RESOLUTION NO. 9 8 - 17
A RESOLUTION DIRECTING THE CITY ATTORNEY TO
PREPARE AN AMENDMENT TO CITY CHARTER
SECTION 29-B, FOR A SPECIAL ELECTION TO BE
HELD ON NOVEMBER 3, 1998, THEREBY PROPOSING
AMENDMENTS TO EXISTING PROCEDURES TO: (1)
EXEMPT FROM THE PROVISIONS OF SECTION 29-B,
THE SALE OR LEASE OF REAL PROPERTY ACQUIRED
BY MIAMI-DADE COUNTY FOR DELINQUENT TAXES
WHICH HAS BEEN CONVEYED TO THE CITY BY THE
BOARD OF COUNTY COMMISSIONERS UNDER THE
PROVISIONS OF SECTION 197.592, FLORIDA
STATUTES (1997); AND (2) ELIMINATE THE
REFERENDUM REQUIREMENT FOR THE SALE OR LEASE
OF CITY -OWNED REAL PROPERTY, EXCLUDING
WATERFRONT PROPERTY, WHEN LESS THAN THREE
PROPOSALS OR OFFERS ARE RECEIVED FROM
PROSPECTIVE LESSEES OR PURCHASERS AND THE
VALUE OF THE PROPERTY IS $500,000 OR LESS, AS
DETERMINED BY AN APPRAISAL OF THE PROPERTY
PERFORMED BY A STATE CERTIFIED GENERAL
APPRAISER.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The City Attorney is hereby directed to
prepare an amendment to Section 29-B of the City Charter for a
Special Election to be held on November 3, 1998, thereby
proposing amendments to existing procedures to: (1) exempt from
the provisions of said Charter section the sale or lease of real
property acquired by Miami -Dade County for delinquent taxes which
is conveyed to the City of Miami under the provisions of

Section 197.593, Florida Statutes (1997); and (2) eliminate the
referendum requirement for the sale or lease of city -owned real
property, excluding waterfront property, when less than three
proposals or offers are received from prospective lessees or
purchasers and the value of the real property is five hundred
thousand dollars ($500,000) or less, as determined by an
appraisal performed by a state certified general appraiser.
Section 2. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor!/

1% If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted. If
the Mayor vetoes this Resolution, it shall become effective immediately
upon override of the veto by the City Commission.
