HomeMy WebLinkAboutR-98-0784J-98-684(a) 6/23/98 RESOLUTION NO. 98- '784 A RESOLUTION, WITH ATTACHMENT (S), AFFIRMING THE DECISION OF THE ZONING BOARD THEREBY GRANTING A SPECIAL EXCEPTION FROM THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 9, SECTION 931.2, REQUIREMENT FOR RESERVOIR SPACES, TO ALLOW ONE DRIVE THROUGH TELLER WINDOW FOR PROPOSED BANKING INSTITUTION CURRENTLY UNDER CONSTRUCTION AND SECTION 931.2(A), DRIVE THROUGH BANKS, TO WAIVE THREE OF THE REQUIRED TEN RESERVOIR SPACES, FOR THE PROPERTY LOCATED AT 7101 S.W. 8TH STREET, MIAMI, FLORIDA; MORE PARTICULARLY LEGALLY DESCRIBED HEREIN; SUBJECT TO (1) A TIME LIMITATION OF TWELVE (12) MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED (2) OWNER SHALL SUBMIT A NEW LANDSCAPE PLAN WHICH IS TO BE REVIEWED AND APPROVED BY THE PLANNING DEPARTMENT PRIOR TO THE ISSUANCE OF AN BUILDING PERMITS, PLAN SHALL DEPICT SPECIFICATIONS, IRRIGATION, ILLUMINATION AND A "LEFT TURN ONLY" SIGN AT THE DRIVE THROUGH EXIT, AND (3) DRIVE THROUGH TRAFFIC WILL BE LIMITED TO A "LEFT TURN ONLY" EXIT. WHEREAS, the Miami Zoning Board at its meeting of June 1, 1998, Item No. 4, adopted Resolution No. ZB 1998-0069 by a six to one (6-1) vote, granting a special exception requiring City Commission approval as hereinafter set forth; and WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, requires City Commission approval of the special exception as hereinafter set forth; and ATTACHMENT (S) CONTAINED vrff GOM MMON MEEiEIdG OF J U h ?. 1 1998 Resolution No. 98 784 WHEREAS, the City Commission after careful consideration of this matter, finds the application for special exception does meet the applicable requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to affirm the decision of the Zoning Board and grant the Special Exception; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The decision of the Zoning Board to grant a Special Exception from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 9, Section 931.2, Requirements for Reservoir Spaces, to allow one drive through teller window for Banking Institution presently under construction, and Section 931.2(A), Drive Through Banks, to waive three of the required ten reservoir spaces for the property located at 7101 S.W. 8th Street, Miami, Florida, more particularly legally described in Exhibit "A" attached hereto and made a part hereof, is hereby affirmed, and the Special Exception is hereby granted subject to (1) a time limitation of twelve (12) -3- 98- 784 months in which a building permit must be obtained (2) Owner providing a new landscape plan for review and approval by the planning department which increases the amount of shade trees and hedges prior to issuance of building permits, plan shall depict specifications, irrigation, illumination and a "Left Turn Only" sign at drive through exit, and (3) the drive through exit traffic shall be limited to a "Left Turn Only" exit. Case No. 1998-0122 Pursuant to Section 931.2 of Ordinance 11000, as amended, The Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed for drive-thru that do not meet the minimum reservoir spaces required as follows: Required reservoir spaces before teller window - 10 Proposed reservoir spaces before teller window - 7 The following findings have been made: • It is found that the Department of Planning and Development is reviewing the amount of required reservoir spaces before teller windows for banks with drive - through service and will present an amendment to the Ordinance 11000 in order to decrease the number of the requirements in the next future. • It is found that use is compatible with the area and will be beneficial by providing a needed service to the community, and it is also found that the use is in scale and char- acter with the surrounding area. • It is found that the proposed layout provides adequate parking and circulation how- ever, the drive -through exit traffic should be restricted to left turn only. • It is fond that the depicted landscape is not adequate regarding the amount of plants proposed. • It is found that upon compliance with the condition set forth below, this project will not have any adverse impacts on the surrounding area. Based on these findings, the Department of Planning and Development is recom- mending approval of the application subject to the following condition: A new landscape plan increasing the amount of shade trees and hedges must be submitted for review and approval by the Planning Division prior to the issuance of any Building Permits. This new landscape plan should depict specifications, irriga- tion and illumination and also a "Left turn only" sign at the drive -through exit.
