Dear Mr. Marquez:
By letter dated October 26, 1996, 1 had requested. a personal appearance before
the City Commission. In response to this request, I had a telephone conversation in
November, 1996 tenth Lourdes Slazik of the City of Miami Planning Department. In
our conversation, it was agreed that my desire to appear before the City Commission
could not be resolved by staff as I Avished to discuss a matter of policy. Ms. Slazik
advised me that she would send a memo to the City Manager's office outlining our
discussion and our resolution that my request could not be resolved by staff.
Please schedule a personal appearance for me at the earliest possible meeting.
Please note that I am the President of Homeowners' .Association in this area and have
requested an appearance before the City Commission regarding a matter that is currently
pending and requires immediate discussion.

RECOMMENDATION
It is respectfully recommended that the City Commission listen to the concerns expressed
and request that a study be conducted of this area prior to any specific direction regarding
changes in zoning.
;BACKGROUND
The requested personal appearance is for the purpose of discussing the zoning for the area
generally surrounding S.W. 28" Street between S.W. 26"' Avenue, Jefferson Street and
S.W. 27" Avenue. This particular area was rezoned in 1989-90 along with the rest of the
City during the time when the Planning Department replaced Zoning Ordinance 9500
with Zoning Ordinance 11000. The changes which were made on the subject properties
were approved by the City Commission at that time, with the inclusion of the SD-19
overlay; the SD-19 overlay puts a limitation on the F.A.R. of these properties. In this
case, the property has an F.A.R. limitation. of 0.5,
It seems that the current concerns revolve around a recent Class II Special Permit which
was granted for the property located at 2630 S.W. 28`j' Street for a Hotel use. The
property in question is zoned "O" Office, with SD-3 and SD-19 overlay districts. The
proposed hotel use is permitted in the district, and the project went through a substantial
design review process.
