The issue of abolition was initiated by a petition of ten (10) percent of the qualified electors of the City of Miami and certified by the Supervisor of Elections on January 7, 1997. The proposed abolition resolution must be adopted by the City Commission within 120 days of certification of the petition for abolition, i.e. May 7, 1997. A late August election has been proposed. I have enclosed herewith a timetable indicating the latest date in April that adoption can be had in order to have this issue placed on the ballot in late August. The election must occur not less than 60 nor more than 120 days after the adoption of the resolution. Accordingly, the latest date the election can be held is September 4, 1997. Section 5.03 of the Dade County Charter requires the governing body to make copies of the abolition proposal available to the electors not less than 30 days before the election. The abolition proposal as such would set forth how the functions, duties responsibilities, services and potential liabilities are to be provided for. As of this date, I am unaware of a proposal for operation in the event of a favorable vote on dissolution. In conferring with the County Attorney, Robert Ginsberg', he has indicated his opinion that the ballot language should make reference to some existing "proposal" for dissolution. 1 I have conferred with Mr. Ginsberg and considered his opinion because Section 5.03 is a provision of the Metropolitan Dade County Charter for which the Dade County Attorney's Office is responsible for interpreting. However, the proposal for abolition must be made available for review by the electorate not less than 30 days prior to the election. Nevertheless, the time parameters are imminent insofar as action to be taken on your part. Proposed Ouestion: SHALL THE CITY OF MIAMI BE ABOLISHED AND CEASE TO EXIST AS A MUNICIPAL ENTITY, EFFECTIVE SEPTEMBER 30, 19989 IN ACCORDANCE WITH RESOLUTION NO. WHICH REQUIRES A PROPOSAL FOR THE TRANSFER OF MUNICIPAL FUNCTIONS, SERVICES, RESPONSIBILITIES AND LIABILITIES IN THE EVENT OF A FAVORABLE VOTE ON DISSOLUTION BY THE ELECTORATE.
