WR I I; WT SUBJECT: 1001 MacArthur Causeway on Watson Island (Miami Yacht Club) REFERENCES: ENCLOSURES: FILE : I 'i Discussion concerning the future use of the City -owned facility located at - 1001 MacArthur Causeway, Miami, Florida, on Watson Island. BACKGROUND Since 1947, this site has been utilized by the Miami Yacht Club ("MYC") for the purpose of providing marine recreational services including such usual functions incidental to boat club operations. The most recent lease governing MYC's use of the property was approved by the City Commission on February 11, 1982 by Resolution 82-95. This lease agreement provided for a term of three years. The rental consideration was the greater of (1) the base rent of $16,326.29 annually, or (2) the per capita tax times the number of non-resident members or (3) ten percent of gross income. Following a request by MYC, the Commission adopted Motion 82-324 which authorized the MYC to pay the minimum rent only until such time as the City would adopt plans for Watson Island with some certainty, at which time the MYC would be permitted to apply for a lease compatible with the plans. By Resolution 84-728, the Commission formally waived the percentage charge of gross income and per capita tax times the number of non- resident members. Since the expiration of the lease on February 28, 1985, the MYC has continued to occupy,the property on a month -to -month basis under the same terms and conditions of the lease agreement as amended by Resolution 84-728. 7,1 Honorable Mayor and Members of the City Commission Page 2 On November 2, 1993, the electorate of the City of Miami approved Charter Amendment No. 1 thereby amending the Charter of the City of Miami to establish a procedure for waiving competitive bidding and referendum requirements when entering into a lease or extending an existing lease with a nonprofit, noncommercial, water -dependent organization which provides or seeks to provide marine -recreation services and/or activities to the community at any city -owned waterfront property, provided certain conditions are met pertaining to public access, public use, waterfront setback and view -corridor requirements, fair return to the City, compliance with the master plan and requirements prescribed by ordinance pertaining to an organization using city -owned facilities. As a result of the adoption of this Charter amendment, the MYC has inquired regarding the negotiation of a new lease agreement for its continued use of this space. It should be noted that the City was deeded the lands constituting Watson Island by the State of Florida in 1949. This deed includes a restriction that Watson Island be used solely for public and municipal purposes only. The deed expressly prohibits the sale or lease of lands to any private person or corporation for private purpose. On March 23, 1993 the Board of Trustees of the Internal Improvement Trust Fund found the use by the Miami Yacht Club to be consistent with the deed. Additionally, the City has on occasion been able to obtain from the Trustees -a waiver of this deed restriction. Most recently, the City was granted a waiver of the deed restriction authorizing the City to enter into a lease agreement with Parrot Jungle subject to the State receiving a portion of the revenues received by the City from the lease. RECOMMENDATION The Department of CPR, Division of Asset Management recommends the City Commission authorize the City Manager to negotiate a new lease agreement with the Miami Yacht Club for its continued use of the property which lease shall be subject to the review and approval of the City Commission.
