*1 A MOTION INSTRUCTING THE CITY ATTORNEY TO
AMEND THE PROPOSED BALLOT QUESTION ("SHALL
THE CITY OF MIAMI BE ABOLISHED AND CEASE TO
EXIST AS A MUNICIPAL ENTITY, EFFECTIVE SEPTEMBER
30, 1998, IN ACCORDANCE WITH RESOLUTION NO.
WHICH REQUIRES A PROPOSAL FOR THE
TRANSFER OF FUNCTIONS, SERVICES,
RESPONSIBILITIES AND LIABILITIES IN THE EVENT OF A
FAVORABLE VOTE ON DISSOLUTION BY THE
ELECTORATE") IN ORDER THAT SAID QUESTION IS
PHRASED IN THE POSITIVE SO THAT A YES ANSWER BY
THE ELECTORATE INDICATES THAT THE CITY OF MIAMI
SHALL RETAIN ITS EXISTENCE AND NOT BE ABOLISHED;
FURTHER DIRECTING THE CITY ATTORNEY TO BRING
BACK SAID AMENDED LEGISLATION TO BE CONSIDERED
AT THE EARLIEST AVAILABLE DATE.

*2 Note for the Record: A Special Commission meeting was
scheduled for Monday, April 28, 1997 at noon to consider
proposed ballot question language for Special Election to be
held on September 4, 1997 to consider whether the City of
Miami, a Florida Municipal Corporation, shall retain its
existence and not be abolished. Mayor Carollo stated that the
Commission will consider the rescheduling of the attorney -
client closed session on Pottinger vs. City of Miami during the
Special meeting of April 28, 1997.

MEETING DATE: April 23, 1997
Direction to the City Manager and the City Attorney: by Mayor
Carollo to guide the Commission in the legal and
administrative aspects in putting together the proposal (for
transfer of municipal functions, services, responsibilities and
liabilities in the event of a favorable vote on the municipal
corporation dissolution by the electorate) for the Commission's
consideration, review and approval within the designated time
frame that is required.
*3 Direction to the Administration: by Commissioner Plummer to
educate the public regarding the conduct of a Special Election
to vote on the issue of whether the City of Miami, a Florida
Municipal Corporation, shall retain its existence and not be
abolished.
APPROVED:
Direction to the City Attorney: by Commissioner Regalado to
explore the legality of establishment of a fund to place monies
received from private sources in connection with financing the
Special Election regarding the abolition issue.
Note for the Record: Commissioner Plummer congratulated
the Miami Police Chief Don Warshaw and the Police
Department on their recent efforts to control drug activity in the
West Grove area.
NOTE: AS DULY NOTED ON THE HEREIN AGENDA AND CITY CLERK'S
REPORT, WHICH CONSTITUTE A JOURNAL OF CITY COMMISSION
PROCEEDINGS, THE "UNANIMOUS" NOTATION NEXT TO THE VOTE ON
EACH AGENDA ITEM MEANS THAT ALL FIVE CITY COMMISSIONERS
WERE PRESENT AND VOTED "AYE" ON SAID ROLL CALL VOTE.
NEGATIVE VOTES, PHYSICAL ABSENCE OF A COMMISSIONER OR
ABSTENTION FROM VOTING BY A COMMISSIONER, IF ANY, IS ALSO
DULY REFLECTED IN SAID VOTE.
