A RESOLUTION BY A FOUR FIFTHS (4/5THS) AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, WAIVING THE REQUIREMENTS FOR COMPETITIVE BIDDING PROCEDURES FOR THE ACQUISITION OF PAINT AND PAINT SUPPLIES FROM REX TONE, INC., IN AN AMOUNT NOT TO EXCEED $7,993.30, IN ORDER TO COMPLY WITH THE CITYWIDE BEAUTIFICATION PROJECT AND COMPLETE THE CITY OF MIAMI'S CITYWIDE RESIDENTIAL PAINT PROGRAM, ADMINISTERED BY THE NEIGHBORHOOD ENHANCEMENT TEAMS; ALLOCATING FUNDS THEREFOR FROM ACCOUNT CODE NO. 452249.670799.209; AUTHORIZING THE CITY MANAGER TO INSTRUCT THE CHIEF PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER FOR SAID ACQUISITION. WHEREAS, pursuant to Resolution No. 94-726, adopted October 27, 1994, the City Commission accepted the bid of Rex Tone, Inc., on a contract basis, at a annual cost not to exceed $45,000.00, for the furnishing of paint and paint supplies for the Department of Community Development's Citywide Residential Paint Program, administered by the Neighborhood Enhancement Teams (NET), as part of the Citywide Beautification Project; and WHEREAS, said contract, including its renewal options, expired in November, 1997; and WHEREAS, in order to complete the Citywide Beautification Project, Residential Paint Program, the NET Service Centers continued to provide vouchers without knowledge of the CITY COQKIS301� NM=ING OF 0 0 T 2 7 1998 Resolution No. 98-1063 expiration, and thus, no valid purchase order, resolution or contract authorized payment for the acquisition of paint and paint supplies required from Rex Tone, Inc., in the amount of $7,993.30; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this section. Section 2. By a four -fifths (4/5ths) affirmative vote of the members of the City Commission, competitive niaaing procedures for the acquisition of paint and paint supplies to comply with the Citywide Beautification Project and complete the City of Miami's Citywide Residential Paint Program, administered by the Neighborhood Enhancement Teams (NET), from Rex Tone, Inc., in an amount not to exceed $7,993.30, are hereby waived, with funds therefor hereby allocated from Account Code No. 452249.670799.209. Section 3. The City Manager is hereby authorized to direct the Chief Procurement Officer to issue a purchase order for said increase. Section 4. Warshaw City Manager RECOMMENDATION DATE: OCT I 9 ;9�J,98, FILE : tJ SUBJECT: REFERENCES: ENCLOSURES: Outstanding Invoices - Rex -tone Paint & Chemical It is respectfully recommended that the City Commission approved the attached resolution to authorize the City Manager to resolve outstanding invoices for Rex - Tone Paint and Chemical in the amount of $7,993.30 from account code number 452249670799-209. BACKGROUND NET Service Centers administer a Residential Paint Program that utilizes community development block grant funds to provide paint and paint supplies to single family homeowners in community development targeted areas. For the period between November 9, 1994, and November 9, 1997, Rex -tone Paint and Chemical held a contract to provide the necessary materials for the Residential Paint Program. Presumably the administrative upheaval that occurred in the City during that period created a communication gap such that NET Service Centers continued to provide vouchers for the Residential Paint Program although the contract had expired. The error was realized in February 1998 and voucher issuance was halted. On May 12, 1998, the City Commission allocated $50,000 from the community development block grant to continue the Residential Paint Program. Upon receiving the specifications from the appropriate department, Purchasing will issue a new solicitation to institute a new contract. DHW �WW s-1063
