A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF THE
MEMBERS OF THE CITY COMMISSION, AFTER A DULY
ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING
AND CONFIRMING THE CITY MANAGER'S FINDING OF SOLE
SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE
SEALED BIDDING PROCEDURES AND APPROVING THE
PURCHASE OF NON -LETHAL WEAPON SYSTEMS FROM
SAGE INTERNATIONAL, LTD., IN THE AMOUNT OF
$4,740.00; AND THE AMMUNITION FOR THESE WEAPONS
FROM SAGE CONTROL ORDNANCE, INC., IN THE AMOUNT
OF $2,508.00, THE SOLE SOURCE PROVIDERS FOR THIS
EQUIPMENT, AT A TOTAL COST NOT TO EXCEED
$7,248.00, FOR THE DEPARTMENT OF POLICE;
ALLOCATING FUNDS THEREFOR FROM THE LAW
ENFORCEMENT TRUST FUND, PROJECT NO. 690003, SUCH
EXPENDITURE HAVING BEEN CERTIFIED BY THE CHIEF OF
POLICE AS COMPLYING WITH THE U.S. DEPARTMENT OF
THE TREASURY'S "GUIDE TO EQUITABLE SHARING".
WHEREAS, the Department of Police will be procuring non -lethal weapon systems
and accessory ammunition, which will immobilize subjects without the use of deadly force,
to equip its Specialized Weapons and Tactics Team; and
WHEREAS, funds are available from the Law Enforcement Trust Fund, Project No.
690003; and
WHEREAS, Sage International, Ltd., is the sole source manufacturer of the
non -lethal weapons; and

WHEREAS, Sage Control Ordnance, Inc., is the sole manufacturer of the
ammunition used for these weapons; and
WHEREAS, the Chief Procurement Officer has adopted a finding that Sage
International, Ltd., and Sage Control Ordnance, Inc., are the sole sources for these weapon
systems and ammunition; and
WHEREAS, the finding of the Chief Procurement Officer has been approved and
adopted as the finding of the City Manager; and
WHEREAS, the City Manager and the Chief of Police recommend that the
requirements for competitive formal sealed bids be waived and the procurement of
non -lethal weapon systems from Sage International, Ltd., and the accessory ammunition
from Sage Control Ordnance, Inc., the sole source providers, be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution
are hereby adopted by reference thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a four -fifths (4/5t") affirmative vote of the members of the City
Commission, after a duly advertised public hearing, ratifying, approving, and confirming the
City Manager's finding of sole source, waiving the requirements for competitive bidding
procedures, and approving the purchase of Non -Lethal Weapon Systems, in an amount of
$4,740.00, from Sage International, Ltd., and the ammunition for these weapons, in an
amount of $2,508.00, from Sage Control Ordnance, Inc., the sole source providers for this
equipment, at a total cost not to exceed $7,248.00, for the Department of Police; with
funds therefor hereby allocated from the Law Enforcement Trust Fund, Project No.
690003, such expenditure having been certified by the Chief of Police as complying with
the U.S. Department of the Treasury's "Guide to Equitable Sharing".

Section 3. This Resolution shall become effective immediately upon its adoption.

It is respectfully recommended that the City Commission waive the necessity of competitive bids
and approve the attached Resolution for the purchase of Non -Lethal Weapon Systems, from Sage
International, Ltd., a Non-Local/Non-Minority vendor located at 630 Oakland Avenue, Pontiac,
Michigan, 48342, at a total estimated cost not to exceed $4,740.00, and Ammunition used for these
weapons from Sage Control Ordnance, Inc., a Non-Local/Non-Minority vendor, located at 63-0
Oakland Avenue, Pontiac, Michigan, 48342, at a total estimated cost not to exceed $2,508.00, for a
total amount of $7,248.00. Funding will be from the Law Enforcement Trust Fund, Project
Number 690003.
BACKGROUND
The Police Department will be procuring non -lethal weapon systems with the ammunition used for
these weapons to equip its Specialized Weapons and Tactics Team and enable them to use methods
of immobilizing subjects without the use of deadly force.
The funds to purchase these non -lethal weapons are available from the Law Enforcement Trust
Fund. Funding for these items was approved on October 28`h, 1997 per Resolution No. 97-745.
The Chief Procurement Officer has determined that Sage International, Ltd., is the sole
manufacturer of the non -lethal weapons, and that Sage Control Ordnance, Inc., is the sole
manufacturer of the ammunition used for these weapons.

ENCLOSURES:
An investigation was conducted by the staff from the Department of Purchasing to
determine whether Sage International, Ltd., a non-local/non-minority vendor located at 630
Oakland Avenue, Pontiac, Michigan 48342, is the sole source provider of Non -Lethal
Weapon Systems, and whether Sage Control Ordnance, Inc., a non-local/non-minority
vendor, also located at 630 Oakland Avenue, Pontiac, Michigan 48342, is the sole source
provider of the Ammunition used for this weapon system.
It has been determined that Sage International Ltd. is the sole manufacturer and distributor
of the weapon systems required by the Miami Police Department. Police had required this
product due to the accuracy of the weapon system. The Ammunition utilized by these
weapons is manufactured solely by Sage Control Ordnance, Inc. Contact with both Sage
International and Sage Control Ordnance, Inc. confirmed that the acquisition of the non-
lethal weapons and the ammunition for the same are sole source.
Accordingly, I am recommending that the requirements for competitive bidding be waived,
and these findings be approved: Sage International, Ltd. Is the sole source supplier of the
non -lethal weapons, and Sage Control Ordnance, Inc. is the sole source supplier of the
ammunition to be utilized for these weapons, for a total estimated cost not to exceed
$7,248.00. Funding will be from the Law Enforcement Trust Fund, Project Number 690003.

The Police Department requested the purchase of non -lethal weapon systems with the
ammunition used for these weapons to equip its Specialized Weapons and Tactics Team
and enable them to use methods of immobilizing subjects without the use of deadly force.
The items they require must ensure accuracy and according to Police, the non -lethal
weapons and the ammunition for these weapons can be obtained from Sage International
Ltd. and Sage Control Ordnance, Inc., respectively. Contract with Mr. John M. Klein,
President of both vendors, reported that their non -lethal weapons are "rifle -barreled" to
ensure accuracy, and that they are the sole manufacturers and distributors of both
products.
Therefore, I recommend the acquisition of the Non -Lethal Weapon Systems and the
Ammunition for the same be deemed a sole source.

Sags International Limited is the "sole source" for the SL-6 Multi
Rate Projectile: Launcher and the SL-1 Single Shot Projectile
Launcher which is manufactured in the United States'of America.
No other coimpany manufactures the SL-b or SL-1 weapon systems in
the united States. Sage Control Ordnance inc., manufactures the
37mm ammunition, used for the SL-6 and SL--1 weapons. This
ammunition is also fully compatible with the British ARWON-37
weapon systema,
sage Internationsf Limited, sells directly to police departments
and other law enforcement agencies, there is no distributor program
for the SL-6, SL-1 or ammunition for these weapons.

Shot Projectile Launcher, and the ARW'EN 37. The Ammunition is
manufactured in the United States of America.
No other company manufactures the 37mm ammunition specifically
designed for use with the SL-6 and 3i.-1 wsapon6. This ammunition
is also fully comnatibit with the British ARWEN-37 weapon systems.
Sdse Control drdnanct, Inc., sells directly to police departments
and other 18rr enforcement agencies, there is no distributor program
for our ammunition products.
