MIAMI COURT AT ITS INTERSECTION WITH N.W. 14 STREET AND N.W. 15 STREET IN THE CITY OF MIAMI, FLORIDA, SUBJECT TO THE PROVISIONS CONTAINED HEREIN. WHEREAS, N.W. Miami Court between N.W. 14 Street and N.W. 15 Street is a poorly developed public right-of-way; and WHEREAS, the owner of the property abutting N.W. Miami Court has expressed concern about unsafe conditions within this right-of-way and has petitioned the City to restrict vehicular access to N.W. Miami Court at its intersection with N.W. 14 Street and N.W. 15 Street; and WHEREAS, the Police Department, Fire -Rescue Department and General Services Administration/Solid Waste Department have been notified of said proposed vehicular access restriction and have expressed no substantial objection to this action; and WHEREAS, the proposed vehicular access restriction shall be accomplished by the placement of a fence across N.W. Miami Court at its intersection with N.W. 14 Street and CITY COM USSIOdf MEETUIC OF SEP2?,19% Resotudon If& 98- 912 at N.W. 15 Street; and WHEREAS, Section 54-16 of the Code of the City of Miami, Florida, as amended, gives the City Commission the power, after a properly advertised public hearing, to recommend that vehicular access to a particular street be prohibited at an intersection where such prohibition is found to be in the best interest of the public; and WHEREAS, pursuant to due public notice, a public hearing was held before the City Commission on this date to hear objections to the implementation of prohibition of vehicular access to N.W. Miami Court at its intersection with N.W. 14 Street and N.W. 15 Street on a temporary basis and no substantive objections were voiced; and WHEREAS, the City Commission finds that the herein prohibition should be instituted until such time as N.W. Miami Court is closed and vacated in accordance with the subdivision regulations contained in Chapter 55 of the Code of the City of Miami, Florida, as amended, or until such time as the Director of the Department of Public Works makes a finding that N.W. Miami Court should be reopened to vehicular access; and WHEREAS, the City Commission finds that the herein 2 98- 912 prohibition is in the best interest of the public; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in The Preamble to this Resolution are hereby adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The temporary restriction of vehicular access to N.W. Miami Court at its intersection with N.W. 14 Street and N.W. 15 Street in the City of Miami, Florida, is hereby authorized on a temporary basis, subject to the following conditions: (a) The Department of Public Works and the Department of Fire -Rescue shall approve the design of the temporary fence to prohibit vehicular access; (b) The herein prohibition shall be instituted until such time as N.W. Miami Court is closed and vacated in accordance with the subdivision regulations contained in Chapter 55 of the Code of the City of Miami, Florida, as amended, or until such time as the Director of the Department of Public Works makes a finding that N.W. Miami Court should be re -opened to vehicular access. Section 3. This Resolution shall become effective 3 9$- 912 immediately upon its adoption and signature of the Mayorll. Miami Court at N.W.14 Street and N.W. 15 Street REFERENCES: ENCLOSURES: The purpose of the September 28, 1998 public hearing is to hear comments and consider a Resolution authorizing the restriction of vehicular access to N.W. Miami Court at its intersection with N.W. 14 Street and N.W. 15 Street. BACKGROUND N.W. Miami Court between N.W. 14 Street and N.W. 15 Street is a poorly developed public right of way with a substandard pavement width in poor condition. very little vehicular and pedestrian traffic utilizes this roadway where the- adjacent properties are either undeveloped or consist of closed warehouses. A movie production studio by Big Time Productions is currently under design for the entire block of land on both sides of N.W. Miami Court between N.W. 14 Street and N.W. 15 Street. in order to construct the new studio, the owners have tentative approval to replat and close N.W. Miami Court. Since the replatting process will take several months to complete, these property owners are very concerned about security, public safety and illegal dumping on N.W. Miami Court and the vacant land adjacent to the roadway, and have requested that access to N. W. Miami Court be temporarily restricted until completion of the platting process. It is respectfully recommended that the restriction to vehicular access be implemented on a temporary basis until such time that the right of way is closed and vacated in accordance with the City Code or until such time that the Director of the Public Works Department makes a finding that N.W.
