A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF THE
MEMBERS OF THE CITY COMMISSION, AFTER A DULY
ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING
AND CONFIRMING THE CITY MANAGER'S FINDING OF SOLE
SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE
SEALED BIDDING PROCEDURES AND APPROVING THE
PURCHASE OF A PORTABLE CLINICAL BLOOD ANALYZER
FROM I-STAT CORPORATION, THE SOLE SOURCE PROVIDER
FOR THIS EQUIPMENT, FOR THE DEPARTMENT OF FIRE -
RESCUE, URBAN SEARCH & RESCUE (US&R) TEAM, AT AN
AMOUNT NOT TO EXCEED $7,000.00; ALLOCATING FUNDS
THERFOR FROM THE STATE OF FLORIDA GRANT, URBAN
SEARCH AND RESCUE, ACCOUNT CODE NO.
313826.802801.6650.84029.
WHEREAS, currently the determination of the physiological effects of heat,
dehydration, and other biological effects on US&R Team members working at disasters in
austere conditions, or on victims trapped in confined spaces over long periods of time, is
possible only through blood analysis; and
WHEREAS, certain equipment has been identified and required by the Federal
Emergency Management Agency (FEMA) as vital for the US&R Team members to safely
perform their duties; and
WHEREAS, funding is available from the Department of Fire -Rescue, State of Florida

WHEREAS, I-Stat Corporation is the sole manufacturer and provider of the existing
portable clinical blood analyzer of the US&R Team; and
WHEREAS, the Chief Procurement Officer has adopted a finding that I-Stat
Corporation is the only vendor able to provide a portable clinical blood analyzer to the
US&R Team; and
WHEREAS, the finding of the Chief Procurement Officer has been approved and
adopted as the finding of the City Manager; and
WHEREAS, the City Manager and the Director of the Department of Fire -Rescue
recommend that the requirements for competitive formal sealed bids be waived and the
purchase of a portable clinical blood analyzer from I-Stat Corporation, the sole source
provider, be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution
are hereby adopted by reference thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a four -fifths (4/5`hs) affirmative vote of the members of the City
Commission, after a duly advertised public hearing, the City Commission hereby ratifies,
approves, and confirms the City Manager's finding of sole source, waives the requirements
for competitive bidding procedures, and approves the purchase of Portable a Clinical Blood
Analyzer from I-Stat Corporation, the sole source provider for this acquisition, for the
Department of Fire -Rescue, Urban Search & Rescue (US&R) Team, at an amount not to

exceed $7,000.00, with funds therefor hereby allocated from the State of Florida Grant,
US&R, Account Code No. 313826.802801.6650.84029.
Section 3. This Resolution shall become effective immediately upon its adoption
and signature of the Mayor'.

RECOMMENDATION:
It is hereby requested that the City Commission adopt the attached Resolution, by a four -fifths
(4/5ths) affirmative vote of the members of the City Commission, after a duly advertised public
hearing, ratifying, approving, and confirming the City Manager's finding of sole source; waiving
the requirements for competitive sealed bids and approving the engagement of I-Stat
Corporation, 303 College Road East, Princeton, NJ 08540 (a non-minority/non-local vendor), for
a one-time purchase of a Portable Clinical Blood Analyzer for Urban Search and Rescue, in an
amount not to exceed $7,000; allocating funds therefore from the Department of Fire -Rescue,
State of Florida Grant for Urban Search & Rescue, Account Code 313826.802801.6650.84029.
BACKGROUND:
The immediate and continuous ability of the medical team to monitor rescue team
members conducting rescue operations is critical to the effective, efficient, and safe
completion of their assignments. Currently the only way to determine the correct
physiological effects of heat, dehydration, and other biological effects on team members
working at disasters in austere conditions or on victims trapped in confined spaces over
long periods of time is through blood analysis. The Portable Clinical Blood Analyzer has
been identified and required by the Federal Emergency Management Agency as a vital
piece of protective equipment for team members to safely perform their duties.
As the Chief Procurement Officer has deemed the acquisition of a Portable Clinical
Blood Analyzer by I-Stat Corporation as a sole source, it is therefore recommended at
this time that the City Commission ratify the City Manager's finding of sole source and
authorize the acquisition of these services.

An investigation was conducted by the staff from the Department of Purchasing to determine whether I-Stat
Corporation, a non -minority / non -local vendor, located at 303 College Road East, Pringeton,N.J. 08540, is the sole
source provider for its Portable Clinical Blood Analyzer.
After extensive research conducted by my staff, we have been unable to locate any other similar portable product
meeting City and FEMA requirements from any other firm other than the I-Stat Corporation. It has been determined
that I-Stat is the sole manufacturer and distributor of this Portable Clinical Blood Analyzer in the United States, and
it cannot be obtained from any other source. The Department of Fire -Rescue is seeking to acquire this portable
Analyzer with Accessories for their Urban Search and Rescue (US&R) Team as this Analyzer is necessary as
currently there is no way for them to determine correct physiological effects of heat, dehydration, and other
biological effects on team members working at disasters in austere conditions, or on victims trapped in confined
spaces over long periods of time. The Department is seeking the Analyzer from I-Stat due to its portability (size of a
cordless phone and weight of 1 lb.), the blood components it is required to measure, and its speed in producing
results. The Portable Clinical Blood Analyzer is a vital piece of equipment due to the immediate and continuous
ability of the medical team to monitor team members conducting rescue operations. In addition, it was reported the
Federal Emergency Management Agency (FEMA) has identified and required the Medical component of the US&R
Team to have a Portable Clinical Blood Analyzer for team members and victim care.
Accordingly, I am recommending that the requirements for competitive bidding be waived, and these findings be
approved: I-Stat Corporation is the sole source supplier of the Portable Clinical Blood Analyzer for the Department
of Fire -Rescue.

Accessories
The Department of Fire -Rescue is seeking the acquisition of a Portable Clinical Blood Analyzer with Accessories for the Urban
Search and Rescue Team from the I-Stat Corporation be deemed a sole source. An investigation was conducted to determine
whether I=Stat Corporation, a non-minority/non-local vendor located at 303 College Road East, Princeton, N.J. 08540, is the sole
source provider of a Portable Clinical Blood Analyzer requested by the Department of Fire -Rescue.
Fire -Rescue advised this portable Analyzer is necessary as currently there is no way for them to determine correct physiological
effects of heat, dehydration, and other biological effects on team members working at disasters in austere conditions, or on
victims trapped in confined spaces over long periods of time. The Department is seeking the Analyzer from 1-Stat due to its
portability (size of a cordless phone and weight of 1 lb.), the blood components it can measure, and its speed in producing
results. The Clinical Analyzer is a vital piece of protective equipment due to the immediate and continuous ability of the medical
team to monitor team members conducting rescue operations. In addition, it was reported the Federal Emergency Management
Agency (FEMA) has identified and required the Medical component of the US&R Team to have a Portable Clinical Blood
Analyzer for team members and victim care.
In order to determine if there were other sources from which to obtain a similar product, I conducted extensive research and
found only 2 similar firms who provide a similar "portable" blood analyzer. There are firms that provide table -top machines
similar in size to a fax, but not portable. However, of the two found, one is "portable" but its weight is 15 pounds, which is too
heavy for those using this product in the field. The other firm's product does not measure all the components required to be
analyzed in a blood sample by FEMA as it measures only two components of the blood. As a result, these two products did not
meet the requirements of the Department nor FEMA.
Contact was also made with Ms. Vivian Scarpitti from the I-Stat Corporation. She reported that her firm is the sole manufacturer
and distributor of the I-Stat Portable Clinical Blood Analyzer in the United States as they do not utilize any third party
distributors domestically. She further supplied me with literature of her product and all the research done by laboratories and
hospitals, all of which praise the portability and performance of the I-Stat product. As I have been unable to locate through
research of the product any other firm that offers a similar portable blood analyzer product, I have determined I-Stat
Corporation is the sole source provider of the portable clinical blood analyzer meeting City and FEMA requirements.
The proposed cost for the acquisition of the Portable Clinical Blood Analyzer with Accessories is in an amount not to exceed
$7,000.00. Funds to cover the cost of this Analyzer will be from an Urban Search and Rescue State Grant and appropriated for
Urban Search and Rescue, Code 313826.802801.6650.84029.
Therefore, I am recommending that the requirements for competitive bidding be waived and the following findings be approved:
I-Stat Corporation, a non-minority/non-local vendor, is the sole source provider of the Portable Clinical Blood Analyzer.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the City Commission of the City of Miami, Florida, on
July 21, 1998, at 10 a.m. in the City of Miami Commission chambers at City Hall, 3500
Pan American Drive, Miami, Florida, for the purpose of considering a waiver of the
requirements of obtaining sealed bids for the engagement of I-Stat Corporation, Inc., to
acquire a Portable Clinical Blood Analyzer, for the Department of Fire -Rescue. The
acquisition of the blood analyzer at this time shall be at a total cost not to exceed $7,000.
Inquires from other potential sources of providers who feel that they might be able to
satisfy the City's requirements in the provision of these services may contact Peter
Smalley, Fire -Rescue Department, at 305-446-0722.
All interested persons are invited to appear and may be heard concerning such proposed
waiver for purchase and upgrade. Should any person desire to appeal any decision of the
City Commission with respect to any matter considered at this hearing, that person shall

evidence upon which any appeal may be based.
