CITY OF MIAMI
CITY CLERK'S REPORT
MEETING DATE: April 14, 1997
Direction to the City Attorney: by Commissioner Plummer
to review contract involving the City of Miami, Miami
Greater Associates, and the University of Miami in order
to ascertain whether the failure of University of Miami to
honor its commitment to have 100,000 people annually
for conferences in the James L. Knight / University of
Miami Conference Center is a material breach of contract
sufficient to sue the University of Miami.
Direction to the City Manager: by Commissioner Gort to
go step by step over the proposed fire fee, in order to
provide the public with a better understanding on
information related to the development of the proposed
fire fee and the application of its assessment. Further,
directing the City Manager to work with the private sector
in order to bring new ideas for reoccurring revenue
sources.
Direction to the Administration: by Mayor Carollo for the
administration to explain the applicability of the proposed
fire assessment fee to nonprofit groups as well.
Direction to the City Attorney: by Mayor Carollo to
research further how to minimize the effect on the City of
the 1969 Interlocal Agreement signed in perpetuity with
Metropolitan Dade County regarding public housing,
which prohibits any assessment or collections by the City
on the County.
Note for the Record: Vice Mayor Regalado stressed need
to (a) listen to employee ideas; (b) explore other
alternatives to the fire assessment fee; (c) consider
privatizing Solid Waste function, which would spurn the
elimination of the fire fee; (d) review departmental
expenses to determine other savings; (e) start an
aggressive media campaign to inform the public about the
fire fee; (e) encourage apartment owners not to increase
rent until next year.
Note for the Record: Commissioner Gort indicated that
there are people downtown who are willing to work with
the City. He further stated that the City cannot make a
determination regarding where to further reduce
expenditures because the City does not know what the
consequences will be.

Note for the Record: Vice Mayor Regalado requested
each Commissioner to observe designated departments,
and bring back to the Commission new ideas for not only
recurring revenues, but also for reasonable savings within
departments.
Direction to the Administration: by Commissioner
Plummer to research and obtain further details and
provide the Commission with a report related to the
"business pleasure" concept articulated by Mayor Rendell
of Philadelphia in his presentation before the State
Oversight Board, whereby fees are assessed to
companies that reside outside the city limits but that are
engaged in doing business within the city.
Direction to the Administration: by Commissioner Plummer to
include The Florida League of Cities in the City's procurement
process specifically as it relates to Workers' Compensation
and insurance underwriting issues.
Note for the Record: Commissioner Gort introduced into the
public record a letter from an ad hoc committee of downtown
property owners which urged the Commission to consider
their taxes as already being paid.
Direction to the Administration: by Commissioner Plummer to
consider charging nonresidents and residents with insurance
for emergency medical services in the near future.
Note for the Record: Mayor Carollo stated that the
Commission will continue to work to decrease the fire fee and
to bring more reoccurring revenue to the City.
Direction to the Administration: by Commissioner Plummer to
give priority to Solid Waste workers when considering
privatization, if the Solid Waste workers can match the best
offer from the private sector.
Direction to the City Attorney: by Mayor Carollo to research the
concept of "negative benefit" whereby fees are assessed on
vacant lots.

Direction to the Administration: by Commissioner Gort to work
together with the union representatives, specific industry
experts and staff to ascertain ways to generate recurring
revenues. Further requesting of the Administration to
disseminate information to the public regarding assessed fees
in order to properly educate them.
Note for the Record: Tom Gabriel, president of the
International Association of Firefighters (IAFF) urged the
Commission to appoint at least one appointee representing
IAFF to the Blue Ribbon Task Force established to assist in
developing recommendations and plans to improve business
practices of the City's government.
Direction to the Administration: by Commissioner Plummer to
provide the Commission with a report on actual monies
brought in by the City of Miami Police Department's Marine
Patrol program that were deposited into the general fund.
Direction to the Administration: by Vice Mayor Regalado to
report on the status of the Special Emergency Fund
established from Community Development Block Grant
Program Income and if there are any funds available.

research and provide an answer to the Commission by the
next Commission meeting to the following issue: Why has the
United States Federal District Court allowed the federal
government to put up a fence around its property in response
to encroachment by homeless persons, while the City of Miami
has not been allowed to do the same?
