A RESOLUTION AMENDING RESOLUTION NO. 98-159,
ADOPTED FEBRUARY 10, 1998, AUTHORIZING THE
CITY MANAGER TO REALLOCATE THE $400,000
APPROPRIATED IN THE CONTRACT WITH PINO-
FONTICIELLA CONSTRUCTION CORPORATION FOR THE
PROJECT ENTITLED " TOWER THEATER
REHABILITATION, B-3253, SECOND BIDDING ",
FROM AUDIO-VISUAL AND FOOD SERVICE EQUIPMENT,
AND ADDITIONAL CONSTRUCTION WORK TO COVER THE
COST OF RESTORATION OF THE FRONT FACADE AND
INTERIORS OF THE TOWER THEATER BUILDING.
WHEREAS, the City Commission adopted Resolution No. 98-159
on February 10, 1998, allocating funds to the ""Tower Theater
Rehabilitation, B-3253", (CDBG Project No. 799402/Capital
Improvement Project No. 322061), in an amount not to exceed
$400,000, in the contract with Pino-Fonticiella Construction
Corporation to cover the cost of audio-visual and food service
equipment, and additional construction work; and
WHEREAS, the project's Architect and Engineer, Bermello,
Ajamil & Partners and Donnell & Dequesne, PA, have found that the
front facade of the Tower Theater Building, which was to be
preserved for its historical significance, is unsafe and
structurally unsound and recommends that said front facade be

demolished; and
WHEREAS, the actual condition of said structure represents a
threat to the welfare and safety of the public; and
WHEREAS, funding is required to cover the cost of
restoration of the front facade and interiors of the Tower
Theater;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Resolution No. 98-159, adopted February 10,
1998, is hereby amended to authorize the City Manager to
reallocate the $400,000 appropriated in the contract with Pino-
Fonticiella Construction Corporation for the project entitled
"Tower Theater Rehabilitation, B-3253, Second Bidding", from
audio-visual and food service equipment, and additional
construction work to cover the cost of restoration of the front
facade and interiors of the Tower Theater Building.
Section 2. This Resolution shall become effective

immediately upon its adoption and signature of the Mayor.!/

The attached report on the current status of the reconstruction of the Tower
Theater was distributed to the Mayor and City Commission last month. At present
all work has stopped pending a decision on how the remaining funds in the
contract will be used.
It is imperative that the project continue with construction as stated in the report.
For this reason it is recommended that the City move forward with Option 3 of
the report which utilizes the remaining contract funds to the fullest extent
possible in order to complete the building structure and interior.

In accordance with your request of May 29, the following is a report on the status
of the Tower Theater Rehabilitation project.
The contractor has ceased work on the building because unforeseen conditions
revealed major structural deficiencies in the existing front portion of the building
which seriously affect the construction budget and the historic preservation
character of the front facade. The project architect and structural engineer have
advised the City that the front structure is unsound and unsafe and can not be
rehabilitated as originally intended. They have revised their plans which call for
the demolition and rebuilding of the front facade which is beyond the original
scope of work. The following is an in-depth report on the situation with
recommendations regarding the continuation of construction of the project.
Background
Originally, the Planning and Development Department served as the Project
Manager for the design and construction phases of the Tower Theater
Rehabilitation project. This project was bid twice, through the Public Works
Department, under the direction of the Planning and Development Department.
The first bidding was over budget and a decision was made to proceed with
demolition (as a first phase) while the rehabilitation construction was being re -bid.
The demolition contractor, Demolition Masters, did most of the demolition work
but could not finish because of serious concerns regarding the stability and
condition of the existing front portion of the theater. The concern was that the
removal of the existing adjacent floors and roof slabs in the front would cause the
front facade to collapse.
Based on the existing conditions, the project architects, Bermello, Ajamil &
Partners, revised the demolition plans for the front of the building and issued
new documents as an addendum for the second bidding of the rehabilitation
construction. The Planning and Development Department decided to proceed
with the rehabilitation construction recognizing that more funds would be
needed to construct the project and that the original construction schedule would
be extended. in July 1997, the City Commission awarded the construction contract
to Pino-Fonticiella Construction Corp. (P-F), in the amount of $1,982,260, which
included the demolition and a cash allowance of $150,000 for unforeseen
conditions.

Status of Construction
P-F began work September 29, 1997. As the new demolition work progressed, the
actual —existing conditions were exposed. The architects and City inspectors
discovered that the existing structure was significantly different than the
conditions shown in the architect's plans. Over the years, the front portion of the
Tower Theater had undergone several additions and modifications which were
poorly built. The structural integrity of the front portion was found to be unsafe
by the structural engineers, Duquesne and Donnell, Inc.
Because of historic considerations, the architect's construction plans intended to
save a large portion of the front part of the building, particularly the existing
exterior walls. The plans also included demolition of the adjacent roof structure,
the existing concrete mezzanine, and adjacent second floor slab. The intent was to
leave the existing front walls in place by extensive shoring work while demolishing
the adjacent structures.
When these problems first arose, the architects were slow to react. They first
proposed additional remedial work for the front portion of the building to save
the existing front wall. The contractor's price for this work was much higher than
anticipated. The architect then proposed an alternate solution to save money
and the contractor proceeded on this basis when more structural problems were
found. The consultants assumed the front facade had a structural frame and there
was none. Later it was found that there were no foundations under the front
walls. To correct these problems will now require extensive additional work at
extra cost. The contractor went as far as he could and then stopped work in the
front area of the building, waiting for directions from the architect. Meanwhile,
the contractor continued working at a slower rate in other areas of the building.
On February 2, 1998, P-F submitted delay claims for all the work stoppages they
incurred to date.
At the City Commission meeting of February 10, 1998, after considerable discussion
about the status of the Tower Theater project and the Planning and Development
Department's request for additional funds intended for food service and audio
visual equipment, the Commission approved a $400,000 increase in the
construction contract. In mid -March, the City Manager directed Public Works to
provide a construction project manager from Public Works' staff and to furnish a
status report on the project (see report dated March 31, 1998). Because of the
large number of problems associated with the project, the City Manager directed
Public works to take over as project manager and try to resolve the outstanding
design and construction issues. Public Works made an investigation of all the
construction problems and the funding available to finish the project. In addition
to the major problem with the front facade structure, there is an extensive list of
construction changes that are either comp!eted or pending (see Attachment 1).
Also attached (Attachment 2) is an analysis of the estimated cost of Change Orders
to date (through May 29, 1998) and the Cash Allowance (Special Provisions) in the
construction contract. We are currently estimating a construction funding
shortfall of $285,000, assuming no future major problems.

on May 12, 1998, the contractor notified Public Works that they were shutting
down the project and demobilizing due to incomplete plans and the need for
further direction.
RECOMMENDATIONS
There is not enough budgeted funding to complete the construction as currently
planned. The existing construction must be brought to some point of conclusion
until more funding is available. The following are recommended options to
accomplish this:
Option 1. Obtain additional funding to complete the project as planned.
Option 2. At a minimum, continue construction of the building shell and
structure to render the building safe using existing funding.
Option 3. To the maximum extent possible, continue construction of the
building and interiors except for certain equipment and furnishings
utilizing all existing funding, including the $400,000 allotted for food
service and audio-visual equipment. The building could be opened
when the additional funding is obtained to provide the necessary
equipment and furnishings.
At this point we will need direction as to which options should be pursued to
continue the construction on the project. Hurricane season is underway and the
structure needs to be made safe, including completion of the outer shell. Based
upon the information contained in this memorandum, I will schedule a discussion
item regarding the continued construction of this project for the next available
Commission meeting.
