A RESOLUTION RELATED TO THE 36TH ANNUAL
NATIONSBANK COCONUT GROVE ARTS FESTIVAL,
CONDUCTED BY THE COCONUT GROVE ASSOCIATION,
INC., TO BE HELD ON FEBRUARY 13-15, 1999;
AUTHORIZING THE CITY MANAGER TO ISSUE A
THREE-DAY PERMIT FOR THE SALE OF ALCOHOLIC
BEVERAGES DURING SAID EVENT IN THE AREA OF
MCFARLANE ROAD FROM SOUTH BAYSHORE DRIVE TO
MAIN HIGHWAY AND SOUTH BAYSHORE DRIVE FROM
MCFARLANE ROAD TO MAIN HIGHWAY, INCLUDING ALL
STREETS, AVENUES, ALLEYS, WAYS AND
THOROUGHFARES WHICH INTERSECT SAID AREAS IN
COCONUT GROVE, MIAMI, FLORIDA; SAID
AUTHORIZATION CONDITIONED UPON THE
ORGANIZERS: (1) OBTAINING ALL PERMITS
REQUIRED BY LAW, INCLUDING BUT NOT LIMITED TO
A TEMPORARY PERMIT TO SELL ALCOHOLIC
BEVERAGES BY THE FLORIDA DEPARTMENT OF
BUSINESS REGULATION, DIVISION OF ALCOHOLIC
BEVERAGES AND TOBACCO, PURSUANT TO
SECTION 54-13 OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED; (2) PAYING FOR
ALL NECESSARY COSTS OF CITY SERVICES AND
APPLICABLE FEES ASSOCIATED WITH SAID EVENT;
(3) OBTAINING INSURANCE TO PROTECT THE CITY
IN THE AMOUNT AS PRESCRIBED BY THE CITY
MANAGER OR HIS DESIGNEE; (4) INSTITUTING AN
IDENTIFICATION PROGRAM TO ASSURE THAT ONLY
THOSE INDIVIDUALS OVER THE AGE OF TWENTY-ONE
MAY PURCHASE ALCOHOLIC BEVERAGES; (5)
ADVISING ALL ADJACENT BUSINESSES, PROPERTY
OWNERS, AND RESIDENTS OF STREET CLOSURES
ASSOCIATED WITH SAID EVENT; AND (6) COMPLYING
WITH ALL CONDITIONS AND LIMITATIONS AS MAY BE
PRESCRIBED BY THE CITY MANAGER OR HIS
DESIGNEE.

FLORIDA:
Section 1. The City Manager is hereby authorized to
issue a three-day permit for the sale of alcoholic beverages
during the 36th Annual NationsBank Coconut Grove Arts Festival,
conducted by the Coconut Grove Association, Inc., to be held on
February 13-15, 1999, in the area of McFarlane Road from South
Bayshore Drive to Main Highway and South Bayshore Drive from
McFarlane Road to Main Highway, including all streets, avenues,
alleys, ways and thoroughfares which intersect said areas in
Coconut Grove, Miami, Florida.
Section 2. The herein authorization is hereby
conditioned upon the organizers (1) obtaining all permits
required by law, including but not limited to a temporary permit
to sell alcoholic beverages by the Florida Department of Business
Regulation, Division of Alcoholic Beverages and Tobacco, pursuant
to Section 54-13 of the Code of the City of Miami, Florida, as
amended; (2) paying for all necessary costs of City services and
applicable fees associated with said event; (3) obtaining
insurance to protect the City in the amount as prescribed by the
City Manager or his designee; (4) instituting an identification
program to assure that only those individuals over the age of
twenty-one may purchase alcoholic beverages; (5) advising all
adjacent businesses, property owners, and residents of street
closures associated with said event; and (6) complying with all

conditions and limitations as may be prescribed by the City
Manager or his designee.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.1~

the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

Andrew Korge Festival. Beer and wine sales are handled by local service organizations, who receive a

Association, Inc. be placed on an upcoming City Commission agenda to discuss
street closures and the sale of alcoholic beverages during the 36th Annual
NationsBank Coconut Grove Arts Festival, please be advised that your organization

BACKGROUND:
Ms. Carol Romine, Executive Director of the NationsBank Coconut Grove Arts Festival, is
appearing before the City Commission to request authorization to sell alcoholic beverages
during the 36~' annual NationsBank Coconut Grove Arts Festival to be conducted February 13-
15, 1999.
The organizers of the event have met with City staff, including staff from the Police Department,
to discuss street closures and City services and fees related to the festival. The event will utilize
Peacock Park and will require the closure of McFarlane Road and South Bayshore Drive.
The Coconut Grove Standing Festival Committee met with a representative of The Mutiny and
with the sponsors of the Arts Festival, who have worked out a plan to allow access to the hotel
during the event.
RECOMMENDATION:
The City Commission has traditionally authorized the sale of alcoholic beverages for this event,
as well as for other events held in the Coconut Grove area. The administration recommends
that the NationsBank Coconut Grove Arts Festival's request to sell alcoholic beverages
during the 36"' annual Coconut Grove Arts Festival be approved, subject to the following
conditions:
• Obtaining and paying for the cost of all applicable permits and services prescribed by the
City of Miami.
• Obtaining insurance, including liquor liability, to protect the City of Miami.
• Instituting an identification program to assure that only those over the age of twenty-one will
be served alcoholic drinks.
• Notifying adjacent businesses, property owners and residents of the upcoming road closures.
