HomeMy WebLinkAboutR-98-0898J-98-978 9/16/98 RESOLUTION NO. v 898 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE LITTLE HAVANA DEVELOPMENT AUTHORITY, INC., A FLORIDA NOT -FOR -PROFIT CORPORATION, FOR THE MANAGEMENT AND OPERATION OF "MAXIMO GOMEZ PARK", ALSO KNOWN AS "DOMINO PARK", IN AN AMOUNT NOT TO EXCEED $59,075.00; ALLOCATING FUNDS THEREFOR FROM THE FISCAL YEAR 1998-1999 BUDGET OF THE DEPARTMENT OF PARKS AND RECREATION, AID TO PRIVATE ORGANIZATIONS ACCOUNT. WHEREAS, the Little Havana Development Authority, Inc. ("LHDA"), is a not -for -profit 501 (C) (3) organization founded in 1976 to foster, encourage and promote economic development in the City of Miami and more particularly in the area known as "Little Havana"; and WHEREAS, Maximo Gomez Park, more commonly known as Domino Park, located at the corner of Southwest 8th Street and 15th Avenue, Miami, Florida, in the heart of the Little Havana neighborhood, serves the low and moderate income residents and has evolved as a recognizable tourist attraction; and WHEREAS, in the best interest of the Little Havana community, the City of Miami has in the past approved funding for CITY CO'1rIIu$9Ioff MEETING O,F SEP 2 8 1998 F1690106M 8- 898 the LHDA to supervise, manage and operate Domino Park, from the Department of Parks and Recreation Operating Budget; and Whereas, it is now necessary to authorize the execution of an agreement with the Little Havana Development Authority, Inc. and to allocate funds for the operation and management of Maximo Gomez Park; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorizedll to execute an agreement, in a form acceptable to the City Attorney, with the Little Havana Development Authority, Inc., a Florida not -for -profit corporation, for the management and operation of "Maximo Gomez Park", also known as "Domino Park", in an amount not to exceed $59,075.00, with funds therefor hereby allocated from the Fiscal Year 1998-1999 Budget of the Department of Parks and Recreation, Aid to Private Organizations Account. Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. - 3 - 98- 898 CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO: Honorable Mayor and Members of the City Commission FROM: Pld. %Warshaw City Manager RECOMMENDATION: CA=13 DATE: SEIx Z ' 1998 FILE : SUBJECT: Resolution Authorizing the LHDA Agreement for Management of Domino Park REFERENCES: Proposed Resolution & ENCLOSURES: Agreement It is respectfully recommended that the City of Miami Commission adopt the attached resolution authorizing the City Manager to enter into an agreement, in an amount not to exceed $59,075, and in a form acceptable to the City Attorney, with the Little Havana Development Authority, Inc., ("LHDA") a Florida -not -for profit corporation. The agreement is necessary to provide for management and operating services for Maximo Gomez Park, more commonly known as Domino Park. The resolution further authorizes said compensation to be paid from funds already allocated for this purpose in the Aid to Private Organization Account of the Department of Parks and Recreation F.Y. `98-'99 Budget. BACKGROUND: The Department of Parks and Recreation recommends that the City of Miami enter into an agreement in the amount of $59,075, with the Little Havana Development Authority, Inc., to continue uninterrupted management and operations services of Domino Park for a term of one (1) year with two (2) one year renewal options. This is the same funding amount provided to this organization for the past two years for these services. Maximo Gomez Park, commonly known as "Domino Park" is located in the heart of the Little Havana neighborhood, at S.W. 8' Street and S.W. 15`' Avenue. This park is very important to the residents of the Little Havana community. It is also a recognizable tourist attraction for our City. The Little Havana Development Authority, Inc, is a non-profit 501 (C)(3) organization founded in 1976 to foster and promote economic development in the City of Miami and more particularly in the area of Little Havana. In addition, to the many community activities performed by the LHDA, since 1988, it has provided the City of Miami experienced operational and management services of Domino Park. These services include managing the daily operations and maintenance of the Park, coordinating special Honorable Mayor and Members of the City Commission Page 2 '- community events such as Domino tournaments, distributing tourist related information, and developing and distributing one brochure promoting the park. It should be noted that the only work program element that LHDA has not been able to fully complete is the printing and distribution of a promotional brochure about the park. As requested, they did complete a draft of one and submitted it for approval. However, since this agency's funding was reduced two (2) years ago, they have not had the necessary funds to be able to pay for the costs of printing such a brochure. WORK PROGRAM GRANTEE should supervise, manage and monitor all work performed and/or services rendered relative to the daily operations and maintenance of the park. 2. Park shall operate according to the following schedule: Monday through Friday 9:00 am to 0:00 pm Saturday and Sunday 9:00 am to 6:00 pm Park hours may be adjusted as park usage dictates, upon the approval of the Director. 3 GRANTEE shall regularly conduct at least twelve (12) community events at the Park during the term of this agreement GRANTEE shall provide the CITY of Miami Parks and Recreation Department with a written evaluation for each event and submit to the City in the next quarterly report: 4. GRANTEE shall seek fimding support from three (3) different sources during the term of this agreement GRANTEE shall provide the City's Park and Recreation Department with a copy of each of these applications in the applicable quarterly report. 5. GRANTEE shall develop, produce and distribute one (1) brochure promoting the Park (which may include general information on the Little Havana area) within the first six (6) months of this agreement Said brochure shall be approved by the City of Miami Parks Department. 6. GRANTEE shall bear the financial responsibility for the repair and/or replacement of any City property, facilities and/or equipment that are damaged as a result of GRANTEE'S operations and/or activities under this agreement 7. GRANTEE agrees to comply with all applicable provisions of the City code in carrying out it's responsibilities under this agreement. g.
