HomeMy WebLinkAboutR-98-0861J-98-926 8/26/98 RESOLUTION NO. 9 S 8 6 1 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO THE AGREEMENT BETWEEN THE CITY OF MIAMI AND HAWKINS, DELAFIELD & WOOD AND HOLTZMAN, KRINZMAN, EQUELS & FURIA, P.A., CO -BOND COUNSEL FOR THE CITY, TO EXTEND SAID AGREEMENT FOR A ONE (1) YEAR PERIOD, ENDING SEPTEMBER 30, 1999, AND INCREASE THE FEE CAP TO SAID FIRMS FROM $138,000 TO $188,000, PLUS $20,000 FOR EXPENSES; ALLOCATING FUNDS THEREFOR FROM ACCOUNT CODE NO. 00100.921002.6.270. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorizedl/ to execute an amendment, in a form acceptable to the City Attorney, to the Agreement between the City of Miami and Hawkins, Delafield & Wood and Holtzman, Krinzman, Equels & Furia, P.A., co -bond counsel to the City, to extend said agreement for a one (1) year period, ending September 30, 1999, and increase the fee cap to said firms from $138,000 to $188,000, plus $20,000 for expenses, l� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. Warshaw REFERENCES: City Commission Meeting City Manager September 8, 1998 ENCLOSURES: RECOMMENDATION It is respectfully recommended that the City Commission authorize a one year extension to the agreement between the City of Miami and Hawkins, Delafield & Wood and Holtzman, Krinzman, Equels & Furia, P. A., co -bond counsel for the City, as amended; furthermore setting forth an annual fee cap of $50,000, plus $20,000 in expenses, and allocating funds therefore from account code no. 00100.921002.6.270. BACKGROUND Pursuant to Resolution 96-945, the City authorized the City Manager to execute an agreement with Hawkins, Delafield & Wood and Holtzman, Krinzman, Equels & Furia, P. A. to provide legal financial emergency services and bond tax and disclosure services to the City of Miami, in an amount not to exceed $50,000, as amended, from December 18, 1996, until September 30, 1998, with three one-year renewal options subject to City Commission approval. Over the past two years, co -counsel has provided the City with on -going legal advisory services within the scope of work detailed in Exhibit A and B of the firm's contract with the City. Adoption of this Resolution will enable the City to continue to utilize the services of the City's co -counsel to perform work pursuant to the scope of services as outlined in the attachments for an additional one-year period, through September 30, 1999.
