HomeMy WebLinkAboutR-98-0835J-98-869 8/13/98 RESOLUTION NO. 9 8- 835 A RESOLUTION AUTHORIZING THE CONTINUED FINANCING OF PROTRACTED, COMPLEX INVESTIGATIONS BY THE POLICE DEPARTMENT, IN AN AMOUNT NOT TO EXCEED $350,000.00, AND ALLOCATING FUNDS THEREFOR, FROM THE LAW ENFORCEMENT TRUST FUND, PROJECT NUMBERS 690001, 690002, AND 690003, SUCH EXPENDITURES HAVING BEEN CERTIFIED BY THE CHIEF OF POLICE AS COMPLYING WITH FLORIDA STATUTE, §932.7055, AS AMENDED AND THE U. S. DEPARTMENT OF THE TREASURY'S "GUIDE TO EQUITABLE SHARING." WHEREAS, Florida Statute, §932.7055, as amended, and the U.S. Department of the Treasury's "Guide to Equitable Sharing", authorizes the use of Law Enforcement Trust Fund monies to defray the costs of protracted and/or complex investigations and to provide law enforcement with additional technical equipment and expertise; and WHEREAS, the Department of Police is required to conduct protracted and/or complex investigations which often obligate additional monies for such costs as overtime, the purchase/rental of equipment and supplies, payment of confidential informants, and other investigative support expenses; and WHEREAS, it is in the best interest of the community and the City of Miami to continue to fund these expenditures with monies generated through seizures authorized under the am COOLMUM MEET= Or SEP 8 la Rawwrioo um 98- 835 Florida Contraband Forfeiture Act and the U. S. Department of the Treasury's "Guide to Equitable Sharing;" and WHEREAS, funds to cover these necessary and legitimate costs and expenditures have not been included in the Department of Police's normal operating budget; and WHEREAS, the Chief of Police has recommended adoption of this Resolution and has certified that the proposed expenditures comply with Florida State Statutes, §932.7055, as amended and the U. S. Department of the Treasury's "Guide to Equitable Sharing;" NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The continued financing of protracted, complex investigations by the Police Department, is hereby authorized, with funds therefor hereby allocated, in an amount not to exceed $350,000.00, from the City of Miami Law Enforcement Trust Fund, Project Numbers 690001, 690002, and 690003, such expenditures having been certified by the Chief of Police as complying with 2 98- 835 Florida State Statutes, §932.7055, as amended and the U. Funding is to be provided from the Law Enforcement Trust Fund, Project Numbers 690001, 690002, and 690003 . BACKGROUND The Miami Police Department is currently involved in several protracted, complex investigations, as authorized under Florida Statute 932.704, of the Florida Contraband Forfeiture Fund and the U. S. Department of Treasury's "Guide to Equitable Sharing." The monies requested will be utilized to continue these comprehensive investigations outside of normal and established operations of the Miami Police Department. Funds are required for the payment of confidential informants, the provision of buy monies, the provision of consultant/expert services, and any other special investigative expenditures required for successful completion of these protracted, complex investigations, as authorized by the Chief of Police.
