HomeMy WebLinkAboutR-98-1005J-98-1088 10/13/98 RESOLUTION NO. 9 " _ 10 0 5 A RESOLUTION DIRECTING THE CITY MANAGER TO MODIFY THE PROGRAM GUIDELINES FOR THE CITY OF MIAMI'S HOME FUNDED HOMEBUYERS FINANCING PROGRAM TO ALLOW FOR PARTICIPATION OF THE PRIVATE SECTOR HOUSING INDUSTRY AND TO AMEND THE CITY OF MIAMI'S U.S. HUD APPROVED CONSOLIDATED PLAN AND/OR ANNUAL ACTION PLAN TO REFLECT SAID MODIFICATION. WHEREAS, since 1993, the City of Miami has been responsible for the implementation and administration of the Home Investment Partnership Program (HOME Program) which is funded by the U.S. Department of Housing and Urban Development; and WHEREAS, one of the four (4) housing programs which is being administered by the City under the Home Program is the Homebuyers Financing Program; and WHEREAS, currently the Homebuyers Financing Program provides funding in the form of second mortgage financing to qualified very low, low and moderate income homebuyers purchasing a new single family home constructed by a City of Miami certified Community Housing Development Organization (CHDO); and WHEREAS, at the October 13, 1998 City Commission meeting, Mr. Jerry Flick, President of Affordable Homes by Flick Investments, Inc., appeared before the City Commission to CITY comussION ML7MG or 0 C T 13 1993 Resolution No. 98-1005" discuss the participation of his company and the private sector housing industry in the City's Homebuyer Financing Program; and WHEREAS, in an effort to afford Mr. Flick and/or other private sector developers the opportunity to participate and receive Home Program funding through the Homebuyers Financing Program for their prospective homebuyers, it is recommended that the City Commission direct the City Manager to modify the program's guidelines to allow the participation of the private sector housing industry and to amend the City's U.S. HUD approved Consolidated Plan and/or Annual Action Plan; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby directed to modify the program guidelines for the City of Miami's Home funded Homebuyers Financing Program to allow for the participation of the private sector housing industry and to amend the City if Miami's U.S. HUD approved Consolidated Plan 98-10 :a and/or Annual Action Plan to reflect said modification. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.1/ PASSED AND ADOPTED this 13th day of October . 1998. ENCLOSURES: City Commission Meeting of October 13', 1998 Mr. Jerry Flick, President of Affordable Homes by Flick Investments, Inc., has requested a personal appearance before the City Commission to discuss the participation of his company and the private sector housing industry in the City's Home Investment Partnership Program (Home Program). BACKGROUND: Since 1993, the City of Miami has been responsible for the implementation and administration of the Home Investment Partnership Program which is funded by the U.S. Department of Housing and Urban Development. One of the four housing programs which is being administered by the City under the Home Program is the Homebuyers Financing Program. The Homebuyers Financing Program provides funding in the form of second mortgage financing to qualified very low, low and moderate income homebuyers purchasing a new single family home constructed by a City of Miami certified Community Housing Development Organization (CHDO). Currently, only City of Miami certified Community Housing Development Organizations (CHDO's) are eligible to receive Home Program funds through the Homebuyers Financing Program. Presently, the program guidelines preclude the participation of private sector developers in the Homebuyers Financing Program. In order to afford Mr. Flick and/or other private sector developers to participate and receive Home Program funding through the Homebuyers Financing Program for their prospective homebuyers, the City would essentially have to modify the program's guidelines to allow the participation of the private sector housing industry. This would require the City to also amend the City's U.S. HUD approved Consolidated Plan. RECOMMENDATION: It is recommended that the City Commission authorize and direct the City Manager to amend the City's U.S. HUD approved Consolidated Plan and the Home funded Homebuyers Financing Program guidelines in order to afford the private sector housing industry to participate in the aforementione , �aousing program.
