" 8- 1 2 2 8 A RESOLUTION, WITH ATTACHMENT, AFFIRMING THE DECISION OF THE ZONING BOARD THEREBY GRANTING A SPECIAL EXCEPTION FROM THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, TO PERMIT A HEALTH CLINIC IN THE R-3 ZONING DISTRICT FOR THE PROPERTY LOCATED AT 3230 WEST FLAGLER STREET, MIAMI, FLORIDA, PER PLANS ON FILE, AS MODIFIED TO COMPLY WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION REQUIREMENTS, AND WITH A TIME LIMITATION OF TWELVE (12) MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED AND SUBJECT TO THE FOLLOWING CONDITIONS: 1)THE PROPOSED FACILITY SHALL BE LIMITED TO OUTPATIENTS ONLY WITH NO OVERNIGHT STAY; 2) A COMPLETE NEW LANDSCAPE PLAN, WITH SPECIFICATIONS, INCLUDING IRRIGATION AND ILLUMINATION MUST BE SUBMITTED FOR REVIEW AND APPROVAL BY THE PLANNING DIVISION PRIOR TO THE ISSUANCE OF ANY BUILDING PERMITS. WHEREAS, the Miami Zoning Board at its meeting of November 2, 1998, Item No. 5, adopted Resolution No. 1998-0111 by a vote of six to zero (6-0), recommending the granting of a Special Exception requiring City Commission approval as hereinafter set forth; and WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, requires City Commission approval of the Special Exception as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter, finds the application for Special Exception does meet the applicable requirements of 17C7 (S) No. 11000, CITY Corwssiox MEETING OF DEC 0 9 1998 RQaolution No. as amended, and deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to affirm the decision of the Zoning Board and grant the Special Exception as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The decision of the Zoning Board to grant a Special Exception from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 4, Section 401, Schedule of District Regulations, to permit a health clinic in the R-3 Zoning District for the property located at 3230 West Flagler Street, Miami, Florida, legally described as shown as Exhibit 111" attached hereto and made a part hereof, is hereby affirmed and the Special Exception is hereby granted per plans on file, as modified to comply with the Florida Department of Transportation requirements, with a time limitation of twelve (12) months in which a building permit must be obtained and subject to: 1) the proposed facility shall be limited to outpatients only with no overnight stay; and 2) a complete new landscape plan, with specifications, including irrigation and illumination must be submitted for review and approval by the 2 - 98-1228 Planning Division prior to the issuance of any building permit. CASE NO. 1998-0158 Pursuant to Section 401 of Ordinance 11000, as amended, The Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed to allow a Health Clinic (medical Office) in the R-3 Multifamily Medium -Density Residential District as follows: The following findings have been made: • It is found that the proposed Health Clinic use will be beneficial to the area in pro- viding a needed service to the community. • It is found that the design of the proposed Health Clinic (medical office) is in scale and character with the surrounding area. • It is found that the submitted plans comply with the requirements, including parking, ingress and egress and open space. • It is found that on the presented landscape plan, the amount of trees along the pe- rimeter of the property and landscape islands is deficient and should be increased. • It is found that upon compliance with conditions set forth below, this project will not have any adverse impacts on the surrounding area.
