WHEREAS, Ordinance No. 6432 adopted September 2, 1959, created the Miami Fire Fighters' Relief and Pension Fund (the "Fund"); and WHEREAS, certain amendments to said Ordinance are now necessary in order to add certain definitions and other provisions and to ensure that the form of the Ordinance and the operation and administration of the Fund are consistent with ,.applicable law; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 10. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 11. BACKGROUND: Ordinance No. 6432 was adopted on September 2, 1959 providing for the implementation of the Municipal Firemen's Pension Trust Fund Act as authorized by Chapter 175, Florida Statutes through the creation of the Miami Firemen's Relief and Pension Fund. Other than the adoption of Ordinance No. 7979 on July 22, 1971 amending Ordinance No. 6432 no other modifications have occurred since the Ordinance's inception to bring it into compliance with applicable law. Chapter 175 of the Florida Statutes establishes the Firefighters Pension Trust Fund which provides for pension benefits for firefighters. In accordance with Chapter 175 every insurance company, corporation or other insurer engaged in the business of property insurance in Florida is assessed an excise tax on all premiums collected on property insurance policies. On an annual basis the State of Florida remits the premium tax moneys to the City which in turn are deposited in the Miami Firemen's Relief and Pension Fund. Upon a firefighter's termination of employment, disability, retirement, or death benefits are received as specified by the Ordinance. 11462 1 Honorable Mayor and City Commissioners Modification of Ordinance No. 6432 March 10, 1997 Page #2 The International Association of Firefighters, Local 587 is requesting. modifications to Ordinance No. 6432 in response to a letter ruling from the IRS requiring modifications to the Ordinance in order to qualify the fund and remain in compliance with the Small Business Job Protection Act of 1996. The proposed changes to the Ordinance will: 1) clarify the language and reorganize sections of the Ordinance so they are more readable, 2) include proper language for qualification under the IRS code, and 3) allow participants to receive benefits over their lifetime as allowed by a qualified plan. There are no costs to the City as any costs generated by the Fund are paid from the assets of the Fund. The proposed changes to the Ordinance have been reviewed by the City's actuary, A. Foster Higgins & Co., Inc., and they have no objections to the changes. This ordinance applies to Chapter 175 of State statutes, which establishes funding for pension benefits for Firefighters. The current ordinance has been in place for a long time and many issues concerning pensions have since changed. In August of last year, the Small Business Job. Protection Act of 1996 was signed into law. This new law provided for alterations in employee savings and pension plans. The IRS code has been modified to reflect the changes. The IRS now requires that the controlling document of qualified pension plans must adopt these changes in order to remain in compliance. in addition, the "175" Board has been concerned that the current ordinance language is vague in relation to language required by IRS code for qualified pension plans. The Board hired a consulting firm to assist them with qualification criteria, which resulted in the Board sending a "request for review" of the Plan to the IRS. Recently, the 175 Board received a letter from the IRS staring that once the controlling document (Ordinance #6432) has been modified, the fund will clearly be qualified. This favorable response is contingent on modifying and adopting the ordinance within a 90 day time frame from the date of the IRS Haling. Proposed changes to the current ordinance 1) clean up language and reorganizes sections so they are more readable, 2) clear up any question as to whether the Plan is qualified or not, and 3)allows participants to receive benefits over their lifetime. There is no cost to the City of any kind as any costs generated by the Plan are paid from the assets of the Plan.
