Home My WebLink AboutR-98-0681J-98-728 Q 7/13/98 RESOLUTION NO. 9 8 - 681 A RESOLUTION BY A FOUR FIFTHS (4/5THS) AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING THAT AN EMERGENCY SITUATION EXISTS FOR THE IMPROVEMENTS REQUIRED AS RELATED TO THE PROJECT ENTITLED ""SOUTH SERVICE ROAD EMERGENCY RENOVATIONS AT MILDRED AND CLAUDE PEPPER BAYFRONT PARK, B - 4 611 " ; WAIVING THE REQUIREMENTS FOR COMPETITIVE BIDDING PROCEDURES, AND APPROVING THE AWARD OF SAID PROJECT TO HORIZON CONTRACTORS, INC., FOR A TOTAL PROPOSED AMOUNT NOT TO EXCEED $32,900.00; ALLOCATING FUNDS THEREFOR AS PREVIOUSLY ALLOCATED PURSUANT TO RESOLUTION NO. 98-544 (CONTRIBUTIONS FROM BAYSIDE CENTER LIMITED PARTNERSHIP, BAYFRONT VENTURES D/B/A BAYFRONT PRINCESS, AND THE BAYFRONT PARK MANAGEMENT TRUST CAPITAL IMPROVEMENTS ACCOUNT); AUTHORIZING THE CITY MANAGER TO EXECUTE AND/OR ISSUE THE NECESSARY DOCUMENT (S), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH HORIZON CONTRACTORS, INC., FOR SAID PROJECT. WHEREAS, pursuant to Resolution No. 98-544, adopted May 26, 1998, the City Commission approved, in principle, the emergency repair of the traffic circle located on the south service road in the Mildred and Claude Pepper Bayfront Park (""Bayfront Park") , at an estimated amount of $50,000; and WHEREAS, pursuant to Resolution No. 98-545, adopted May 26, 1998, the City Commission accepted donations from Bayfront Ventures d/b/a Bayfront Princess, in the amount of $20,000, and Bayside Center Limited Partnership, in the amount of $20,000, for CITY COMMISSION MEETING OF, J U A 1 4 1998 hew1ution NO. 98- 681 repair of said traffic circle on the south service road at Bayfront Park; and WHEREAS, the City Manager has made a finding that said south service road has inadequate traffic turn around for service vehicles and buses, constituting a valid public emergency; and WHEREAS, the nature of said emergency requires the immediate repair of asphalt pavement and the addition of a new traffic lane to improve traffic circulation for service vehicles and buses to protect the safety and welfare of the citizens of the City; and WHEREAS, the required procedures and scheduling requirements for formal advertising, receipt of bids, award of contract and processing of contract will needlessly and unwisely delay the improvement of said service road; and WHEREAS, Section 18-83 of the Code of the City of Miami, Florida, as amended, provides for the emergency procurement of required goods and services for public works projects and improvements; and WHEREAS, after receipt of informal bids, it was determined that Horizon Contractors, Inc. is the lowest responsive and responsible bidder; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this - 2 - r 1 � Section. Section 2. By a four -fifths (4/5ths) affirmative vote of the members of the City Commission, after a duly advertised public hearing, the City Manager's finding that a valid emergency exists for the improvements required as related to the project entitled "'South Service Road Emergency Renovations at Mildred and Claude Pepper Bayfront Park, B-4611" is hereby ratified, approved and confirmed, competitive bidding procedures are hereby waived, and the award of said project to Horizon Contractors, Inc., for a total proposed amount not to exceed $32,900.00, is hereby approved, with funds therefor hereby allocated for said services as previously allocated pursuant to Resolution No. 98-544 (contributions from Bayside Center Limited Partnership, Bayfront Ventures, d/b/a Bayfront Princess, and the Bayfront Park Management Trust Capital Improvement Account). Section 3. The City Manager is hereby authorized'/ to execute and/or issue the necessary document(s), in a form acceptable to the City Attorney, with Horizon Contractors, Inc. for the emergency improvements as related to the project entitled the *,',South Service Road Emergency Renovations at Mildred and Claude Pepper Bayfront Park, B-4611" Section 4. BACKGROUND: The Department of Public Works, in an effort to serve all residents of the City of Miami, has determined that it is now in order for the City Commission to ratify the City Manager's emergency finding justifying informal bids and award a contract to Horizon Contractors, Inc. in the amount of $32,900. The reasons for the emergency finding are as follows. The City of Miami has made a commitment to the existing and new lease holders at Mildred and Claude Pepper Bayfront Park to provide adequate service vehicle access including service vehicles and buses in a timely manner. In order to meet this commitment, it is necessary to construct the improvement on the South Service Road immediately.
