HomeMy WebLinkAboutO-11456=ir J-97-39 1/7/97 ORDINANCE NO. 114 5 AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, CBD CENTRAL BUSINESS DISTRICT, TO REVISE EXISTING REGULATIONS FOR SIGNAGE AND OTHER APPURTENANCES; FURTHER, AMENDING SECTION 2502 TO REVISE AND CLARIFY EXISTING DEFINITIONS FOR SIGNAGE; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting. of November 20, 1996, Item No. 9, following an advertised hearing, adopted Resolution No. PAB 62-96 by a vote of five to zero (5-0), RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained .in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. !; .q i Section 2. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended. by amending the text of said Ordinance as follows:l' "ARTICLE 4. ZONING DISTRICTS Sec.401. Schedule of district regulations. C-1 Restricted Commercial. CBD Central Business District Commercial. Class II Special Permits: A Class II Special Permit shall be required prior to approval of any permit (except special permits pursuant to article 13) affecting the height, bulk, location or exterior configuration of any existing building; or for the .erection of any new building; or for the. location, relocation or alteration of any structure, sign, awning, landscaping, parking area or vehicular way visible from a public street or waterfront walkway. The purpose of the Class II Special Permit shall be to ensure conformity of the application with the expressed intent of this• district, with the general considerations listed in section 1305, and with the special considerations listed below. In making determinations concerning construction of new principal buildings or substantial exterior alteration of existing principal buildings, the planning director may obtain the advice and recommendations of the Urban Development Review Board. 6. All structures and improvements,on lots abutting any street or waterfront designated as a "primary pedestrian pathway" in the official zoning atlas shall be designed in accord with the standards in the Primary Pedestrian Pathway Design Guides and Standards. l� Words and/or figures stricken through shall be deleted. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions'of this Ordinance shall not be affected. Section 5. PLANNING Approval. RECOMMENDATION BACKGROUND AND It has been found that the proliferation of signage in the ANALYSIS Downtown area has had a significantly adverse impact. For this reason, the subject proposal seeks to amend sign regulations in the Central Business District (CBD) so as to make them slightly more stringent. Simultaneously, it enables property owners in the CBD to apply for signage and other appurtenances, currently subject to Class II Special Permit review, under a new simplified procedure which will expedite the granting of the applicable permits and reduce their expense, for those applicants who are willing to abide by pre -established criteria set forth in the district's Community Appearance Code. Finally, this proposal includes slightly revised definitions for some terms presently contained in the Zoning Ordinance which have proven somewhat vague and at times confusing and difficult to interpret.
