PROVIDING FOR AN EFFECTIVE DATE. the Miami Planning Advisory Board, at its meeting 1996, Item No. 4, following an advertised public hearing, adopted Resolution No. PAB 36-96 by a vote of seven to one (7-1), RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as hereinafter set forth; and WHEREAS, 4 the City Commission after careful consideration of this matter deems t auvisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. 0,44. � i f t I 11441 i Yt''t Section 2. Ordinance No. 11000, as amended, the Zoning At ordinance of the City of Miami, Florida, is hereby amended by amending the text of said Ordinance as follows:'-' "ARTICLE 9. GENERAL AND SUPPLEMENTARY REGULATIONS See. 9-1-6. Reserved. Sec. 916. Interim parking. 916.1. Intent. It is intended that this section allow for a mechanism which will enable conditionally, unimproved and partially improved lots in the City to be utilized, for accessory parking purposes in a temporary fashion or as a component of facilities which require parking on an event by event basis, without having to pave the proposed interim lots to accomplish this goal. As specified herein, proposals subject to this section shall also ensure that safety measures are implemented which will safeguard users of the subject facilities. I 916.2. Special permit required for approval. An interim parking facility shall be defined as a surface parking lot for which paving, drainage and marking of parking spaces as well as other improvements incidental to permanent parking lots shall not be required. Asterisks indicate omitted and unchanged material. 2 11441 There shall be two (2) types of interim Yp parking as follows: s (a) Temporary special event parking, and (b) Short-term event parking. 916.2.1. Temporary special event parking. Temporary special event parking on unimproved interim parking lots, as defined herein, shall only be permitted pursuant to Class I Special Permit and only in conjunction with an approved special event that requires the additional Darkina to be accommodated on said lot(s). 916.2.2. Short-term event parking facilities. Short-term event parking facilities shall be permitted as a conditional use on non - residentially zoned lots, within a six hundred (600) foot radius of the major public facility they are intended to serve, pursuant to a Class II Special Permit and only in conjunction with major public facilities such as major sports facilities, arenas, 3 11441 exhibition centers, performing arts centers and any other such major public facility whose scale and operation. warrant the use of interim parking facilities on an event-b event basis versus dais year-round use. Parking spaces provided on this type of interim parking facility shall not be counted toward meeting required parking for any such major public facility. 916.3. Considerations and standards. In order to mitigate any potentially adverse effects that unimproved interim parking lots may have on adjacent areas, all such facilities intended to be utilized as short-term event parking, as described in Sec. 916.2.2. above, shall be required to maintain a park -like appearance to consist of fully sodded lots over an approved stabilized, below grade, pervious system or any other type of system which provides a honeycomb type stabilized base underneath the lot and therefore allows for parking on the sod while not impeding drainage. 4 7 1144 } tt t 4 } tr 1 �t Interim parking facilities may also be used for k i57t _ Y t t the temporary staging of miscellaneous equipment and/or t It vehicles necessary for any of the functions associated with an approved special event or an activity taking glace in a major public facility subject to all applicable regulations and special permits listed above. All interim parking and staaincr activities ermissible under this section shall be limited in duration to a_ time specified in the special permit obtained. The duration shall run concurrently with the event or activity requiring said parking or staging, 1 and may be expanded on a limited basis to allow for preparation, disassembly and activities related to that specific event or activity. In addition to the considerations and standards listed generally in Section 1305 of this ordinance, Class I and Class II Special Permits for interim parking facilities shall also consider the following: a) Use of traffic monitors to facilitate vehicular flow into and out of such facilities during major events; 5 1144 1 r"^ (b) Use of specialized lighting features to rr 3. ensure safety when such facilities are Y, proposed for evening use; and h (c) Use of perimeter fencing to assist in the control of access points and security of proposed lots while not in use. ARTICLE 25. DEFINITIONS Specific definitions. Interim Parking Facility. A surface parking facility_ for which paving drainage and marking of parking spaces as well as other improvements incidental to permanent parking lots shall not be required: interim larking facilities shall only be permitted upon approval of a special permit pursuant to the regulations set forth in Section 916 of this zoning r ordinance. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. 6 11441 1 If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Not applicable. Consideration of amending Article 9, Section 916. to introduce a new section entitled "Interim Parking" and Article 25, Section 2502, Speck Definitions, in order to provide a definition for "Interim Parking Facility". Approval. The proposed amendment to introduce "Interim Parking" into Zoning Ordinance 11000 was drafted in an effort to recognize that short term or event parking in conjunction with major public facilities is a real need that to date has been accommodated on dirt lots without the benefit of review or approval by the City. The proposed ordinance will now offer a mechanism by which these facilities can be permitted and by which the City can require that certain conditions be met in order to mitigate any potentially adverse effects that such facilities and special events can cause. A particularly innovative requirement of this ordinance is that all such facilities maintain a park -like appearance by using a new type of grasspave porous system which provides a honeycomb type stabilized base upon which sod can be planted to allow for parking on the sod and therefore maintain a green space that is safe for parking and does not impede drainage. This system is particularly effective and ideally suited for the use proposed herein which pertains to lots that are used for event -to -event type parking situations versus daily year-round use.
