HomeMy WebLinkAboutR-98-1182J-98-1199 11/24/98 RESOLUTION NO.y V— 1 1 8 2 A RESOLUTION BY AN AFFIRMATIVE VOTE OF 4/5THS OF THE MEMBERS OF THE CITY COMMISSION, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR FORMAL COMPETITIVE SEALED BIDS AND APPROVING THE EMERGENCY CONSTRUCTION OF A STORMWATER DRAINAGE SYSTEM FOR THE PROJECT ENTITLED "N.W. 25 AVENUE EMERGENCY STORM SEWER, B-5642" BY PNM CORPORATION, IN THE AMOUNT OF $114,190.00; ALLOCATING FUNDS THEREFOR FROM PROJECT No. 352231, AS APPROPRIATED BY THE FISCAL YEAR 1998-99 CAPITAL IMPROVEMENT ORDINANCE NO. 11705, AS AMENDED, IN THE AMOUNT OF $114,190.00, TO COVER THE CONTRACT COST AND $18,341.00, TO COVER THE ESTIMATED EXPENSES, FOR AN ESTIMATED TOTAL COST OF $132,531.00; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PROJECT. WHEREAS, the City Manager has made a finding that severe stormwater flooding on N.W. 25 Avenue at its intersection with N.W. 37 Street prevented access to local businesses and residences, delayed emergency vehicles, and constituted a public emergency; and WHEREAS, the immediate construction of a stormwater drainage system was necessary to improve access for service and emergency vehicles and to protect the safety and welfare of the citizens of the City; and WHEREAS, this emergency necessitated waiving formal bidding CITY CabIIms1o2f MEETING OF DECO 81998 4 QQRerolutkm Na qR - t1 requirements as provided for in Sections 18-83 and 18-84 of the Code of the City of Miami, as amended; and WHEREAS, informal bidding procedures were used and PNM Corporation was the lowest responsible and responsive bidder for the project; and WHEREAS, the City Manager and the Director of the Department of Public Works recommend the award of the emergency contract to PNM Corporation; and WHEREAS, funds are available from the Capital Improvement Program, Project No. 352231, as appropriated by the Fiscal Year 1998-1999 Appropriations/Capital Improvements Ordinance No. 11705, as amended; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a 4/5ths affirmative vote of the members of the City Commission, after a duly advertised public hearing, ratifying, approving and confirming the City Manager's finding of an emergency, waiving the requirements for competitive sealed bids and approving the emergency construction of a stormwater drainage system for the project entitled "N.W. 25 Avenue Emergency Storm Sewer, B-5642" by PNM Corporation, in the amount of $114,190.00, with funds therefor hereby allocated from Project No. 352231, as appropriated by the Fiscal Year 198-99 2 98-1182 Appropriations/Capital Improvements Ordinance No. 11705, as amended, in the amount of $114,190.00, to cover the contract cost and $18,341.00, to cover the estimated expenses, for an estimated total cost of $132,531.00. Section 3. The City Manager is hereby authorizedY to execute a contract, in a form acceptable to the City Attorney, with PNX Corporation for this project. Section 4. BACKGROUND: During the construction of the State of Florida N.W. 36 Street project by the Florida Department of Transportation (FDOT), severe street flooding occurred on N.W. 25 Avenue during rainstorms on September 16, 17, and 18 and again on October 12 and 13, 1998. An investigation by the City of Miami Public Works Department reveals that the drainage system on N.W. 25 Avenue was disconnected from the existing drainage system on N.W. 36 Street prior to the construction and reconnection of a replacement drainage system. This disconnection was done by the FDOT Contractor. Due to the State's revised construction schedule, the potential for flooding on N.W. 25 Avenue will remain and businesses could be inaccessible for several months if the original schedule for the completion of the replacement drainage system is maintained. This situation is unacceptable to the City of Miami and its citizens and requires that a replacement drainage system be immediately constructed. Funds for the execution of this project are available from monies already appropriated in the City's Capital Improvement Appropriations Ordinance 11705, Project No. 352231. DHW?.rLJ . c: James J.
