HomeMy WebLinkAboutO-11461J-97- 131 2/10/97 ORDINANCE Nt1461 AN EMERGENCY ORDINANCE AMENDING SECTION III OF ORDINANCE NO. 11337, AS AMENDED, ADOPTED JANUARY 25, 1996; THE CAPITAL IMPROVEMENTS APPROPRIATIONS ORDINANCE, THEREBY INCREASING THE APPROPRIATIONS TO EXISTING CAPITAL IMPROVEMENT PROJECT NO. 322061 ENTITLED "TOWER THEATER REHABILITATION" FROM $1,302,800 TO $1,906,800, AN AMOUNT OF $604,000; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission pursuant to Ordinance No. 11337, adopted January 25, 1996, established appropriations for Capital Improvements, continue previously approved Capital Improvement Projects, to begin during Fiscal Year 1996-97; and WHEREAS, the City of Miami has received additional funds from the Twentieth (20) and Twenty -Second (22nd) Years Community Development Block Grant Program funds for Capital Improvement Project No. 322061 entitled "Tower Theater Rehabilitation;" and WHEREAS, it is urgent for the preservation of public property to include said additional appropriations in an amount not to exceed $ 604,000 for this Capital Project scheduled to commence during Fiscal Year 1996-97; and NOW, THEREFORE, BE IT ORDAINED_BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 11461 Ll s Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section III. of Ordinance No. 11337, as amended, adopted January 25, 1996, is hereby amended in the following particulars:' "Section 1. The herein appropriations are hereby made for implementation of all municipal Capital Improvements of the City of Miami, including new Capital Improvement Projects scheduled to begin during fiscal year 1996-1997. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior fund appropriations. The source of revenues to support the herein appropriations is hereby identified by fund and project with the project appropriations with revenues therefor being set forth for seven program (I - VII) areas based upon use or functional category within said areas, as follows: Total Appropriations ($XOOO) III. SOCIAL AND ECONOMIC ENVIRONMENT ECONOMIC DEVELOPMENT A. CAPITAL PROJECTS 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary purchases and payments and to generally carry out the function and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on the two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. 3 11461 11 Section 7 adoption. J S, III CITY ATplllslEY 11461 CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM 5 TO Honorable Mayor and Members DATE : FS 19 W% FILE of the City Commission FROM Edward Marquez City Manager RECONE%IENDATION SUBJECT: Amendment to Capital Improvement Ordinance No. 11337 for emergency reading at Commission Meeting February 27, 1997 REFERENCES: ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached Ordinance amending Capital Improvement Ordinance No. 11337 increasing appropriations for Capital Improvement Project No. 322061, Tower Theater Rehabilitation for $604,000 reallocated from the Twentieth (20ffi) and Twenty -Second (22'� Years Community Development Block Grant Program funds. The theater is a City -owned, public facility located on the comer of S.W. 8th Street and S.W. 15' Avenue anchoring the Latin Quarter Specialty Center in the City of Miami. BACKGROUND In conjunction with the Department of Community Planning and Revitalization, the Office of Capital Improvements has prepared this Ordinance amending Capital Improvement Ordinance No. 11337, adopted January 25,1996, in order to commence the implementation of additional funds received by the City of Miami from various grants sources for the implementation of said Capital Project. The project would rehabilitate the historic Tower Theater into a twin -cinema and regional center in the Latin Quarter District. The total project cost as estimated by the architects is approximately $2,278,429. The funds needed to complete the project are approximately $975,595. Funds available at the present time for the project are $1,302,834 which include a $352,834 grant from the State of Florida Historical Resources, $500,000 grant from the State of Florida Cultural Affairs, and $450,000 from CDBG. The Historical Resources grant expires on March 31, 1997, and the Cultural Affairs grant expires on July 31, 1997. The receipt of the above state grants are contingent on securing the additional funds to begin construction and awarding a construction contract before the expiration .dates of the grants. The Department has requested a six-month extension of the $352,834 grant from Historical Resources. The State's favorable decision on the extension is expected. at the end of February. t146 1 I Tower Theater Ordinance Commission Meeting. Feb. 27", 1997 The strategy that we are recommending to complete the project is to request $604,000 from the Twentieth (20'h) and Twenty -Second (22°d) CDBG Program funds, put the project out to bid with additive alternates, and request $500,000 in the Twenty -Third (23'd) CDBG Program to complete the project alternates, including a contingency fund. The reprogramming from CDBG funds for $604,000 has been scheduled for Commission approval at the hearing on February 27'. The request for $500,000 from the Twenty -Third CDBG Program Year is scheduled for Commission approval on February 20'b. The Community Development (CD) staff has recommended $370,000 and the CD Board has recommended $300,000 for the Twenty -Third Year.
