PROPOSALS FROM LOCAL NOT FOR PROFIT AGENCIES
THAT PROVIDE SERVICES TO PERSONS WITH AIDS AND
ARE DESIROUS OF OWNING AND OPERATING THE
PROPERTY IN ACCORDANCE WITH THE TERMS AND
CONDITIONS SET FORTH IN SAID RFP; APPOINTING A
REVIEW COMMITTEE TO EVALUATE THE PROPOSALS
SUBMITTED TO THE CITY AND TO MAKE
RECOMMENDATIONS TO THE CITY COMMISSION FOR ITS
CONSIDERATION.
WHEREAS, at the December 16, 1993 City Commission Meeting, the City Commission
adopted Resolution No. 93-769, which awarded $569,652 in 1993 HOPWA funding to Christian
Community Service Agency ("CCSA"), for the purpose of acquiring and rehabilitating the
property located at 14590-92 Southwest 2641h Street, 26431-33 Southwest 146th Court and

26421 Southwest 146t' Court, Miami, Florida, located in the Naranja area of Miami -Dade
County, consisting of three (3) duplexes, commonly referred to as Casa De Los Milagros
("Property"), to be used to provide permanent affordable housing for low income persons with
HIV/AIDS and their families; and
WHEREAS, prior to the purchase of said Property, CCSA agreed to the City's
requirement of placing a restriction on the deed for the properties to be used to provide affordable
housing for persons with HIV/AIDS; and
WHEREAS, the Property was acquired and rehabilitated by CCSA and is currently being
used to provide permanent affordable housing for low income persons with HIV/AIDS; and
WHEREAS, on March 4, 1996, CCSA executed a mortgage and security agreement with
City National Bank on the Property without the City's knowledge or consent; and
WHEREAS, CCSA terminated its operations on September 30, 1997 and ceased to
provide both management and supportive services to the clients residing at the Property; and
WHEREAS, the City was notified on January 27, 1998, that City National Bank had filed
a complaint to foreclose on the mortgage of $200,000.00 on the Property; and
WHEREAS, at the May 26, 1998 City Commission Meeting, the City Commission
adopted Resolution No. 98-500, which authorized the City Manager to acquire the Property from
City National Bank by allocating an amount not to exceed $200,000.00 in 1997 HOPWA funds
for said purpose, and to negotiate the conveyance of said duplexes with the South Florida Jail
Ministries/AGAPE Women's Center ("AGAPE"); and
WHEREAS, the HOPWA Advisory Board has recommended that rather than conveying
said Property to AGAPE, that the City issue a Request for Proposals for the purpose of soliciting

proposals from various local not for profit agencies that provide services to persons with
HIV/AIDS; and
WHEREAS, the City Commission must appoint members to the HOPWA RFP Review
Committee to review the proposals submitted pursuant to the RFP and to recommend for
approval the proposal that is in the best interest of the City; and
WHEREAS, at the June 15, 1998, HOPWA Advisory Board (HAB) meeting, the attached
Request for Proposals was approved by the HOPWA Advisory Board for issuance by the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. Resolution No. 98-500, passed and adopted by the City Commission on
May 26, 1998, is hereby amended by rescinding Section 3, whereby the City Manager was given
authorization to negotiate the transfer of the property located at 14590-92 Southwest 264`h
Street, 26431-33 Southwest 146th Court and 26421 Southwest 146th Court, Miami, Florida, in the
Naranja area of Miami -Dade County ("Property") to South Florida Jail Ministries/AGAPE.
Section 3. The City Manager and the City Attorney are hereby authorized and
directed to acquire from City National Bank said Property consisting of three duplexes, commonly

referred to as Casa De Los Milagros Project, at a cost not to exceed $200,000.00.
Section 4. The City Manager is hereby authorized to issue a Request for Proposals
("RFP"), in substantially the attached form, for the purpose of soliciting proposals from local not
for -profit agencies that provide services to persons with HIV/AIDS and are desirous of owning
and operating said Property in accordance with the terms and conditions set forth in the RFP.
Section 5. The following individuals are hereby appointed as members of the RFP
Review Committee to evaluate each proposal and render a written report of its evaluation and
recommendations to the City Commission for its consideration:

Section 6. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor. '-/
' If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from
the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

The City of Miami, in conjunction with Miami -Dade County, and the cities of
Hialeah and Miami Beach, announces a Request For Proposals (RFP) for the
purpose of soliciting not -for -profit HIV/AIDS service agencies to operate the Casa
de Los Milagros Project and the provision of supportive services to the tenants. The
Project is located in the Naranja area of southern Miami -Dade County. The
successful proposer will be assisted by the City to secure the property and with
funding to assist in defraying the costs of operating and supportive services to be
provided to the tenants.
Proposers may use up,,to 7% of the awarded grant amount for administrative
expenses. The RFP ciR be obtained at the City of Miami, Department of
Community Development, ,Housing Division, located at 444 S.W. Second Avenue,
2nd Floor, Miami, Florida 33130, (305) 416-2098. Proposals must be submitted with
all requirements, and must be received on or before Friday, July 31, 1998, at 4:00

proyecto Casa de Los Milagros y provean servicios de apoyo a los inquilinos. El
proyecto esta localizado en el area de Naranja, en el sur del Condado Miami -Dade.
El solicitante triunfador sera ayudado por la Ciudad a obtener la propriedad y con
fondos para ayudar a sufragar los costos y los servicios de apoyo en que se incurra.

II. HOPWA PROGRAM INTRODUCTION
The City of Miami, Florida, through this Request for Proposals (RFP) is soliciting
proposals from not -for -profit HIV/AIDS service agencies desirous of owning and
operating the Casa de Los Milagros Project, for the provision of housing and supportive
services to low income persons with HIV/AIDS, and their families. The City of Miami
will be willing to convey ownership of the Casa de Los Milagros Project and provide
operational funding to the successful not -for -profit HIV/AIDS service agency submitting
the most responsive proposal in response to this RFP.
The Casa de Los Milagros Project is a group of three (3) duplexes located at 14590-92
S.W. 264 Street, 26421-23 S.W. 146 Court, and 26431-33 S.W. 146 Court, in the
Naranja community of unincorporated southern Miami -Dade County, Florida. These
three (3) contiguous properties are improved with three (3) buildings. Each building has
two (2) apartments, and each apartment has two (2) bedrooms and one bathroom.
Currently, the project is not owned by the City of Miami, however, the City will assist the
selected agency in obtaining ownership of the property.
Previously, the Casa de Los Milagros Project was purchased by Christian Community
Service Agency (CCSA) with the -use of funds from the City of Miami's Housing
Opportunities for Persons With AIDS (HOPWA) Program. CCSA ceased operating the
project on September 30, 1998. Currently, the property has a first mortgage from City
National Bank. City National Bank has agreed to work with the City of Miami in order to
be able to deliver clear and unencumbered title/deed for the subject properties to the
agency selected through this RFP process.
ELIGIBLE PROPOSERS: Not -for -profit corporations actively registered and in
good standing in the State of Florida.
All entities receiving HOPWA Program funds shall be required to submit quarterly
reports, as well as, periodic information related to the HUD required Annual Progress
Report (APR). Applicants may use up to seven (7%) of the awarded grant amount for
administrative expenses.

stated deadline will not be considered. Incomplete applications will not be considered.

copies must be submitted, in one inch, three ring binders, and tabbed. The City reserves
the right to reject any and/or all proposal(s) at its own discretion, waive certain
requirements, and increase or decrease funding.

III. Scope of Services: Operations & Supportive Services
The scope of services is to provide housing and supportive services to residents, being low
income persons with HIV/AIDS, and their families who reside at the Casa de Los Milagros
Project. The City of Miami will assist in funding the costs of operations and supportive services.
Eligible operating costs include maintenance, security, operation, insurance, utilities, furnishings,
equipment, supplies, and other incidental costs (Appendix C 24CFR Part 874.300(b)(8)). Eligible
supportive services costs include, but are not limited to, health, mental health, assessment,
permanent housing placement, drug and alcohol abuse treatment and counseling, day care,
nutritional services, intensive care when required, and assistance in gaining access to local, State,
and Federal government benefits and services, except that health services may only be provided to
individuals with AIDS and not to family members of these individuals (Appendix C 24CFR Part
874.300(b)(7)).
The goal of this Request For �roposals (RFP) is to seek a not -for -profit HIV/AIDS service
agency willing to own and operate the Casa de Los Milagros Project, in order to provide six units
of permanent affordable housing and supportive services to low income persons with HIV/AIDS,
and their families. '
OBJECTIVES:
1. To find a not -for -profit HIV/AIDS service agency with experience in assisting low income
persons with HIV/AIDS, and their families, with their housing and supportive services
needs.
2. To find a not -for -profit HIV/AIDS service agency with the capacity to assist up to six low
income persons or households, wherein at least one person has HIV/AIDS.
3. To find a not -for -profit HIV/AIDS service agency having geographic accessibility in
southern Miami -Dade County.
4. To find a not -for -profit HIV/AIDS service agency having multilingual capability, i.e.,
capable of communicating in English, Spanish, and Creole.
5. To find a not -for -profit HIV/AIDS service agency with existing linkage agreements with
other HIV/AIDS service agencies for services not provided directly by the proposer to its
clients, which services could normally be expected to be needed by low income persons
with HIV/AIDS.
6. To find a not -for -profit HIV/AIDS service agency which can provide all of the above to
the residents of Casa de Los Milagros in a cost effective manner, and which has a
reasonable plan for the project to reach self sufficiency within five (5) years.

REQUIREMENTS:
1. Housing must be used on a year round basis for persons living with HIV/AIDS, and their
families, whose household income does not exceed eighty percent (80%) of the HUD
defined median income for the area. (See HUD Median Incomes, Appendix B).
2. Client(s) shall pay as rent, the highest of
(a) Thirty percent (30%) of the family's monthly adjusted income (adjustment
factors include the age of the individual, medical expenses, size of family
and child care expenses and are described in detail in 24 CFR 813.102);
(b) Ten percent (10%) of the family's monthly gross income; or
(c) If the family 'I v receiving payments for welfare assistance from a public
agency and a part of the payments, adjusted in accordance with the family's
actual housing costs, is specifically designated by the agency to
meet the family's housing costs, the portion of the payments that is
designated.
3. At a minimum, on an annual basis the housing units must pass housing quality standards
inspections, as defined by Miami -Dade Housing Agency.
4. Agency must comply with the regulations promulgated by the U.S. Department of
Housing and Urban Development for the Housing Opportunities for Persons With AIDS
(HOPWA) Program (24 CFR Part 570 - see Appendix C), and any subsequent
modifications.
5. Agency must agree to a permanent use restriction being placed on the deed to property,
for use by low income persons with HIV/AIDS.
6. Agency must be a not -for -profit corporation actively registered and in good standing in
the State of Florida.

Final Rule for Housing Opportunities
for Persons With AIDS
SUMMARY: This final rule is being issued for the Housing Oppor-
tunities For Persons with AIDS (HOPWA) Program. The program
provides States and localities with resources and incentives to
devise long-term comprehensive strategies for meeting the housing
needs of persons with acquired immunodeficiency syndrome (AIDS)
or related diseases aid their families. The program authorizes
entitlement grants and competitively awarded grants for housing
assistance and service§. This final rule includes changes made
in response to public comments.
Public Comments and HUD Responses: The following provides
changes to the HOPWA regulations. A discussion of the public
comments and HUD responses on these matters can be found in the
Final Rule as published in the FEDERAL REGISTER on April 11,
1994.
Parts 50 and 574 of title 24 of the Code of Federal Regulations
are amended, as follows:
Part 50--PROTECTION AND ENHANCEMENT OF ENVIROMONTAL QUALITY
1. The authority citation for part 50 is revised to read as
follows:

2. This rule adopts without change as final the amendments

It is respectfully recommended that the City Commission adopt the attached resolution, authorizing the
issuance of a Request for Proposals (RFP), in substantially the form attached, for the purpose of
identifying a not -for -profit organization to own and operate the Casa de los Milagros Project, located in
the Naranja area of Miami -Dade County.
BACKGROUND:
In December of 1993, through Resolution No. 93-769, Christian Community Service Agency was
awarded a grant in the amount of $569,652 from the City's FY 1993 HOPWA Program, for the
acquisition, rehabilitation and operation of three (3) duplexes located at 14590-92 S.W. 264 Street,
26431-33 S.W. 146 Court, and 26421-23 S.W. 146 Court, in the Naranja area of Miami -Dade County.
In October of 1994, the three (3) duplexes were acquired by Christian Community Service Agency and
rehabilitation work was completed in May of 1996. Currently, four (4) of the six (6) units are being
occupied by low income households wherein at least one (1) member has HIV.
At the time that Christian Community Service Agency acquired the properties, the City incorporated a
deed restriction, which required in the event the properties were not used as affordable housing for low
income persons with HIV/AIDS, the said properties would vest in the City. In March of 1996, City
National Bank provided Christian Community Service Agency a mortgage for the subject properties in
the amount of approximately $200,000. Although there was no restriction by the City against Christian
Community Service Agency mortgaging the properties, it was the City's intent that the housing units
would be operated and maintained with a minimal amount of rent payments being charged to the
tenants by Christian Community Service Agency.
In September of 1997, Christian Community Service Agency ceased to operate and foreclosure
proceedings were initiated by City National Bank. City National Bank, as part of their foreclosure
motion, requested that the court set aside the City's deed restriction and to allow the bank to
foreclosure on the properties, thereby, allowing the bank to sell the subject properties without the said
restriction.

At the May 26; 1998 City Commission meeting, through Resolution No. 98-500, the City Commission
allocated up to $200,000 in FY 1997 HOPWA Program funding, for the purpose of purchasing the first
mortgage from City National Bank, if required, to protect the City's interest in the subject properties.
The said resolution further directed the City Manager to negotiate with the successful local AIDS
service provider selected by the HOPWA RFP Review Committee as a result of the City's request for
proposals (RFP), for the conveyance and operation of the subject properties.
On May 26, 1998, a court hearing was held wherein City National Bank filed a motion for a summary
judgment in an attempt to foreclosure the City's interest in the properties via the deed restriction. The
City Attorneys Office opposed the motion and City National Bank did not challenge. Presently, the
attorney for City National Bank would like to discuss some sort of settlement with the City as an
alternative to the foreclosure action. In the event there is still a need to move forward with the
purchase of City National Bank's first mortgage position and take possession of the subject properties,
it is imperative that the City identifies another organization that would own and operate the Casa de los
Milagros Project.
In an effort to identify a local AIDS service provider that would be responsible for maintaining and
operating the Casa de los Milagros Project as permanent affordable housing for persons living with
HIV/AIDS, it is recommended that the City Commission adopt the attached resolution authorizing the
issuance of a RFP for the aforementioned purpose.
