A RESOLUTION AUTHORIZING THE CITY MANAGER TO
AMEND AN EXISTING AGREEMENT, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH LAW
ENFORCEMENT PSYCHOLOGICAL AND COUNSELING
ASSOCIATES, INC., TO INCREASE COMPENSATION,
IN AN AMOUNT NOT TO EXCEED $45,425.00, PAID
TO SAID FIRM FOR THE PROVISION OF STRESS
TRAINING SERVICES FOR THE DEPARTMENT OF
POLICE; AMENDING RESOLUTION NO. 97-184 TO
REFLECT (1) THE CORRECT TERM OF THE
AGREEMENT, AS EXECUTED, (2) THE CORRECT NAME
OF THE SPECIAL REVENUE FUND FROM WHICH FUNDS
ARE ALLOCATED, AND (3) THE INCREASED
COMPENSATION; FURTHER, ALLOCATING FUNDS
THEREFOR FROM THE SPECIAL REVENUE FUND
ENTITLED "S.T.O.P. PROGRAM" FOR SAID
SERVICES.
WHEREAS, pursuant to Ordinance No. 11478, adopted by the
City Commission on March 7, 1997, a special revenue fund entitled
"S.T.O.P. Program" was established and funds appropriated,
consisting of a grant awarded the City by the U.S. Department of
Justice, in the amount of $45,425.00, to provide counseling and
training for stress symptoms for all officers and their families
during the employees' first year of employment; and
WHEREAS, on March 20, 1998, the City Commission adopted
Resolution 97-184 which authorized the City Manager to execute an
agreement with Law Enforcement Psychological and Counseling
Associates, Inc. for a period of two years, for the provision of
said services, with funds allocated in the amount of $47,250.00

WHEREAS, the U.S. Department of Justice has awarded the City
of Miami a second grant in the amount of $45,425.00 for the
continuation of said services which has been appropriated by
Ordinance to the S.T.O.P. Program Special Revenue Fund; and
WHEREAS, it is necessary to amend the existing agreement,
approved pursuant to Resolution No. 97-184, to reflect the
increase of compensation from $47,250 to $92,675, for the amount
of $45,425, to Law Enforcement Psychological and Counseling
Associates, Inc.; and
WHEREAS, Resolution No. No. 97-184 must be amended to
reflect that the term of the agreement with Law Enforcement
Psychological and Counseling Associates, Inc., as executed, was
for a term of eighteen months, with the City's option to extend
for an additional one year period and that the funding source
from which funds we to be allocated for payment of said
compensation was the special revenue fund entitled "S.T.O.P.
Program";
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized1/ to
amend an existing agreement, in a form acceptable to the City
Attorney, with Law Enforcement Psychological and Counseling
Associates, Inc. to increase compensation, in an amount not to
exceed $45,425.00, paid to said firm for the provision of stress
and training services for the Department of Police, with funds
therefor hereby allocated from the special revenue fund entitled
II"S.T.O.P. Program" for said services.
Section 3. Resolution No. 97-184, adopted March 20,
1997, is hereby amended in the following particulars:/

It is respectfully recommended that the City Commission adopt the attached Resolution amending
Resolution 97-184, to increase the amount from $47,250.00 to $92,675.00 for the provision of
stress training services executed under a Professional Services Agreement.
Funding will be from the Stress Training for Officers and Partners ("STOP") Grant, Account Code
No. 110079.290483.6.270.
BACKGROUND
The Department of Police has been awarded additional grant monies in the amount of $45,425
from the U.S. Department of Justice, to continue its Employee Assistance Program instituted to
provide counseling sessions for all officers during their first year of employment. This
supplemental award will provide training on interpersonal skills building and recognition of stress
symptoms in young officers for eventual referral to the Officers Assistance Program (for officers in
need and their families). Specialized training will also focus on recently promoted sergeants and
field training officers. The training will enable them to participate in a learning environment
designed to promote self-awareness, communication skills, problem solving techniques and
evaluative techniques related to their personality and management style.
The Department of Police requests an increase of the Professional Services Agreement from
$47,250 to $92,675 with Law Enforcement Psychological and Counseling Associates, Inc., to
provide pertinent services, as per the grant award requirements.

WHEREAS, the Department of Police intends to enhance its Employee Assistance

WHEREAS, this program will also be available to the employee's family; and
WHEREAS, the U.S. Department of Justice has approved a Stress Training for Officers
and Partners ("S.T.O.P.") Grant in the amount of $47,250.00, to contract Law Enforcement
Psychological and Counseling Associates, Inc., for the provision of these services; and
WHEREAS, there is no match required of the City of Miami;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF

maintenance of a minimum level of grant cash -on -hand. Should your institution not adhere to these

other administrative action as appropriate.
Two copies of the Grant Award with Special Conditions are enclosed. If you accept this award, sign and
return both the original of the Grant Award and Special conditions to the Control Desk, Office of the
Comptroller. Obligations and expenditures may be incurred on or after the fast day of the official grant
period.
Also included are copies of the required Agency guidelines and reporting forms (both progress and
fmancial) with instructions on preparation of the forms. All copies of progress and financial reports, as

quicker OCR review and approval. The enclosed Seven -Step Guide to the Design and'Development

This award is a continuation of a grant that implemented an innovative counseling program for rookie police
officers. This supplemental will provide training on interpersonal skill building, recognitions of stress symptoms
in young officers and effective techniques for referral to the officer Assistance Program of officers in need.
The specialized training will be focused on recently promoted inexperienced sergeants and field training officers.
The training will enable them to participate in a learning environment designed to promote self-awareness,
communication skills, problem solving techniques and complete a non-threatsning instrument to look at their own
personality and management style.

NOTIFICATIONS AND PRIOR APPROVALS
1. The grantee agrees to obtain grantor agency approval prior to the expenditure of grant
funds for consultants whose salary exceeds $450 per day.
2. It has been determined that the employees whose names appear below, and/or the
positions identified below and yet to be filled, are necessary for the successful
performance of this grant. Therefore, the grantee agrees to assign such employees or
persons to the performance of the work under this grant and shall not reassign, remove, or
appoint persons to the positions identified without written notice to and the written
concurrence of the grantor. Whenever, for any reason, one or more of the employees
listed below or subsequently approved is unavailable for assignment for work under the
grant, the grantee shall, with the approval of the grantor, replace such employee with an
employee of substantially equal abilities and qualifications. These key staff are: Dr.
Mark Axelberd. Principal Investigator, and Major Gerald Darling.
3. To assist in information -sharing, the grantee shall provide the grant manager with a copy
of all interim and final reports and proposed publications (including those prepared for
conferences or other presentations) resulting from this agreement. Submission of such
materials prior to or simultaneous with their public release aids NIJ in responding to any
inquiries that may arise. Any publications (written, visual, or sound) -- excluding press
releases and newsletters--- whether published at the grantee's or government's expense,
shall contain the following statements: " This project was supported by Grant No.
awarded -by the National Institute of Justice, Office of Justice
Programs, U.S. Department of Justice. Points of view in this document are those of the
author and do not necessarily represent the official position or policies of the U.S.
Department of Justice." NIJ defines publications as any planned, written, visual, or sound
material substantively based on the project, formally prepared by the grant recipient for
dissemination to the public.

4. The recipient shall transmit to the grant monitor copies of all official grant -related press
releases at least ten (10) working days prior to public release. Advance notice permits
time for coordination of release of information by NIJ where appropriate and to respond
to press or public inquiries.
OTHER REQUIREMENTS
5. All National Institute of Justice supported research involving human subjects must
comply with the "Model Policy on Human Research Subjects" (45 Code of Federal
Regulations 46). Prior to the initiation of data collection, a written copy of the recipient's
Institutional Review Board approval of this research project, if applicable, must be
submitted to the National Institute of Justice.
6. The recipient shall conform to the privacy requirements of 28 CFR, Part 22.
7. Grantee acknowledges that failure to submit an acceptable Equal Employment
Opportunity Plan (if grantee is required to submit one pursuant to 28 CFR §42.302), that
is approved by the Office of Civil Rights, is a violation of its Certified Assurances and
may result in the suspension of the drawdown of funds.
8. The recipient agrees to complete and keep on file, as appropriate, Immigration and
Naturalization Service Employment Eligibility Verification Form (I-9). This form is to
be used by recipients of federal funds to verify that persons are eligible to work in the
United States.
PERIODIC REPORTS
9. NU Program Managers should be kept informed of research progress, using the format
provided in the grant award documents. Written progress reports are required on a semi-
annual basis and should inform the Program Manager of which tasks have been
completed and whether significant delays or departures from the original workplan are
expected. The reporting periods are January 1 through June 30, and July 1 through
December 31, or portions thereof at the beginning and end of the grant. All progress
reports are due 30 days following the end of the reporting period.
10. Periodic financial reports shall be submitted as specified in the grant award documents
and applicable regulations.

GRANT PRODUCTS
The recipient shall provide all products specified in the proposal. In addition, the recipient will
comply with the following requirements:
11. The recipient shall submit an original and two copies of a draft Final Project Report
before the grant expires which shall describe the project's activities in sufficient detail to
permit a replication of the project's design, including all data collection and data analysis
procedures, findings, and relevant literature. Unusual or interesting implementation or
analytical problems encountered, and the extent to which they were successfully
addressed, should also be included in this report.
12. The recipient shall submit to NIJ an original and two copies of a draft 2,500 to 4,000
word Summary before the grant expires highlighting the project's findings and their
implications for criminal justice operations. The summary should be suitable for
publication and dissemination by NIJ to policymakers, practitioners, and researchers.
13. The draft Final Report and Summary may -- at NIJ's discretion -- be submitted to peer
review. The grantee shall make appropriate revisions to these documents based on the
reviewers' comments.
14. For dissemination purposes, the grantee shall provide an original and two copies of the
revised Final Report and 2,500 to 4,000 word Summary. While final reports are
occasionally reproduced and distributed by NIJ, in general, these reports are made
available to the public through the National Criminal Justice Reference Service. These
reports shall be submitted on 3.5" high density diskettes, with text and graphics in one of
the following formats: WordPerfect, MS Word; postscript, Pagemaker, and Acrobat, and
compatible graphics formats (Adobe Illustrator/Photoshop, Corel Draw, Freehand,
Harvard Graphics, Lotus Freelance, Persuasion, and Powerpoint). Images which adhere
to GIFF, JPEG, PICT, and TIFF standards may also be used, with GIFF and PICT images
preferred.
15. To support NIJ in its mission to make available data and documentation from all NIJ-
funded research, the recipient agrees to deliver to NIJ upon termination of the award
period: 1) the Final Report and Summary, in hard copy and machine -readable -formats, as
described in the preceding paragraph; 2) a machine-readable copy of each data set
generated in conjunction with this project (SPSS portable files preferred; SAS portable,
dBASE, Lotus or ASCII files acceptable with appropriate documentation); 3) a
description of the general technical characteristics of the floppy disk (e.g., file format),

computer tape (e.g., labeled/unlabeled, blocking parameters, file format), or other
medium containing the data; 4) a codebook listing the data variable, their codes, and code
labels (MS Word preferred; WordPerfect, Rich Text Format [RTF], ASCII acceptable; 5)
a machine-readable and hard copy version of each data collection instrument (see above
list for preferred formats); 6) a frequency count or other appropriate description for each
variable; 7) a printed copy of the first five and last five records of each data set; 8) any
specialized programs necessary to replicate the original data analysis. Recipients should
consult the Handbook "Depositing Data with the Data Resources Program of the National
Institute of Justice" for further guidance.
16. The recipient shall make no guarantee, without prior NIJ approval, that the data generated
as part of this project will not be transferred or released. (Such guarantee would preclude
NIJ from archiving and making available all NIJ-funded data.)
17. The recipient agrees to comply with the financial and administrative requirements set
forth in the current edition of the Office of Justice Programs (OJP) Financial Guide.
18. The recipient agrees to comply with the audit requirements of OMB Circular A-133:
The first audit should cover the period 10/01/97 to 09/30/98. Include the audit report and
accompanying management letter in the audit report package.
If the audit disclosed findings or recommendations, the recipient must also include a
corrective action plan in the audit report package, that contains the following:
1) The name and number of the contact person responsible for the corrective action plan.
2) Specific steps taken to comply with the recommendations.
3) Timetable for performance and/or implementation dates for each recommendation.
4) Descriptions of monitoring to be conducted to ensure implementation.
Submit audit report packages and the appropriate number of copies as defined in OMB
Circular A-133 §.320, no later than thirteen (13) months after the close of each fiscal year
during the term of the award -(for fiscal years beginning on/after 1 July 1998 audit
report packages are due nine (9) months after the close of each fiscal year) as
follows:

REFLECT (1) THE CORRECT TERM OF THE
AGREEMENT, AS EXECUTED, (2) THE CORRECT NAME
OF THE SPECIAL REVENUE FUND FROM WHICH FUNDS

WHEREAS, pursuant to Ordinance No. 11478, adopted by the
City Commission on March 7, 1997, a special revenue fund entitled
"S.T.O.P. Program" was established and funds appropriated,
consisting of a grant awarded the City by the U.S. Department of
Justice, in the amount of $45,425.00, to provide counseling and
training for stress symptoms for all officers and their families
during the employees' first year of employment; and
WHEREAS, on March 20, 1998, the City Commission adopted
Resolution 97-184 which authorized the City Manager to execute an
agreement with Law Enforcement Psychological and Counseling
Associates, Inc. for a period of two years, for the provision of
said services, with funds allocated in the amount of $47,250.00
