HomeMy WebLinkAboutO-11437.1q J-96-659 9/11/96 ORDINANCE NO. 1437 AN ORDINANCE AMENDING THE ZONING ATLAS BY CHANGING THE ZONING CLASSIFICATION, FROM C-1 RESTRICTED COMMERCIAL TO C-2 LIBERAL COMMERCIAL, FOR THE PROPERTIES LOCATED AT APPROXIMATELY 301-583 AND 300-598 NORTHWEST 54TH STREET, MIAMI, FLORIDA; AND BY MAKING ALL NECESSARY CHANGES ON PAGES 13 AND 16 OF SAID ZONING ATLAS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. -9114 WHEREAS, the Planning Advisory Board, at its meeting of July 17, 1996, Item No. 3, following an advertised public hearing, adopted by Resolution No. PAB 35-96, by a vote of eight to zero (8-0), RECOMMENDING APPROVAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Atlas of Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by changing the zoning classification from C-1 Restricted Commercial to C-2 Liberal Commercial for the properties located at approximately 301-583 and 300-598 Northwest 11437 54th Street, Miami, Florida, more particularly described as followst Lots 11-15, Block 9; Lots 11-15, Block 10; Lots 11-15, Block 11, and Lots 11-15, Block 12, BUMA VISTA GARDRNS, as recorded in Plat Book 5, at page 45, and Lots 1-9 and 19-21, Block 10, and Lots 1-3 and 7-15, Block 11, RAILWAY SHOP ADDITION, as recorded in Plat Book 3, at Page 183 of the Public Records of Dade County, Florida. Section 2. It is hereby found that this zoning classification change: (a) is in conformity with the adopted Miami Comprehensive Neighborhood Plan; and (b) is not contrary to the established land use pattern; and (c) will not create an isolated district unrelated to adjacent and nearby districts; and (d) is not out of scale with the needs of the neighborhood or the City; and (e) will not materially alter the population density pattern or increase or overtax the load on public facilities such as schools, utilities, streets, etc.; and (f) is necessary due to changed or changing conditions; and I (g) will not adversely influence living conditions in the neighborhood; and (h) will not create or excessively increase traffic congestion or otherwise affect public safety; and (i) will not create a drainage problem; and 2 11437 '•r ,44� (j) will not seriously reduce light and air to adjacent area; and W will not adversely affect property value in the adjacent area; and (1) will not be a deterrent to the improvement of development of adjacent property in accord with existing regulations; and (m) will not constitute a grant of special privilege to an individual owner so as to compromise the protection of the public welfare. Section 3. Page Nos. 13 and 16 of the Zoning Atlas, made a part of Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, by reference and description in said Ordinance, are hereby amended to reflect the changes made necessary by this amendment. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section S. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 7. This Ordinance shall become effective after final reading and adoption thereof pursuant and subject to Section 163.3189, Fla. Stat. (1995). CASE NO: 95-257 Pursuant to Article 4, Section 401 and Article 22 of Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed for an amendment to the Zoning Atlas as follows: The request is to change the Zoning designation as follows: Lots fronting NW 54* Street between NW 3' and 6" Avenues at approximately 301 to 583 and 300 to 5" NW 54th Street from C-1 "Restricted Commercial" to C-2 "Liberal Commercial ". The proposed change has been brought about due to concerns expressed to the Depart- ment of Community Planning and Revitalization by citizen leaders, who share a convic- tion that the actual zoning designation of this area is not helping the development and re- vitalization of this commercial strip. The following findings have been made: • It is found that the existing buildings on the majority of the 44 lots that comprise the subject properties, actually designated C-1 "Restricted Commercial", are warehouse type structures that have been and actually are grandfathered and utilized for uses permitted in the C-2 "Liberal Commercial' zoning designation and not in the C-1 "Restricted Commercial" designation. • It is found that this application if approved, will create a buffer area along NW 50 Street between the C-I "Restricted Commercial' zoned area east and the I-95 Ex- .r pressway, west of the subject properties, with more heavy commercial uses in the ex- isting structures and facilitating the development of similar and/or ancillary uses per - witted in the C-2 "Liberal Commercial" that will result in a more effective revitali- zation of the area • It is found that the existing conditions and the potential future development of this area are not consistent with the actual zoning designation. • It is found that at the present time, the C-I "Restricted Commercial' designated areas, west and east of the subject properties have sufficient capacity to accomodate light commercial activities.
