HomeMy WebLinkAboutO-11457• 0 J-97-40 1/7/97 ORDINANCE NO. 1.1457 AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING SECTION 1513 AND INTRODUCING NEW SECTION 1520 TO PROVIDE FOR A CERTIFICATE OF COMPLIANCE IN -LIEU -OF .A CLASS II SPECIAL PERMIT AND ESTABLISH CRITERIA AND STANDARDS THEREFOR; PROVIDING FOR APPEALS; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of November 20, 1996, Item No. 10,,. following an advertised hearing, adopted Resolution No. PAB 63-96 by a vote of five to zero (5-0), RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its.inhabitants to amend Ordinance No. 11000 as hereinafter set forth;; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted ,by reference thereto and incorporated herein as if fully set forth in this Section. 11457 Section 2. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by amending the text of said Ordinance as follows:l' "ARTICLE 15. CLASS II SPECIAL PERMITS; DETAILED REQUIREMENTS" li Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. 2 11457 Mar Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. 3 11457 Section 5. RECOMMENDATION BACKGROUND AND The Class 11 Special Permit review process has been instituted to ANALYSIS ensure that certain criteria specified in section 1305 of the Zoning Ordinance are observed in an effort to ensure the health, welfare and safety of the community. This evaluation process applies to a wide-ranging series of proposals in numerous districts of the City" Due to the varying degree of complexity of proposals to which this review process applies and due to the numerous forms and referrals involved in the process, the time frame needed to conduct this review has been established at an average of three (3) weeks to a (1) month, by the Zoning Ordinance. It is felt that for many of the simpler proposals the lengthy review process constitutes a significant hardship. For this reason and in an effort to ease the permitting process for them, while continuing to ensure that the applicable criteria are met, an abridged review process has been devised and is herein proposed which would allow the applicant to obtain a certificate of compliance in -lieu -of a Class It Special Permit upon verification that a pre -established series of standards and guidelines are met.
