HomeMy WebLinkAboutR-98-0868J-98-883 8/17/98 RESOLUTION NO. 9 8- 868 A RESOLUTION, WITH ATTACHMENT, ACCEPTING AND ADOPTING THE CITY OF MIAMI, MIAMARINA AT BAYSIDE ECONOMIC DEVELOPMENT PLAN, ATTACHED HERETO AND MADE A PART HEREOF, FOR THE ASSIGNMENT OF COMMERCIAL VESSEL SLIPS ALONG THE INTRACOASTAL WATERWAY OF MIAMARINA, KNOWN AS THE ICW SEA WALL. WHEREAS, the City Commission directed the Department of Public Facilities to develop an Economic Development Plan for the assignment of commercial vessel slips at Miamarina at Bayside; and WHEREAS, the Department of Public Facilities was further directed to conduct a public hearing for the purposes of soliciting input for said plan; and WHEREAS, a public hearing for this purpose was held on August 12, 1998 at City Hall, during the Waterfront Advisory Board meeting; and WHEREAS, members of the public, including representatives from Bayside Market Place, Bayfront Ventures, International Trade Board, U.S. Submarines Inc., Floribbean Hospitality Cruises, Kite Hunter, Inc., Francisco Mingo, Crazy Clam Cruises, A -Biscayne Cruise IATTACHMENT (S)I CONTAINED CITY coKK=()n KEETWG of SEP 0 8 W8 Ammmimuft Line, provided input on the proposed plan; and WHEREAS, the majority of those who provided input supported the Economic Development Plan proposed by the Department of Public Facilities; and WHEREAS, the Waterfront Advisory Board designated board member, Jack King, to speak as the representative of the board at the City Commission Meeting on September 8, 1998; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City of Miami, Miamarina at Bayside Economic Development Plan, attached hereto and made a part hereof, for the assignment of commercial vessel slips along the Intracoastal Waterway of Miamarina, known as the ICW Sea Wall, is hereby accepted and adopted. MIAMARINA AT BAYSIDE HISTORY The City of Miami's Miamarina facility has hosted recreational and commercial boaters for over forty years. The Marina's commercial business development traces its roots to the fleet of wooden hulled fishing vessels of Pier 5, which supplied much of Miami with "fresh off the boat" fish for many years. Completely rebuilt after Hurricane Andrew, Miamarina at Bayside was reopened to the public in October of 1997. The facility now provides for a mixed use of pleasure and commercial vessels. Of the one hundred thirty total slips available in the reconfigured Marina, eighty seven have been allocated for pleasure vessel use, and the remaining forty three are considered "commercial dockage". The majority of the commercial slips are located on the west side of Miamarinais inside basin, known as "Pier 5". The remaining commercial slips are located on the South Wall of the inside basin and on the Marinais east - CIO ern outside wall along the Atlantic Intracoastal Waterway (known as the "ICW Sea Wall"). a� I Commercial vessel dockage at Miamarina is currently comprised of sightseeing, sportfish charter, sail charter, sail sightseeing, and commercial fishing vessels. Of the forty three commercial slips available, twenty one (or 00 49%) are currently licensed for long-term dockage. Of those twenty one commercial vessels, ten (or 48%) are classified as "sightseeing vessels". Based on recurring monthly revenues of $14,793 for July, August, September I 00 00 AREA / MARINA DEVELOPMENT The development of the Bayside Marketplace by the Rouse Corporation in 1984 provided a tremendous increase in exposure for Miamarina. The Marinais commercial businesses gradually moved away from fishing related activ- ities, and toward tourist / visitor services. Large sightseeing vessels began operations from both within the inside basin and along the ICW Sea Wall, drawing from the hundreds of thousands of vacationing visitors that visit Bayside annually. While sightseeing operations within the basin have flourished, sightseeing vessels operating from the ICW Sea Wall have provided a documented record of failure (the latest casualty, the Miami Queeni, ceased operations at Miamarina in March of 1998). Future area development with a large potential of positive impact for Miamarina includes the construction of the new American Airlines Arena, located just across the street from the Marina. It is anticipated that a large number of visitors taking in events at the Arena will choose to come by water, making Miamarina an ideal choice for overnight stays. Additionally, construction of a new domed baseball stadium for the Florida Marlins may very well take place within blocks of the Marina, making the facility immensely popular for the same reasons mentioned above. Finally, the National Marine Manufacturers Association, sponsor of the Miami International Boat Show (held annually in February) have renewed their relationship with Miamarina for the 1999 Boat Show. It is antici- pated that Miamarina will be seen by over 200,000 visitors during the seven day event (providing international exposure for the facility and the City of Miami). Since rgopening in October of 1997, several exciting ideas for new commercial business have been introduced to Miamarina. Some are new ventures, and some are businesses that have expressed strong interest in either mov- ing or expanding existing operations to the City of Miami. The new businesses continue to be tourist / visitor ori- ented, but in different ways than existing sightseeing operations. These proposed businesses include direct pas- senger ferry service between Miamarina at Bayside and Key West; comprehensive Water Sports Charters (which would include parasail, jetski, sailing, and diving adventures in the Upper Keys); luxury megayacht charters and dinner cruises; and even a passenger submarine (taking trips to explore the areas many reefs and wrecks). cc Miamarina possesses two vital features that will allow the facility to accommodate these new commercial and pleasure vessels: deep water in and around the Marinais slips (allowing access to larger vessels), and a great deal I of linear dockage (also referred to as "alongside dockage"). These assets will enable Miamarina to attract not only the new commercial businesses mentioned above, but also large privately owned yachts desiring temporary or permanent dockage. U.S.C.G CERTIFICATE OF INSPECTION OR SURVEY CERTIFICATE t70 The Economic Development Plan for Miamarina at Bayside was developed by the City of Miamiis Department of Conferences, Conventions, & Public Facilities to provide a blueprint for the sustained growth and success of plea- sure and commercial vessel operations at the facility. While the majority of this report deals with commercial ves- sel operations, a brief summary of pleasure vessel operations planning is warranted. The original analysis for the economic development of Miamarina at Bayside recommended a total and absolute emphasis on "day boat excursions" (visitors by boat to Bayside for up to several hours) and overnight transient vessels. This emphasis would have served to exclude any type of seasonal or long-term dockage of pleasure ves- sels at Miamarina. This recommendation was subsequently determined to be economically impractical for the sus- tained financial viability of the Marina. Current long-range strategic planning for pleasure vessel operations at Miamarina calls for a blend of overnight transient, seasonal, and long-term dockage to optimize revenues for the City. This department recognizes the importance of day boat excursioners to the success of both Miamarina and Bayside Marketplace, and has set aside a significant amount of linear dockage within Miamarina basin for vessels desiring temporary dockage. Additionally, the Marina has recently added a state-of-the-art concrete floating pier that will meet the needs of the many smaller vessels and jetskis desiring temporary dockage. The following pages outline proposed new commercial businesses seeking long-term commercial dockage at Miamarina at Bayside, and the direct economic benefits to the City of Miami these businesses will provide. Intangibles such as increased jobs for City residents, additional visitor traffic and revenues to Bayside Marketplace, revenues from fees, taxes, etc. are not addressed in detail in this report. These vessels and business are not competitive to each other or to current commercial vessels already berthed at Miamarina - rather, they will complement the existing commercial vessels at the facility, and will serve additionally to attract other pleasure and commercial vessels to Miamarina by virtue of their unique qualities and style. '-----�; The Deepstar is a 45-passenger tourist submarine with a unique pressure hull composed of polymcthyl methacrylate (acrylic plastic) which provides passengers with panoramic viewing. The submarine was built in 1992 and is classed +Al Manned Submersible by the American Bureau of Shipping. The certified diving depth is 80 meters. The submarine is electric powered with batteries stored in external one -atmosphere pods and motive force derived from IOkW brushless DC electric thruster motors. The submarine has made approximately 3200 dives through its operating history and has 15-20 years of remaining useful life. Freebex Pontoon Support Barge Overall Length: 26.00 m Overall Height: 5.80 m Overall Beam: 10.00 m Weight in Air: 95 tons Description: The Freebex is a pontoon barge with a hydraulic lift between the pontoons capable of fully lifting the Deepstar submarine from the water. Internal space in the pontoons houses equipment and machinery space and spare parts storage plus a workshop and crew area. A diesel generator provides electrical power and a second diesel provides power for the hydraulic Schottel drives that are used for slow speed maneuvering in close quarters, The Freebex also contains the high presure air compressor, battery chargers and oxygen transfer pump necessary for the operation of the submarine. The Freebcx was built in 1992 and rebuilt in 1993 when the bridge deck and maneuvering systems were added. We have had more than sixty charters out of the Marina to date. Designed and built specifically for corporate and special events, the 135 foot Carrousel Yacht has impressed countless presidents, ambassadors, VIP's and CEO's from around the world, and has catered to such Fortune 500 Companies as Motorola, American Express, Ford Motor Co., Bell South, Citibank, Coca-Cola, American Airlines and AT&T. Great Bay Yacht Charters welcomes the wonderful dock improvements the City has made at Miamarina. In the past it has not always been conducive to recommend Bayside as a venue to our high profile clients because of the reputation and surrounding areas. Additionally the seawall docks were not in first class condition or set up for accommodating larger yachts. However it is evident on docking recently that not only have the docks continued to maintain a high standard, but the whole area and image of Miamarina is undergoing a new facelift. Great Bay Yacht Charters is hoping to expand in the near future and would seriously consider using Miamarina as a permanent dock, but only if the class of yachts being attracted to dock at Miamarina are at a level that would improve the image, bringing Miamarina up to a first class operation, on a par with Pier 66 and Bahia Mar. Our hope is that the upgrading continues, so that the City of Miami can receive the recognition in the boating industry it deserves. Dade has every opportunity, presence and leadership at the Miamarina to compete with the world class facilities only available in Fort Lauderdale. (305) 530-9700 Fax (305) 539-5108 A DIVISION OF GREAT BAY CORD 9 8 - 868 MIAMARINA AT BAYSIDE PLAN IMPLEMENTATION Of the seven new commercial vessels mentioned in the preceding pages of this report, six are ready to sign dockage agreements and commence operations within forty five days. Unfortunately, current City Code prohibits six of these seven (translating to an additional $7,000 per month in dockage revenues) from doing business with the City of Miami. City Code prohibits commercial vessels / busi- nesses that are not City or county residents from operating at City marinas. This restriction has made it impos- sible for City Marina facilities to attract successful businesses from expanding their operations to Miami, and has choked the growth and development of new marine oriented businesses in this City. As the cornerstone of implementing this economic development plan, this department recommends amending the City Code to remove the prohibition on non -City / county businesses from bringing their businesses to the City of Miami, and streamlining the current application process for commercial dockage (which generally takes in excess of two months to complete, delaying needlessly additional revenues to the City). This department will be sponsoring legislation at the City Commission Meeting to be held on September 8, 1998 that will accomplish the above (see attached "Exhibit B"). Additionally, other legislation proposed by this department will strengthen 00 I City marinas' ability to enforce existing procedures in collecting delinquent dockage from marina customers. EXHIBIT B PROPOSED AMENDMENTS TO MIAMI CITY CODE SECTION 50-61 (new): Application for commercial dockage. Vessels making application for commercial dockage at City Marinas shall furnish the Marinas Manager with the following information: 1. Business name, address, date of incorporation, vessel operators years of experience 2. Proof of documentation / registration for commercial purposes 3. Occupational License (or Application copy) 4. Proof of vessel / business liability insurance 5. Description of the vessel, including: a. vessel name / manufacturer / identification number b. length / beam / draft c. seating capacity d. gross / net tonnage e. description of commercial activity If the vessel making application is a sightseeing or excursion vessel, the applicant shall, in addition to the above, furnish the following: 6. United States Coast Guard Captain's / Master's License for all vessel operators 7. Three (3) Professional Letters of Reference 8. Current U.S.C.G. Certificate of Inspection or Survey Certificate SECTION 50-338 (rewritten) : Dockage fees at all City Marinas are due and payable in advance. Monthly dockage fees, based on a 30-day month, are due and payable on the first day of each month and shall be considered delinquent if not paid on or before the tenth of the month. A tenant who is delinquent for a period of twenty days shall be considered to be in breach / default of their Dockage Agreement, and shall have thirty days to pay in full all outstanding dockage payments and late fees owed to the City. If pay- ment in full is not made after this period, the City shall revoke his / her Dockage Agreement and reassign the berth and, if the vessel is still occupying the berth, to impound the vessel in accordance with the procedure for impounding vessels as �.0 specified in Sections 50-2 through 50-4 of this Code. 00 I SECTION 50-343 (new): Reapplication for dockage after revocation. 00 Any person, or principal in a business or corporation listed as licensee for dockage at a City Marina who has had that dock- age agreement revoked by the City, may reapply for dockage after a period of twelve months. Any outstanding dockage pay- ments, late fees, or other charges owed to the City must be paid in full prior to reapplication for dockage. SUMMARY This report summarizes the efforts of the City of Miami's Department of Conferences, Conventions, and Public Facilities to successfully operate Miamarina at Bayside. The proposed commercial vessels outlined in this report will provide the City of Miami with the following: • Significant additional revenue • Complementary businesses to existing commercial operations at Miamarina • Additional economic benefit through employment, local purchase of goods and services, fees, taxes, etc. Miamarina's Mission Statement calls on this Department "to operate a world class marina" - the Economic Development Plan for Miamarina will provide that, and much more, for the City of Miami. 00 Christina P. BACKGROUND The City Commission, at their meeting of July 21, 1998, directed the Department of Public Facilities to develop an Economic Development Plan for the assignment of slips to commercial vessels at Miamarina. Further, the Department of Public Facilities was directed to conduct a public hearing for the purposes of soliciting input into the development of the plan, and instructing the administration to present the plan at the City Commission meeting on September 8,1998. After providing public notice to all concerned parties, and advertising such meeting to the public, the department presented the proposed Economic Development Plan to the public during the regularly scheduled meeting of the City of Miami Waterfront Advisory Board. A copy of the Plan is attached. Members from the public, and organizations associated or interested in Miamarina, participated in the public hearing. The vast majority of the participants expressed their support of the Economic Plan. The proposed Economic Development Plan will increase revenues to the City in the amount of $90,000 annually, provide a diverse mix of commercial vessels in Miamarina, complement the existing commercial vessels, provide the public with a variety of attractions, and enhance the enjoyment of Miamarina and Bayside Marketplace. The vessels outlined in this proposal will also serve to attract additional business to Miamarina by virtue of their unique qualities and appearance. In addition, the proposed plan will alleviate the dangerous congestion of pedestrians at the entrance into the valet and marina parking lot by diverting the public away from the area and into the marina.
