MEMBERS OF THE CITY COMMISSION, AFTER A DULY
ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING
AND CONFIRMING THE CITY MANAGER'S FINDING OF SOLE
SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE
SEALED BIDDING PROCEDURES AND APPROVING THE
PURCHASE OF PACIFIC RESCUE HELMETS FROM RESCUE
EQUIPMENT NW, INC., THE SOLE SOURCE PROVIDER FOR
THIS EQUIPMENT, FOR THE DEPARTMENT OF FIRE -RESCUE,
URBAN SEARCH & RESCUE (US&R) TEAM, AT AN AMOUNT
NOT TO EXCEED $19,000.00; ALLOCATING FUNDS THERFOR
FROM THE STATE OF FLORIDA GRANT, US&R, ACCOUNT
CODE NO. 313826.802801.6650.84029.
WHEREAS, the purchase of protective rescue helmets are necessary for the Urban
Search & Rescue Team (US&R) to preserve public safety and welfare in the event of an
emergency; and
WHEREAS, funding is available from the Department of Fire -Rescue, State of Florida
Grant for Urban Search & Rescue, Account Code No. 313826.802801.6650.84029; and
WHEREAS, Pacific Helmets (NZ) Ltd., is the sole manufacturer of the helmets used
by of the US&R Team for maximum protection; and
WHEREAS, Rescue Equipment NW, Inc., is the sole provider and distributor of the
Pacific Helmets in the entire United States; and

WHEREAS, the Chief Procurement Officer has adopted a finding that Rescue
Equipment NW, Inc., is the only vendor able to provide Pacific Rescue Helmets, Model
R3K/1 to the US&R Team; and
WHEREAS, the finding of the Chief Procurement Officer has been approved and
adopted as the finding of the City Manager; and
WHEREAS, the City Manager and the Director of the Department of Fire -Rescue
recommend that the requirements for competitive formal sealed bids be waived and the
purchase of Pacific Rescue Helmets from Rescue Equipment NW, Inc., the sole source
provider, be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution
are hereby adopted by reference thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a four -fifths (4/51W affirmative vote of the members of the City
Commission, after a duly advertised public hearing, the City Commission hereby ratifies,
approves, and confirms the City Manager's finding of sole source, waives the requirements
for competitive bidding procedures, and approves the purchase of Pacific Rescue Helmets
from Rescue Equipment NW, Inc., the sole source provider for this equipment for the
Department of Fire -Rescue, Urban Search & Rescue (US&R) Team, at an amount not to

exceed $19,000.00, with funds therefor hereby allocated from the State of Florida Grant,
US&R Account Code No. 313826.802801 .6650.84029.
Section 3. This Resolution shall become effective immediately upon its adoption
and signature of the Mayor'.

It. is hereby requested that the City Commission adopt the attached Resolution, by a four -fifths
(4/5ths) affirmative vote of the members of the City Commission, after a duly advertised public
hearing, ratifying, approving, and confirming the City Manager's finding of sole source; waiving
the requirements for competitive sealed bids and approving the engagement of Rescue Equipment
NW,Inc., P.O. Box 72, Redmond WA, 98073 (a non-minority/non-local vendor), for a one-time
purchase of Pacific Rescue Helmets for Urban Search and Rescue, in an amount not to exceed
$19,000; allocating funds therefore from the Department of Fire -Rescue, State of Florida Grant
for Urban Search & Rescue, Account Code313826.802801.6650.84029.
BACKGROUND:
The purchase of the aforementioned helmets is necessary in order for the Urban Search
and Rescue Team (USAR) to preserve public safety and welfare in the event of an
emergency. Currently there are numerous USAR Team members performing their duties
without vital protective equipment. The immediate and continuous ability of these team
members to be able to be on 24 hour call includes having the proper equipment to carry
out their duties safely.
As the Chief Procurement Officer has deemed the acquisition of Pacific Rescue Helmets
by Rescue Equipment NW, as a sole source, it is therefore recommended at this time that
the City Commission ratify the City Manager's finding of sole source and authorize the
acquisition of these services.

An investgAtion was conducted by the staff from the Department of Purchasing to determine whether Rescue
Equipment N.W., Inc., a non -minority / non -local vendor, located at P.O. Box 72, Redmond, Wa. 98073, is the sole
source prdvider for Pacific Rescue Helmets, Model R3K/l.
It has been determined that Rescue Equipment N.W., Inc. is the sole distributor of the these Pacific Rescue Helmets
in the entire United States, and they cannot be obtained from any other source. The Department of Fire -Rescue is
seeking to acquire these helmets for their Urban Search and Rescue (US&R) Team as there are numerous members
performing their duties without this vital equipment. Additionally, the Federal Emergency Management Agency
(FEMA) requires the use of such a low profile Kevlar helmet and specifically identifies it as a requirement in the
US&R equipment cache list for team member protection.
Accordingly, I am recommending that the requirements for competitive bidding be waived, and these findings be
approved: Rescue Equipment N.W., Inc. is the sole source supplier of the Pacific Rescue Helmets, Model R3K/1,
for the Department of Fire -Rescue.

The Department of Fire -Rescue is in need of purchasing Urban Search & Rescue
Helmets.
In 1995 the US&R Team purchased 62 low profile and light weight Kevlar helmets for
team members to use in confined space and other rescue operations. This purchase was
the Pacific Rescue Helmet.
Additionally, the Federal Emergency Management Agency requires the use of a low
profile Kevlar helmet and specifically identifies it as a requirement in the US&R
equipment cache list for team member protection.
Team member protection, low profile design, standardization, and uniformity are the
primary reasons the Department is supporting the sole source request.
Pacific Helmets (NZ) Ltd. Is the sole manufacturer of the existing helmets of the US&R
Team.
It is requested you evaluate this request and deem the acquisition of the Pacific Rescue
Helmet as a sole source.

SUBJECT: Sole Source Request for Acquisition of
Pacific Rescue Helmets

The Department of Fire -Rescue is requesting the acquisition of Pacific Rescue Helmets for the Urban Search and
Rescue Team from Rescue Equipment N.W., Inc. be deemed a sole source. An investigation was conducted to
determine whether Rescue Equipment N.W., Inc., a non-minority/non-local vendor located at P.O. Box 72,
Redmond, Wa. 98073, is the sole source provider of Pacific Rescue Helmets requested by the Department of Fire -
Rescue.
Fire -Rescue is seeking to obtain Pacific Rescue Helmet Model R3K/1 from Rescue Equipment N.W., Inc. for the
Urban Search and Rescue (US&R) Team. They advised that currently there are numerous US&R Team members
performing their duties without vital protective equipment. The immediate and continuous ability of these team
members to be on 24 hour call is critical to the effective, efficient, and safe completion of their assignments. In
addition, it was reported the Federal Emergency Management Agency (FEMA) requires the use of a low profile
Kevlar helmet, and specifically identifies it as a requirement in the US&R equipment cache list for team member
protection.
Contact was made with Lt. Peter Smalley of the Department of Fire -Rescue. He reported that the acquisition of
these Helmets can only be obtained from Rescue Equipment N.W., Inc. as they are the only distributor of these
helmets in the United States, and as such, are the sole source providers of this equipment. The Department had
previously conducted research and determined that the acquisition of these helmets best suits their needs.
Contact was also made with Mr. Randall B. Slemp, President of Rescue Equipment N.W., Inc. He reported that his
firm is the sole source provider and distributor of the Pacific Helmets in the entire United States. He further advised
that these helmets are used by the Urban Search and Rescue Teams due to the strength of the helmet as it offers the
most protection to the team members compared to other helmets made from different materials.
The proposed cost for the acquisition of the Pacific Rescue Helmets is in an amount not to exceed $19,000.00.
Funds to cover the cost of these helmets will be from an Urban Search and Rescue State Grant and appropriated for
Urban Search and Rescue, Code 313826.802801.6650.84029.
Therefore, I am recommending that the requirements for competitive bidding be waived and the following findings
be approved: Rescue Equipment N.W., Inc., a non-minority/non-local vendor, is the sole source provider of Pacific
Rescue Helmets.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the City Commission of the City of Miami, Florida, on
July 21, 1998, at 10 a.m. in the City of Miami Commission chambers at City Hall, 3500
Pan American Drive, Miami, Florida, for the purpose of considering a waiver of the
requirements of obtaining sealed bids for the engagement of Rescue Equipment NW, Inc.,
to acquire Pacific Rescue Helmets, for the Department of Fire -Rescue. The acquisition of
the helmets at this time shall be at a total cost not to exceed $19,000.
Inquires from other potential sources of providers who feel that they might be able to
satisfy the City's requirements in the provision of these services may contact Peter
Smalley, Fire -Rescue Department, at 305-446-0722.
All interested persons are invited to appear and may be heard concerning such proposed
waiver for purchase and upgrade. Should any person desire to appeal any decision of the
City Commission with respect to any matter considered at this hearing, that person shall
