" " — 0 " 1 A RESOLUTION DECLARING THAT JOE SANCHEZ SHALL SERVE AS COMMISSIONER OF DISTRICT 3 OF THE CITY OF MIAMI, FLORIDA, DUE TO THE ABSENCE OF ANY OPPOSITION, TO FILL THE REMAINDER OF AN UNEXPIRED TERM, SUBJECT TO POSSIBLE DISPLACEMENT, OR UNTIL SUCH TIME AS THE RESULTS HAVE BEEN DECLARED AND CERTIFIED FOR THE NONPARTISAN PRIMARY ELECTION ON NOVEMBER 6, 2001, AND THE NONPARTISAN GENERAL ELECTION, IF NECESSARY, ON NOVEMBER 13, 2001, WHICH ELECTION(S) SHALL ELECT A COMMISSIONER TO SERVE A TERM PURSUANT TO SECTION 4 OF THE CHARTER OF THE CITY OF MIAMI, FLORIDA, AS AMENDED. WHEREAS, pursuant to §112.51, Florida Statutes (1997), the Governor of the State of Florida removed Humberto Hernandez from office in the District 3 Seat of the City of Miami; and WHEREAS, Joe Sanchez was appointed, pursuant to City Charter provisions relative to same, to fill the temporary vacancy in the District 3 Seat of the City of Miami, Florida; and WHEREAS, the resulting vacancy necessitated holding an extraordinary election to fill the concomitant unexpired District 3 City Commission term which ends at such time as the results of the election have been declared; and WHEREAS, Joe Sanchez was the only individual to qualify for the election to have been held for the office of District 3 CITY COKKUSMR �ETIl�C OAF OCT 2 7 IM 1%olUU00 info. 98-10, 51 Commissioner; and WHEREAS, due to the absence of any opposition for the District 3 Commission Seat, it is now appropriate to declare Joe Sanchez as District 3 Commissioner of the City of Miami, Florida, to fill the remainder of an unexpired term, subject to possible displacement, or until such time as the results have been declared and certified for the Nonpartisan Primary Election on November 6, 2001, and the Nonpartisan General Election, if necessary, on November 13, 2001, which election(s) shall elect a commissioner to serve a term pursuant to Section 4 of the Charter of the City of Miami, Florida, as amended. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. JOE SANCHEZ is hereby declared to serve as Commissioner Of District 3 of the City of Miami, Florida, due to the absence of any opposition, to fill the remainder of an unexpired term, subject to possible displacement, or until such time as the results have been declared and certified for the Nonpartisan Primary Election on November 6, 2001, and the Nonpartisan General Election, if necessary, on November 13, 2001, which election(s) shall elect a commissioner to serve a term - 2 - 98-io5i pursuant to Section 4 of the Charter of the City of Miami, Florida, as amended.
