AN EMERGENCY ORDINANCE AMENDING CHAPTER 30, OF
THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED,
ENTITLED "LEISURE SERVICES AND RECREATION", THEREBY
ADDING AND DELETING DEFINITIONS; GRANTING THE CITY
MANAGER THE AUTHORITY TO ESTABLISH AND ADJUST
FEES; MORE PARTICULARLY BY AMENDING SECTIONS 30-1,
30-2, AND 30-6, AND REPEALING SECTIONS 30-3, 30.4, 30-
5 AND 30-7 IN THEIR ENTIRETY; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE; PROVIDING FOR
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. Chapter 30, Article I, of the Code of the City of Miami, Florida, as
amended, is hereby amended in the following particulars:'
Section 2. Sections 30-1 and 30-2 of the Code of the City of Miami, Florida, as
amended, is hereby amended in the following particulars:
'Sec. 30-1. Charges for use of recreational facilities generally.
' Words and/or figures stricken through shall be deleted. Underlined words and/or figures shall be added.
Asterisks and ellipsis represent omitted and unchanged material. The remaining provisions are unchanged and
remain in effect.
I) Definitions. For purposes of this Chapter_ the following terms are
defined as:
"Day use" means the period of time when park sport lights are not used.
"Night use" means the period of time when park sports lights need to be
used.
"City resident" means a person who can prove that their place of residency
is in the City of Miami corporate limit. As for organizations, city residency
means that the organization can prove that its principal office is located
within the City of Miami corporate limits, or in the event that the
organization does not have an office, the person who applies for a permit on
behalf of the organization, and who is authorized to act on behalf of the
organization, can prove that his or her residency is located within the City of
Miami corporate limits. Acceptable documentation to prove city residency
for individuals shall include driver's licenses, voter's registration, official
identification card, utility invoices, current tax bill, military documentation
(for active military individuals currently residing in city corporate limits), etc.
With respect to minors, the residence of such individuals shall be established
by proof provided by such individual's guardian, parent or parents.
Businesses can also furnish copies of occupational licenses, certificates of
use, etc.
(b) Application.
Written applications for the use
of desired park facilities on a specific date shall be submitted to the office of
the director of the Parks and Recreation department by the established
deadlines.
(c) Use Charges. Charges for use of recreations facilities shall be as
follows:44 :
(1) City sponsored activities. There shall be no charge to all
city -sponsored activities, including city -recreation -sponsored
programs, for use of the following recreational facilities: play
area; picnic area; camping area; community building; track
meet (three-hour limit); softball field (two-hour limit); baseball
field (three-hour limit); football/soccer field (four-hour limit).

(2) Schedule of use charges; generally. The city manager
shall establish the schedule of recreational facility use charges
by March 27, 1997. Thereafter, the city manager shall review
and revise the schedule of use charges, annually, prior to the
first day of September, and such use charges, if revised, shall
become effective the first day of October. In reviewing the
existing schedule of use charges to determine whether or not
to revise and adjust the same, the city manager shall take into
consideration any one, or all of the following: (1) operating
expenses; GO city financial needs; (iii) market conditions;
(iv) purpose and type of event(s) or program(s) conducted at
the recreational facility, including benefits to the community;
(v) estimated revenues to be generated; NO and/or other
factors deemed appropriate by the city manager. At any time,
if the city manager determines that the then current schedule
of charges does not properly address a particular type of
usage, the city manager shall be authorized to negotiate the
recreational facility use charge, in the case of a specific event

or use, or establish a use charge in the case of a type of event
or use which is likelto reoccur.
Rules end regulations. The Parks and Recreation Department
director shall establish the rules, regulations and procedures (including
cancellation fees, deposits, etc.) for the usage of recreational facilities in city
Parks, subject to review and approval of the city manager and the city
attorney. Recreational facility usage applications, permits and contracts
shall be subject to review and approval of the city manager and the city
attorney. All users shall be _required to provide the necessary, insurance,
indemnification, etc., as required by the city°s risk management division or
its successor.
(e) Personnel costs. Any additional personnel_ costs deemed necessary
by the Parks and Recreation Department shall be added to the facility rental
fee.
(f1 Fee reductions. The city manager may establish a fee reduction
program to encourage more participation in the city sponsored summer,
holiday, and spring recreation camps."

Section 3. Sections 30-3, 30-4, 30-5, and 30-7 of the Code of the City of Miami,
Florida, as amended, are hereby repealed in their entirety.
Section 4. Section 30-6 the Code of the City of Miami, Florida, as amended, is
hereby amended in the following particulars:
"Section 30.6. Specialized instruction and programs.
(a) Fee formula. The following formula for determining fees for specialized
instruction and programs of the recreation department is hereby established:

C = cost per participant for said specialized instruction or program
P = aai-salary ( exclusive of fringes ) cost to conduct instruction or
program
S = supplies and materials necessary to conduct instruction or program, i.e.,
books, paper, crafts, equipment, etc.
R = rental cost of facility if it has to be especially opened for specialized
instruction or programs
N = number of participants
1.20 = represents a 20% charge for overhead
For a proposed specialized arts and crafts instruction for two 92) hours a
week for ten 00) weeks, or a total of twenty (20) hours' instruction, taught
by a specialist costing five dollars ($5.00) per hour; requiring craft materials
costing sixty dollars (560.00); incurring no 4Wk-eat rental costs; and with
twenty (20) participants, the cost (exclusive of applicable taxes) would be:

Section 5. All ordinances or parts of ordinances insofar as they are inconsistent
or in conflict with the provisions of this Ordinance are hereby repealed.
Section 6. If any section, part of section, paragraph, clause, phrase or word of
this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be
affected.
Section 7. This Ordinance is hereby declared to be an emergency measure on the
grounds of urgent public need for the preservation of peace, health, safety, and property of
the City of Miami and upon the further grounds of the necessity to make the required and
necessary payments to its employees and officers, payment of its debts, necessary and
required purchases of goods and supplies, and to generally carry on the functions and
duties of municipal affairs.
Section 8. The requirement of reading this Ordinance on two separate days is
hereby dispensed with by an affirmative vote of not less than four -fifths of the members of
the Commission.
Section 9. This Ordinance shall become effective immediately upon its adoption.

RECOMN ENDA'I'ION:
It is respectfully recommended that the City Commission adopt the attached emergency
ordinance which, where necessary, formalizes, and provides for fee adjustments and updates to
existing City Code provisions pertaining to usage fees for City park facilities.
BACKGROUND --
The Department of Parks and Recreation has prepared the attached emergency ordinance to
formalize and in some cases adjust the park facility usage fees for such activities as baseball
softball, football, soccer, tennis, swimming, recreation camps, use of community buildings, etc.
It should be noted that many of these fees have not been adjusted in at least eight (8) years.
In developing these fee recommendations, we conducted an extensive review of current fees
being utilized by other local municipalities and adapted them to our own situation. Additionally,
we attempted as much as possible to take into consideration the type of facilities we had and also
the "ability to pay" of our users.
The M. Steirheim Strategic Recovery Financial Plan recommended that park user fees be
increased and that the additional revenues generated be reimbursed into park programs. Already
the City Commission has taken action (on November 21, 1996) to adjust the following charges
associated with special events and other social functions at city parks: facility rental, beer and
wine sales, concessions, as well as showmobile, bleachers and public address system rentals.
The attached legislation would also authorize the City Manager to annually review and adjust
fees, if necessary, based upon certain specified factors. The increased income from these fee
adjustments would represent much needed revenue to the City's Park and Recreation
Department.
