HomeMy WebLinkAboutCC 1997-04-28 City Clerk's ReportCITY OF MIAMI CITY CLERK'S REPORT MEETING DATE: April 28, 1997 A MOTION ACCEPTING IN PRINCIPLE PROPOSED LANGUAGE FOR A BALLOT QUESTION IN CONNECTION WITH A SPECIAL ELECTION TO BE HELD SEPTEMBER 1997 AS FOLLOWS: "SHALL THE CITY OF MIAMI RETAIN ITS EXISTENCE AS A MUNICIPALITY AND NOT BE ABOLISHED, EFFECTIVE SEPTEMBER 30, 1998, IN ACCORDANCE WITH RESOLUTION NO. WHICH REQUIRES A PROPOSAL FOR THE TRANSFER OF MUNICIPAL FUNCTIONS, SERVICES, RESPONSIBILITIES AND LIABILITIES IN THE EVENT OF A FAVORABLE VOTE ON DISSOLUTION BY THE ELECTORATE." Direction to City Clerk: by Vice Mayor Regalado to forward to his office the Spanish translation of the ballot question for perusal of same, Direction to City Clerk: by Mayor Carollo to use a professional translation service rather than Metropolitan Dade County's translator in connection with the translation of the proposed September Special Election ballot question. Direction to City Attorney: by Commissioner Plummer to draft four or five alternate proposals before May 7, 1997 stipulating transfer of municipal functions, services, responsibilities and liabilities, in the event of a favorable vote on dissolution by the electorate. Direction to City Attorney: by Mayor Carollo to outline in writing the legal procedures which must be followed in connection with proposed abolishment of the City of Miami. Note for the Record: The Commission stated that it would, on May 7, 1997, select the date to hold the Special Election on whether the City of Miami shall retain its existence as a municipality, and not be abolished. Direction to City Manager: by Commissioner Plummer to schedule on the May 7, 1997 Commission meeting consideration of the estimated cost for an educational mail -out to the public in connection with the proposed Special September 1997 election. PAGE NO. 1 M 97-301 MOVED: PLUMMER SECONDED: GORT UNANIMOUS CITY OF MIAMI CITY CLERK'S REPORT MEETING DATE: April 28, 1997 Direction to City Manager: by Mayor Carollo to send a letter to be delivered by hand today to the County Manager stating the text of Resolution 97-292, which passed on April 10, 1997, stating as follows: (1) that the City of Miami is only interested in the leasing of the Maritime Park property and shall accept at a minimum the assessed value of said property in connection with said leasing; (2) that no additional extensions shall be granted to Metropolitan Dade County to agree to the terms of a lease of said property beyond May 1, 1997; (3) that the City shall pursue the lease of said property to other entities should the County fail to agree to terms by said date; (4) that the City insists that the Maritime Park Board maintain the membership composition originally established by the County which consists of two members appointed by the County, two members appointed by the City, and a fifth member to be appointed by said four members seated on said board. Direction to City Clerk: to provide copies of the minutes to the Commission concerning the City going into the port business. Direction to City Manager: by Commissioner Plummer to consider the City going into the port business in the event that Metropolitan Dade County fails to reach an agreement with the City for use of the Maritime Park Property. Note for the Record: Commissioner Plummer congratulated the Police Department in connection with the confiscation of the first 12 cars which were used in the buying of illegal drugs. Owners of such cars have to pay approximately $588 in order to get car back from Police. Direction to City Manager: by Mayor Carollo to sell the City's limousine. Note for the Record: A closed door attorney -client executive session was scheduled to take place at 8:30 a.m. on May 7, 1997 for purpose of discussing pending litigation in Pottinger v City of Miami, United States District Court Case. Direction to City Manager: by Commissioner Plummer to keep the Commission informed regarding revenue proposal proffered by the City regarding sale of certain City properties and the State Financial Oversight Board's response to same. PAGE NO. 2 CITY OF MIAMI CITY CLERIC'S REPORT MEETING DATE: April 28, 1997 APPROVED: Direction to City Manager: to forward to each Commissioner copies of all documents pertaining to budget or other monetary matters of the departments each Commissioner is reviewing. Mayor Carollo appointed Commissioner Plummer to co -review the Department of Community Development with Vice Mayor Regalado, Mayor Carollo further appointed Commissioner Gort to review the possibility of privatizing the Department of Off -Street Parking. Commissioner Plummer is also to review the use of the Dinner Key Boat Yard property. Direction to the City Manager: by Commissioner Plummer to instruct a City staff person(s) to compare the assessed value of all major City properties with the price listing of properties sold, that is published in the Miami Daily Business Review; further directing the Manager to instruct a City staff person(s) to pursue with the Dade County Property Appraiser the appropriate assessment of City properties, consistent with Florida Statutory provisions requiring properties to be assessed at 100 percent of their fair market value. Note for the Record: a Special Commission meeting was scheduled for Monday, May 5, 1997 at 7 a.m. to review possible changes to the Five Year Financial Recovery Plan. NOTE: AS DULY NOTED ON THE HEREIN AGENDA AND CITY CLERK'S REPORT, WHICH CONSTITUTE A JOURNAL OF CITY COMMISSION PROCEEDINGS, THE "UNANIMOUS" NOTATION NEXT TO THE VOTE ON EACH AGENDA ITEM MEANS THAT ALL FIVE CITY COMMISSIONERS WERE PRESENT AND VOTED "AYE" ON SAID ROLL CALL VOTE. NEGATIVE VOTES, PHYSICAL ABSENCE OF A COMMISSIONER OR ABSTENTION FROM VOTING BY A COMMISSIONER, IF ANY, 1S ALSO DULY REFLECTED IN SAID VOTE. PAGE NO. 3
