A RESOLUTION, WITH ATTACHMENTS, AUTHORIZING
THE CITY MANAGER TO EXECUTE AN INTERLOCAL
AGREEMENT, IN SUBSTANTIALLY THE ATTACHED
FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND
MIAMI-DADE COUNTY, TO PROVIDE FOR THE CITY'S
PARTICIPATION IN THE STATE OF FLORIDA,
DEPARTMENT OF COMMUNITY AFFAIRS, LOCAL HAZARD
MITIGATION STRATEGY PROGRAM AND TO ALLOW THE
CITY TO RECEIVE A GRANT AWARD, IN AN AMOUNT
NOT TO EXCEED $75,000, TO FUND EMERGENCY
MANAGEMENT AND HAZARD MITIGATION PROJECTS.
WHEREAS, the Florida Department of Community Affairs ("DCA")
has developed a Local Hazard Mitigation Strategy to assist all
Florida counties and their respective municipalities to create a
comprehensive disaster mitigation plan; and
WHEREAS, Miami -Dade County, has been designated as the
grantee for receipt of State funds for said plan, with the
authority to award grants to its municipalities; and
WHEREAS, it has been determined that the City of Miami is
eligible for participation in said disaster mitigation plan; and
WHEREAS, upon execution of an interlocal agreement with
Miami -Dade County, the City of Miami will be awarded a grant, in
an amount not to exceed $75,000, to fund emergency management and
hazard mitigation projects; and
WHEREAS, the City's participation in the planning strategy
will create a more disaster resistant and economically viable

community, and ensure the City's control and prioritization of
local mitigation goals, and enhance the City's chances of
accessing state and federal disaster mitigation and recovery
grant funding;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorizedY to
execute an agreement, in a form acceptable to the City Attorney,
in substantially the attached form, between the City of Miami
("City") and Miami -Dade County, to provide for the City's
participation in the State of Florida, Department of Community
Affairs, Local Hazard Mitigation Strategy Program and to allow
the City to receive a grant award, in an amount not to exceed
$75,000, to fund emergency management and hazard mitigation

Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.21/

If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

INTERL.00AL AGREEMENT
FOR JOINT COMPLETION OF A LOCAL MITIGATION STRATEGY
This Interlocal Agreement is being entered into this day of , 1998, by and between
Miami -Dade County ("County'l and the City of ("City') in order to jointly
complete a Local Mitigation Strategy as described in the attached Scope of Work and in the
Department of Community Affairs (DCA) publication The Local Mitigation . Strategy: a
Guidebookjor Florida Cities and Counties, hereafter referred to as "the Guidebook."
It is agreed that the City shall assist in the development of the Local Mitigation Strategy
("LMS') using the Guidebook as well as other applicable guidance. The City shall participate in
this process in order to achieve a single, unified LMS for the County.
It is agreed that the County will pay compensation at the end of each contract period based on
completion of activities identified in this Scope of Work The payment will be made after the
subcontractor submits all deliverables, within the scheduled time frame, and a determination is
made by the County that the City has satisfactorily completed the pertinent activities and
deliverables. All payments will be -made as soon as possible, following receipt of payments from
the DCA, to the County.
It is agreed that at the end of the first contract period, the City may be paid twenty (20) percent
of the total contract amount, twenty (20) percent at the end of the second contract period, forty
(40) percent at the end of the third contract period, and the remaining twenty (20) percent of the
total contract amount at the end of the fourth and final contract period. The City shall submit all
deliverables in the format prescribed by the County. The final deliverable shall be an agreed -
upon local mitigation strategy document submitted by the County to the DCA.
This agreement shall remain in effect throughout the life of the Local Mitigation Strategy
program, currently scheduled to expire July 1, 1999. This agreement may be modified by the
mutual written consent of both parties and as required by revisions to the statute. This agreement
may be terminated by either party provided that such termination be given in writing to the other
party at least ninety (90) days prior to the date of termination.

ENCLOSURES:
With the distribution of Resolution 98-1225, the Contract with the State of Florida
for Public Assistance from FEMA for Hurricane Georges was attached. This is an
error. This contract should be attached to the Resolution proffered in CA-22 on
the January 12, 1991165Commisslon Agenda. The contract for Resolution #98-
1225 is a one page document of which a copy is attached at the blue tab. The
original of this agreement is being circulated for Oversight Board and City Manager
approval.
