HomeMy WebLinkAboutO-11463J-97-108 3/7/97 ORDINANCE NO. 11463 AN EMERGENCY ORDINANCE ESTABLISHING A SPECIAL REVENUE FUND ENTITLED: "LOCAL LAW ENFORCEMENT BLOCK GRANT PROGRAM", AND APPROPRIATING FUNDS FOR THE OPERATION OF SAME, IN THE AMOUNT OF $3,033,834.00, CONSISTING OF A GRANT FROM THE U.S. DEPARTMENT OF JUSTICE; AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANT AND TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR THIS PURPOSE; FURTHER AUTHORIZING THE ALLOCATION OF MATCHING FUNDS, IN THE AMOUNT OF $337,093.00, FROM THE POLICE DEPARTMENT GENERAL OPERATING BUDGET, ACCOUNT CODE 0011000.290301.6.050; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Miami has a strong interest in reducing crime, improving public safety, and expanding its crime prevention program; and WHEREAS, the City applied for and received a grant in the amount of $3,033,834.00, from the United States Department of Justice, Local Law Enforcement Block Grant Program; and WHEREAS, matching funds from the City of Miami, in the amount of $337,093.00, will be required to accept said grant; and WHEREAS, purchases would have to comply with applicable city code purchasing requirements; and WHEREAS, this Ordinance is being presented as an emergency item due, in part, to the fact that the City of Miami has declared a financial emergency exists, and the use of GkMh ME 11463 • these funds is to aid in reducing crime, improving public safety, and expanding the crime prevention program; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: LOCAL LAW ENFORCEMENT BLOCK GRANT PROGRAM RESOURCES: U. S. Department of Justice $3,033,834.00 APPROPRIATIONS: Necessary expenses for the operation of the Local Law Enforcement Block Grant Program $3,033,834.00 Section 3. The City Manager is hereby authorized' to accept the grant as set forth in the Preamble to this Ordinance and to execute the necessary document(s), in a form acceptable to the City Attorney, for acceptance of the aforesaid monies. Section 4. The allocation of matching funds, in the amount of $337,093.00, required for said grant award, from the Police Department General Operating Budget, Account Code 001000.290301 .6.050, is hereby authorized. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. -2- 11463 Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions. of this Ordinance shall not be affected. Section 6. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 7. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 8. BACKGROUND: The Local Law Enforcement Block Grant Program is administered by the U.S. Department of Justice, Bureau of Justice Assistance (BJA). Miami is eligible for $3,033,834.00 in funding to begin during fiscal year 1996-97. The City of Miami is required to provide a cash match in the amount of $337,093.00. These funds were not budgeted for, however, it was determined that the Police Department General Operating Budget could support the required match. The purpose of this grant is to fund local governments to underwrite projects to reduce crime, improve public safety, and start or expand crime prevention programs. Application requirements include non -binding review by an advisory board which has already been done. Also required is a public hearing regarding the proposed use of said funds. This Ordinance is hereby declared to be an emergency measure on the basis that the City of Miami has declared a financial emergency exists and the use of these funds are to aid in reducing crime, improving public safety, and expanding crime prevention programs. i1463.1 TO: Walter J.
