A RESOLUTION DIRECTING THE CITY ATTORNEY TO
DRAFT AN ORDINANCE, COORDINATED WITH THE CITY
MANAGER AND COUNSEL FOR THE COMMUNITY
REDEVELOPMENT AGENCY, TO PROVIDE FOR FULL
FUNDING OF THE COMMUNITY REDEVELOPMENT AGENCY
FOR FIVE YEARS AND TO PROVIDE FOR A
COMPREHENSIVE SUNSET EVALUATION AND REVIEW OF
THE COMMUNITY REDEVELOPMENT AGENCY BY THE
POLICY AND PROGRAM COMMITTEE, AND TO PRESENT
SAID ORDINANCE TO THE CITY COMMISSION FOR ITS
REVIEW AND CONSIDERATION FOR FIRST READING AT
THE SPECIAL CITY COMMISSION MEETING TO BE
HELD ON NOVEMBER 16, 1998, AND FOR SECOND
READING AT THE FIRST CITY COMMISSION MEETING
IN DECEMBER, 1998.
WHEREAS pursuant to applicable law, the Community
Redevelopment Agency ("CRA'I) is an independent agency established
for the purpose of affording maximum opportunity, consistent with
the sound needs of the City of Miami, to rehabilitate and
redevelop community redevelopment areas; and
WHEREAS, the City of Miami provides funds for the support of
the activities of the CRA; and
WHEREAS the City Commission of the City of Miami desires to
provide enhanced funding for the activities of the CRA for five
years based upon the availability of funds; and
WHEREAS, said enhanced funding shall be contributed on an
annual basis with each annual appropriation to the CRA, taking

into consideration and setting forth the following year funding
and target programs of the CRA; and
WHEREAS, said Ordinance, providing for the funding of the
CRA and providing for a sunset review at the conclusion of five
years is in the best interests of the citizens of the City of
Miami;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Attorney is hereby directed to draft
an ordinance, coordinated with the City Manager and Counsel for
the Community Redevelopment Agency, providing for full funding
for five years of the Community Redevelopment Agency, and
providing for a comprehensive sunset evaluation and review of the
Community Redevelopment Agency by the Policy and Program
Committee, and present said ordinance to the City Commission for
its review and consideration for first reading at the Special
City Commission Meeting to be held on November 16, 1998, and for
second reading at the first City Commission Meeting in December,
1998. The drafting of said Ordinance shall provide for, but not
be limited to, the following:
(a) Commencing in Fiscal Year 2000, the City shall fund the
CRA at a level based on availability of funds and shall
continue to appropriate funds to the CRA on an annual

basis up to and including Fiscal Year 2004 consistent
with applicable state and federal provisions; and
(b) At the end of the fourth fiscal year, the funding,
policies, and procedures of the CRA shall be evaluated
by the Policy and Program Committee.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayors/
PASSED AND ADOPTED this 27th day of October 1998.

1/ If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted. If
the Mayor vetoes this Resolution, it shall become effective immediately
upon override of the veto by the City Commission.
