RESOLUTION NO. 9 8- 691
A RESOLUTION AUTHORIZING THE REIMBURSEMENT OF
FUNDS, IN AN AMOUNT NOT TO EXCEED $400,000,
FROM THE LAW ENFORCEMENT TRUST FUND, PROJECT
NOS. 690001, 690002 AND 690003, TO THE CITY
OF MIAMI'S GENERAL FUND, SUCH EXPENDITURES
HAVING BEEN APPROVED BY THE CHIEF OF POLICE
AS COMPLYING WITH THE DEPARTMENT OF THE
TREASURY'S "GUIDE TO EQUITABLE SHARING."
WHEREAS, the Department of the Treasury's "Guide to
Equitable Sharing" authorizes the expenditure of shared cash or
proceeds forfeited for law enforcement purposes; and
WHEREAS, the payment of salaries and overtime costs of
police officers and support staff assigned to investigations and
operations that result in seizures and forfeitures are authorized
as appropriate expenditures of the Law Enforcement Trust Fund;
and
WHEREAS, during Fiscal Year 11997-1998, these costs were
paid out of the City of Miami' s General Fund due to the lack of
available funding in the Law Enforcement Trust Fund; and
WHEREAS, funds, in the amount of $400,000.00 are now
available in the Law Enforcement Trust Fund to reimburse the

General Fund; and
WHEREAS, the Chief of Police has recommended adoption of
this Resolution and has determined that the proposed expenditure
complies with the Department of the Treasury's "Guide to
Equitable Sharing;"
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The reimbursement of funds, in an amount not
to exceed $400,000.00, from the Law Enforcement Trust Fund,
Project Nos. 690001, 690002 and 690003, to the City of Miami's
General Fund is hereby authorized, such expenditures having been
approved by the Chief of Police as complying with the Department
of the Treasury's, "Guide to Equitable Sharing."
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.1/

If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached Resolution,
authorizing the reimbursement of monies to the General Fund towards the City of Miami's
Recovery Plan, and allocating funds therefor, in an amount not to exceed $400,000.00.
Funding is to be provided from the Law Enforcement Trust Fund, from Project Numbers 690001,
690002 and 690003.
BACKGROUND:
The City's Recovery Plan provides for $1,808,024 in Law Enforcement Trust Fund monies to be
allocated toward eliminating the City's deficit in FY' 97-98. There is $400,000.00 available to
reimburse the General Fund at this time which will be applied towards the salaries, fringe benefits,
and overtime costs of officers and civilian support personnel assigned to investigations and
operations that have resulted in seizures and/or forfeitures. The remaining amount of $600,024
will be allocated as soon as funds become available. The Chief of Police has determined that this
is a permissible use of shared cash or proceeds of forfeited property as outlined in the Department
of the Treasury's, "Guide to Equitable Sharing for Federal, State and Local Law Enforcement
Agencies."
