J887 A RESOLUTION, BY A (4/5THS) AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING THE UPGRADE OF THE FIREARMS TRAINING SYSTEM II TO A FIREARMS TRAINING SYSTEM III FROM FIREARMS TRAINING SYSTEMS, INC., THE SOLE SOURCE PROVIDER FOR THIS ACQUISITION, AT A TOTAL COST NOT TO EXCEED $30,600.00, FOR THE DEPARTMENT OF POLICE; ALLOCATING FUNDS THEREFOR FROM THE DEPARTMENT OF POLICE ENTREPRENEURIAL FUND, ACCOUNT CODE NO. 126001.290402.6.840. WHEREAS, the Department of Police needs to upgrade its Firearms Training System II to a Firearms Training System III; and WHEREAS, this system is used to train recruits and officers in high liability situations, such as the use of deadly force, firearms, and discretionary shooting; and WHEREAS, funds are available from the Department of Police Entrepreneurial Fund, Account Code No. 126001.290402.6.840; and WHEREAS, Firearms Training Systems, Inc., is the sole manufacturer of the of the Firearms Training System III; and WHEREAS, the Chief Procurement Officer has adopted a finding that Firearms Training Systems, Inc., is the only vendor able to CITY co m sa mn PEMTING QP SEP 2 8 1998 (Resolution mm upgrade the existing system to a Firearms Training System III; and WHEREAS, the finding of the Chief Procurement Officer has been approved and adopted as the finding of the City Manager; and WHEREAS, the City Manager and the Chief of Police recommend that the requirements for competitive formal sealed bids be waived and the purchase of a Firearms Training System III from Firearms Training Systems, Inc., the sole source provider, be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after a duly advertised public hearing, the City Commission hereby ratifies, approves, and confirms the City Manager s finding of sole source, waiving the requirements for competitive bidding procedures, and approves the upgrade of the Firearms Training System II to a Firearms Training System III from Firearms Training System, Inc., the sole source provider for this acquisition, at a total cost not to exceed $30,600.00, for the Department of Police, with funds therefor hereby allocated from the Department of Police Entrepreneurial Fund, Account Code - 2 - 98- 887 No. 126001.290402.6.840. BACKGROUND The Police Department needs to upgrade its Firearms Training System II to a Firearms Training System III. This system is used to train basic recruits and officers in the high liability areas of Deadly Force, Firearms, and discretionary shooting. The Chief Procurement Officer has determined that Firearms Training Systems, Inc., due to the proprietary nature of this system, is the sole manufacturer of the Firearms Training System III. Warshaw DATE : August 18, 1998 FILE: City M ger SUBJECT: Sole Source Finding to upgrade Firearms Training System FROM: JlUd C er, Dir ctor ' REFERENCES: D artme o urchasing ENCLOSURES: An investigation was conducted to determine whether Firearms Training Systems (FATS), Inc. located in Swanee, Georgia is the sole source supplier of the products and services for the Police Department's existing Firearms Training System (FATS) II which trains basic recruits and officers in deadly force, firearms, and discretionary shooting. FATS, Inc. designed the present system and all operating software, including peripherals and programmed courseware is proprietary to same. Additionally, FATS, Inc. is the only source available for the upgrade of the FATS simulators and weapons. Based upon this investigation, I am recommending that the requirements for competitive bidding be waived and the above findings be approved, that FATS, Inc. is the sole source provider to upgrade the Firearms Training System II (FATS ID to a Firearms Training System III (FATS IID. This upgrade includes: primary simulation computer, multiple wireless weapons capability (up to four wireless weapons), laser disc player, buggy cable kit, hit detect camera, external cable kit, buggy integration and testing, and software update. Also, it includes five weapon ports that allow the use of up to five officers to use system controlled weapons if desired.
