RESOLUTION NO. 9 8— 1 v 3 2
A RESOLUTION RELATED TO THE TEMPORARY SPECIAL
EVENT, WITH MECHANICAL RIDES, SPONSORED BY THE
CENTRAL SHOPPING PLAZA MERCHANTS ASSOCIATION,
TO BE HELD OCTOBER 29TH THROUGH NOVEMBER 8TH,
1998, AT 700 NORTHWEST 37TH AVENUE, MIAMI,
FLORIDA; GRANTING APPROVAL PURSUANT TO
SECTION 906.9 OF THE ZONING ORDINANCE, AS
AMENDED, FOR SAID EVENT TO TAKE PLACE ON
MONDAY, TUESDAY AND WEDNESDAY, NOVEMBER 2N -
4TH, 1998, SUBJECT TO THE FOLLOWING CONDITIONS:
(1) EVENT SPONSOR MUST APPLY FOR A CLASS I
SPECIAL PERMIT; (2) GENERATORS AND TRUCKS SHALL
NOT BE PARKED IN AREAS ADJACENT TO RESIDENTIAL
AREAS; AND (3) SECURITY GUARDS ARE REQUIRED
DURING THE ENTIRE EVENT; (4) GAMBLING IS
PROHIBITED; (5) NO PERSON SHALL DWELL ON SITE;
AND (6) NO KNIVES OR ANY OTHER OBJECTS
RESEMBLING WEAPONS SHALL BE SOLD OR USED IN
CONNECTION WITH GAMES OF CHANCE; AND FURTHER,
AUTHORIZING AN EXEMPTION FROM THE PROHIBITIONS
OF SECTION 36-4 AND RELAXATION OF TIME
RESTRICTIONS OF SECTION 36-5 OF THE CITY CODE,
AS AMENDED, FOR THE OPERATION OF SOUND MAKING
DEVICES FOR DATES AND TIMES DESIGNATED HEREIN
IN CONNECTION WITH SAID EVENT.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The requests of the Central Shopping Plaza
Merchants Association, sponsors of a temporary special event,
with mechanical rides, located at 700 Northwest 37th Avenue,
Miami, Florida, from October 29th through November 8th, 1998, are

hereby granted as follows:
(a) Approval for said event to take place on Monday,
Tuesday and Wednesday, November 2nd through November
4th, 1998, pursuant to Article 9, Section 906.9, of the
Zoning Ordinance of the City of Miami, Florida, as
amended, General and Supplementary Regulations,
accessory uses and structures, temporary special
events, special permits, is hereby granted.
(b) An exemption from the prohibitions contained in
Section 36-4(a) of the Code of the City of Miami,
Florida, as amended (the "Code"), as it relates to the
operation of sound -making devices, isg hereby declared
from October 29th through November 8t 1998, for said
temporary special event.
(c) The relaxation of the time restrictions from 11:00 P.M.
to 12: 00 A.M. , as contained in 36-5 (a) of the Code, as
it relates to the operation of sound -making devices is
hereby declared for the following dates in connection
with said temporary special event:
Friday, October 30, 1998
Saturday, October 31, 1998
Friday, November 6, 1998
Saturday, November 7, 1998
Section 2. The herein approvals and declarations are
hereby conditioned upon: (1) event sponsor applying for a
Class I Special Permit, (2) generators and trucks shall not be
parked in areas adjacent to residential areas; (3) security
guards provided during the entire event; (4) gambling is
prohibited; (5) no person shall dwell on site; and (6) no knives
or any other objects resembling weapons shall be sold or used in
connection with games of chance.
Section 3. This Resolution shall become effective

immediately upon its adoption and signature of the Mayor.1/

1� If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

Central Shopping Plaza Merchants Association would like to
request that they be placed on the agenda for the Commission
meeting of October 13, 1998. We are planning to host amusement
rides as a promotional event from October 29 thru November 8,
1998. These rides will start setting up on October 26, 1998.
However since this includes Monday, tuesday and Wednesday, we
have been advised that this has to be approved by the City
Commission.
We would appreciate anything you can do to help us host this
traffic building promotion.

Ms. Gladys Gomez, President of the Central Shopping Plaza Merchants Association, is appearing
before the City Commission to request authorization for a temporary event to be held at the
Central Shopping Plaza from Thursday, October 29 through Sunday, November 8, 1998.
This yearly event includes mechanical rides, which are only permissible Thursdays through
Sundays. The sponsors of the event are requesting the relaxation of Article 9, Section 906.9 of
the City's Zoning Ordinance, to allow the operation of mechanical rides on Monday, Tuesday
and Wednesday (November 2 through 4, 1998).
The City Commission has the authority to grant said authorization, and has in previous years
granted the required approval for prior events.
RECOMMENDATION:
The administration recommends that the request of the Central Shopping Plaza Merchants
Association be granted subject to their obtaining any applicable permits required by law.
The Flagami NET Service Center Administrator and Police Lieutenant concur with this
recommendation.
