WHEREAS, the Miami Zoning Board at its meeting of June 1, 1998, Item No. 5, adopted Resolution No. ZB 1998-0067 by an seven to zero (7-0) vote, granting a special exception subject to certain conditions; and WHEREAS, an appeal has been taken to the City Commission by adjoining property owners from the granting of said special exception; and WHEREAS, the City Commission after careful consideration of this matter, finds the application for special exception does meet the applicable requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to affirm the decision of the Zoning Board and grant the Special ATTACHMENTS -:1011TAIINED 0"IT caMMSION, MEETING of JU L 2 1 1998 Resolution No. 98- 782. Exception subject to the conditions set forth herein below; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The decision of the Zoning Board to grant a Special Exception from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 9, Section 917.6, Reduction in Parking Requirements for Housing for Low Income Families and Individuals, to allow a reduction of up to 50% of the required offstreet parking spaces, 121 spaces provided (61.4%) where 197 are required, for the property located at 1400 N.W. 16th Avenue, Miami, Florida, and more particularly legally described in Exhibit "A" attached hereto and made a part hereof, Zoned R-4 Multifamily High -Density Residential District, is hereby affirmed in part, and the Special Exception is hereby granted subject to a time limitation of twelve (12) months in which a building permit must be obtained. - 2 - 98- 782 Section 3. ("Tequesta") in connection with the captioned matter. Tequesta was the applicant who originally requested a special exception pursuant to Section 917.6 of the City's Zoning Ordinance No. 11,000 to allow for a reduction in the off-street parking requirements (the "Special Exception") for its affordable housing project. On June 1, 1998, the City's Zoning Board passed and adopted Resolution ZB 1998- EM This letter shall serve as Tequesta's request for review of the Zoning Board's decision by the City Commission. Although Tequesta agrees with the Zoning Board's decision in approving the Special Exception, it cannot agree and submits for City Commission review the conditions placed on the approval, see attached copy of Resolution ZB 1998-W67 (the "Conditions"). 98 - 782 Ms. Teresita Fernandez June 11, 1998 Page 2 We believe the Conditions are arbitrary and speculative in that they require public hearings after the project is built and occupied. These Conditions may prevent Tequesta from obtaining the necessary financing to construct this much needed affordable housing development. The evidence presented by Tequesta and the City's professional staff at the public heating warranted approval of the Special Exception without the above cited conditions.
