HomeMy WebLinkAboutR-98-1074J-98-1129 10/27/98 RESOLUTION NO. — 10 7 4 A RESOLUTION RELATED TO THE SUPER SPORTS SPECTACULAR TO BE CONDUCTED ON JANUARY 30, 1999, BY THE COCONUT GROVE CHAMBER OF COMMERCE AT PEACOCK PARK; AUTHORIZING A ONE - DAY PERMIT FOR THE SALE OF BEER, WINE, AND ALCOHOLIC BEVERAGES IN THE AREA DURING SAID EVENT, SUBJECT TO THE ISSUANCE OF ALL PERMITS REQUIRED BY LAW; WAIVING THE RESTRICTIONS THAT TWO EVENTS SHALL NOT TAKE PLACE ON SUCCESSIVE WEEKENDS; AUTHORIZING AN EXEMPTION FROM THE PROHIBITIONS OF SECTION 36-4 AND RELAXATION OF TIME RESTRICTIONS OF SECTION 36-5 OF THE CITY CODE, AS AMENDED, FOR THE OPERATION OF SOUND MAKING DEVICES IN CONNECTION WITH SAID EVENT; CONDITIONING ALL APPROVALS AND AUTHORIZATIONS GRANTED HEREIN UPON THE ORGANIZERS: (1) PAYING FOR ALL OTHER NECESSARY COSTS OF CITY SERVICES AND APPLICABLE FEES ASSOCIATED WITH SAID EVENT; (2) OBTAINING INSURANCE TO PROTECT THE CITY IN THE AMOUNT AS PRESCRIBED BY THE CITY MANAGER OR HIS DESIGNEE; AND (3) INSTITUTING AN IDENTIFICATION PROGRAM TO ASSURE THAT ONLY THOSE INDIVIDUALS OVER THE AGE OF TWENTY-ONE MAY PURCHASE ALCOHOLIC BEVERAGES. WHEREAS, the Coconut Grove Chamber of Commerce (the "Chamber") will conduct a Super Sports Spectacular (the "Spectacular") on January 30-31, 1999 at Peacock Park, Coconut Grove, Miami, Florida; and WHEREAS, said event takes place the same weekend as the Super Bowl which is being held in the South Florida area; and WHEREAS, the Spectacular will include interactive sports for CITY C�QLf NZE-1 G OF OCT 2 7 IM R*Wiutian 140. 98-1074 the youth of the community and a musical concert; and WHEREAS, the Chamber has requested permission during said event to: (1) sell alcoholic beverages, beer, and wine; (2) extend the park hours of operation from to 10:00 P.M. to 1:00 A.M.; (3) be exempted from City Code prohibitions as it relates to the operation of sound -making devices; and (4) relax the time restrictions from 11:00 P.M. to 1:00 A.M. as it relates to the operation of sound -making devices; and WHEREAS, another event, the 16th Annual Taste of the Grove, will be held the immediate weekend preceding the Spectacular on January 23-24, 1999, and, pursuant to Section 54-341 of the Code, the City Commission must waive the restriction that two events shall not take place on successive weekends in the Coconut Grove Special Events District; and WHEREAS, the City Commission is desirous of granting the requests of the Chamber as the Spectacular will benefit the community by bringing a positive image to the area and local merchants will realize increased income from the tourists that are in town for the Super Bowl; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this - 2 - 95-1074 Section. Section 2. The request of the Coconut Grove Chamber of Commerce, to sell beer, wine, and alcoholic beverages for a one - day period in connection with the Super Sports Spectacular to be conducted on Saturday, January 30, 1999 from 10:00 A.M. to 1:00 A.M., in Peacock Park in Coconut Grove, Miami, Florida, is hereby granted subject to the issuance of a temporary permit to sell alcoholic beverages by the Florida Department of Business Regulation, Division of Alcohol Beverages and Tobacco, pursuant to City Code Section 54-13 of the Code of the City of Miami, Florida, as amended (the "Code"). Section 3. The restriction contained in Section 54-341 of the Code which requires that two events shall not take place on successive weekends in the Coconut Grove Special Events District is hereby waived. Section 4. (a) An exemption from the prohibitions contained in Section 36-4(a) of the Code, as it relates to the operation of sound -making devices, is hereby declared. (b) The relaxation of the time restrictions from 11:00 P.M. to 1:00 A.M., as it relates to the operation of sound -making devices, contained in Section 36-5(a) of the Code, is hereby declared. Section 5. The herein approvals and authorizations are hereby conditioned upon the organizers: (1) paying for all other necessary costs of City services and applicable fees associated with said event; (2) obtaining insurance to protect the City in the amount as prescribed by the City Manager or his designee; and - 3 - 98-1074 (3) instituting an identification program to assure that only those individuals over the age of twenty-one may purchase alcoholic beverages. In an effort to facilitate your needs and continue our relationship as a good neighbor, please be notified that the Chamber is withdrawing its request for the street closure of McFarlane Road on Saturday, January 30, 1999. While it was never our intention to disrupt the Sailing Club from hosting its event, we will work with you more closely in the future to coordinate access for your members and guests whenever we have activities in surrounding parks. I have marked the pertinent text on page two for your perusal. As you may note, no objections were raised by members of the committee or guests in attendance at the meeting, and the event received a satisfactory recommendation from the committee. All Coconut Grove Standing Festival Committee meetings are advertised and the public is encouraged to participate. • The other item that I marked for you on the agenda, relates to issues raised by Ms. Annette Martens regarding the Muscular Dystrophy Bed Race. As you may note, actions were taken to prevent future problems which were satisfactory to Ms. Martens. • As of today, this office has received no input from area residents in reference to the proposed event. Given the information provided, we have no objections to this proposed event as presented. We still need to request that the park hours be extended to midnight so that there is sufficient time to end the concert and tear down the stage. In addition, we are requesting the right to sell alcoholic drinks to accommodate the needs of Bacardi Imports as one of our main sponsors. The request for alcohol sales comes with the understanding that: • All applicable State and City rules related to beverage sales be followed. • ID stations will be set up for wrist -banding patrons. • Insurance needs set forth by the City of Miami will be met. While it was never our intention to disrupt the Sailing Club from hosting their events, we will work with them in the future to coordinate access for their members and guests. ZThe minutes of the June 17, 1998 meeting were approved, subject to a correction by Committee member w Sky Smith to the effect that some of the comments made by the Coconut Grove Arts Festival representatives during the June meeting were abusive and offensive. O U The committee re -addressed the issue of a letter from Ms. Annette Mertens regarding noise and offensive language at a concert in Peacock Park during the Muscular Dystrophy Bed Race. Ms. Mertens said she had received a letter from the Muscular Dystrophy Association apologizing for the incident. Ted Stahl advised Ms. Mertens that at the June 17`h meeting the Committee recommended via a Motion that d the stage be placed facing the bay to cut down the noise to residents of the area. Ms. Mertens expressed that she was satisfied with the steps taken to resolve her complaint. Sid Sussman and Barry Kates discussed the proposed event "Super Sports Spectacular", explaining that they were requesting the Committee's endorsement of the event to be held January 1999 in Peacock Park. w 98-10'74 C.G.S.F.C.. Minutes July 23, 1998 Page 2 Sid stated that -there will be no McFarlane closure, only the cul-de-sac between Myers and Peacock Park on Saturday. Sid stated that they will be making an appearance before the City Commission to request certain authorizations related to the Sports Spectacular event, such as the extension of the noise ordinance, permission to sell alcoholic beverages and a waiver of the following two requirements imposed by the Coconut Grove Special Events District Ordinance: a) that only one event during a month involve street closures and b) that the special events do not occur on successive weekends. f- 7 Robert Masrieh asked about the length and hours of the event. Sid answered that the event will be held A for four days, using only the Park for three days as a display area from 10:00 AM to 7:00 PM and a full W day of activities, including closure of the cul-de-sac, on Saturday, January 30, until 1:00 AM. Sky Smith stated that the City Commission approved the previous Super Bowl event, and that he is sure the Commission will approve this event. The Committee passed a Motion "TO APPROVE THE EVENT SUBJECT TO COMPLIANCE WITH ALL RULES AND REGULATIONS GOVERNING EVENTS". (Silvia Cejas abstained from voting stating that Mayfair is a sponsor of the event). The Peacock Park terrace project and the Bayshore median project were discussed briefly. Ted touched on the subject of the use of McFarlane, and suggested, as a try -out, moving festivals out of that area before the opening of the Mutiny. Silvia Cejas discussed the idea of getting community input for future projects, and Sky Smith stated that people who are not on the Committee do not know of the roadblocks which prevent or slow the accomplishment of projects. Ted noted that the Committee does not have a final say, explaining that they make recommendations to the City Commissioners, who have the final say. Espe Avalos distributed Commissioner Regalado's memo to the City Manager, as well as the City Manager's response, related to the delayed Solid Waste cleanup of the Bed Race and Goombay Festivals. The Committee resumed the discussion on the revisions of the Festival Ordinance, touching on the issue of the special event surcharge fee. Sky Smith said that he would abstain from voting on the issue since he had been advised by the Coconut Grove Arts Festival that they would reduce the amount of membership in the Chamber in accordance to how he voted on the issue of the fee. He added that he would not vote so that it does not look like his vote was sold. James Cunningham stated comments like this could result in liability for defamation. Clara Aranda explained that if Sky is put in a position that he feels he should abstain, he can do so, and that she believes his reason is sufficient to abstain. She added that she will research this further and that this situation raises a lot of concerns related to compromising Committee members because of their membership in the Chamber. "red Stahl stated that his vote had never been influenced by politics, and that it bothers him that Committee members have to abstain because of their position. 98-1074 C.G.S.F.C. Minutes July 23,1998 Page 3 John Kiskinis said that he had a conversation with Sky Smith to discuss their membership in the Chamber. He said that membership discussions come up on a yearly basis. He added that the Festival lost a significant .amount of money and that, depending on the budget, they could only commit to a general membership. He stated that in no way has his organization extorted a vote on the basis of what would happen tonight. Cunningham added that the Arts Festival is evaluating its membership in the Chamber. Sky Smith said that he understood that the message given to him had been authorized by the board, and that he was told that the category would be reviewed after he voted on the fee issue, specifically that the category would be reduced according to what happened in this meeting. He also said that showing up with a court reporter is threatening, adding that all this led him to believe that this was an effort to control his vote. He wanted to know if he misinterpreted the message that the "membership would be reviewed after our vote here." Mr. Cunningham replied that the court reporter was there making a verbatim report, since minutes do not always reflect all that is said at a meeting. He added that he has the right to say that the Committee is exceeding its authority, that he has a right to challenge, and that it is his democratic duty to do so. Sky Smith said that his conversation with John was a good thing in that he learned that the Arts Festival is loosing money. He stated that he is not looking to heap more responsibility on the Festival, adding that he is prepared to retreat from the fee raises. Silvia Cejas moved to leave the Surcharge Fee Cap as it is; Sky Smith seconded the MOTION, which was unanimously approved by the Committee "TO KEEP THE COCONUT GROVE SUPPLEMENTARY USER FEE CAP AT $ l O,000." Sid Sussman stated that this whole commentary is related to the raising of the fees, and discussed his idea of a separate festival account managed by a trust, suggesting each festival contribute $250 per day. He said a letter could be sent to all festivals to promulgate the idea, suggesting that Olga Fraga, Executive Director of the Chamber of Commerce, be the one to send the letter to all Grove event organizers. Ted said that he feels uncomfortable with the tension generated at the meetings. Clara Aranda replied that the public has a right to speak, adding that sometimes it can get heated. There was further discussion on the revision of the Festival Ordinance. Clara Aranda stated that she feels that there is no consensus on the revisions to the Ordinance, and suggested that Committee members once again go over the Ordinance. On the issue of the Coconut Grove District boundaries, Sky Smith moved to finalize this issue, and Ronnie Arango seconded the Motion, which was approved unanimously "TO EXTEND THE COCONUT GROVE SPECIAL EVENTS DISTRICT BOUNDARIES TO INCLUDE SOUTH 13AVSHORE DRIVE FROM MARV STREET TO AVIATION AVENUE AND MAIN HIGHWAY TO FRANKLIN AVENUE." The organizers of the event met with City staff and the Coconut Grove Standing Festival Committee on July 23, 1998, to discuss the planned festival. The Coconut Grove Standing Festival Committee approved the event subject to compliance with all rules and regulations prescribed by the City of Miami. The event will include sport activities and a musical concert in Peacock Park. RECOMMENDATION: The Coconut Grove Chamber of Commerce is requesting the following authorizations and waivers: • Use of Peacock Park until 12: 00 midnight on January 30, 1999. • Relaxation of the noise ordinance until 12:00 midnight on January 30, 1999. • Authorization to sell alcoholic beverages during the event. • Waiver of the requirement that two events shall not take place on successive weekends, as stipulated by City Code Section 54-341 related to the Coconut Grove Special Events District. The last authorization is necessary because the Taste of the Grove, a grandfathered event, will be held on January 23-24, 1999. 98-10'74 The administration recommends that the Coconut Grove Chamber of Commerce's request be approved, subject to the following conditions: • Paying.for the cost of all City services and applicable permit fees required by law. • Obtaining insurance, including liquor liability, to protect the City of Miami in the amount stipulated by City requirements. • Instituting an identification program to assure that only those over the age of twenty- one will buy alcoholic drinks.
