J-98-732 7/13/98 RESOLUTION NO. 9 669 A RESOLUTION ACCEPTING THE BID OF TOBIN CONSTRUCTION CO., IN THE PROPOSED AMOUNT OF $153,045, TOTAL BID OF THE PROPOSAL, FOR THE PROJECT ENTITLED "BAYFRONT PARK - PAINTING OF TOWERS AND FOUNTAIN PROJECT, B-3265"; ALLOCATING FUNDS THEREFOR FROM PROJECT NO. 331401, AS APPROPRIATED BY FISCAL YEAR 1997-1998 CAPITAL IMPROVEMENT ORDINANCE NO. 11623, AS AMENDED, IN THE AMOUNT OF $153,045 TO COVER THE CONTRACT COST AND $1,000 TO COVER THE ESTIMATED EXPENSES, FOR AN ESTIMATED TOTAL COSTS OF $154,045; AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH SAID FIRM. WHEREAS, sealed bids were received July 2, 1998, for "Bayfront Park - Painting of Towers and Fountain Project, B-326511; and WHEREAS, the City Manager and the Director of the Department of Public Works recommend that the bid from Tobin Construction Co. be accepted as the lowest responsible and responsive bid; and WHEREAS, Fiscal Year 1997-1998 Capital Improvement Ordinance No. 11623, as amended, appropriated monies for the proposed amount of the contract, project expenses, and incidentals under Project No. 331401; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY CITY COMMMON NMTTING OF J U I 1 4 1998 BmMkUti= Na 98 669 OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The July 2, 1998 bid of Tobin Construction Co., in the proposed amount of $153,045, for the project entitled "Bayfront Park - Painting of Towers and Fountain Project, B-326511, for the total bid of the proposal, based on lump sum and unit prices, is hereby accepted at the price stated therein. Section 3. The total estimated project cost of $154,045 is hereby allocated from Project No. 331401, as appropriated by Fiscal Year 1997-1998 Capital Improvement Ordinance No. 11623, as amended. Said total project costs consists of the $153,045 contract cost and $1,000 estimated expenses incurred by the City. Section 4. The City Manager is hereby authorizedl/ to enter into an agreement, in a form acceptable to the City Attorney, on behalf of the City of Miami with Tobin Construction Co. for "Bayfront Park - Painting of Towers and Fountain Project 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. - 2 - 98- 669 B-326511, total bid of the proposal. I telephoned Mr. Pours, asking him to also send the list of projects his firm e had accomplished over the last twenty years. When he did so, I learned that the list of projects a was satisfactory, but that he had been with Aarya Construction for a inperiod of only eight years. It is my belief that Aarya Construction is a nonresponsive, unqualified bidder for this project. The second low bidder, RJB Builders Corporation, did submit a satisfactory list of jobs, and demonstrates the required twenty years of experience.
