J 8- 545 A RESOLUTION ACCEPTING DONATIONS FROM BAYFRONT VENTURES D/B/A BAYFRONT PRINCESS, IN THE AMOUNT OF $20,000, AND BAYSIDE CENTER LIMITED PARTNERSHIP, IN THE AMOUNT OF $20,00, FOR A TOTAL AMOUNT OF $40,000, FOR REPAIR TO THE TRAFFIC CIRCLE ON THE SOUTH SERVICE ROAD LOCATED IN THE MILDRED AND CLAUDE PEPPER BAYFRONT PARK; AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO ACCEPT SAID DONATIONS. WHEREAS, Bayfront Ventures, d/b/a Bayfront Princess, executed a use agreement with Bayfront Park Management Trust for the right to operate a gaming vessel from Bayfront Park; and WHEREAS, Bayfront Ventures is planning to begin operations on August 15, 1998; and WHEREAS, the sole public access to the gaming vessel is by the south service road adjacent to Bayside Marketplace; and WHEREAS, the traffic circle via the service road is currently being used for the valet parking by Bayside Marketplace; and WHEREAS, there is a necessity to make improvements to the south service road and traffic circle to assist in the control of traffic; and CM COMUSSION MEETING OF MAY Z 6 1996 Revoludon No. 98- 545 WHEREAS, Bayfront Ventures, d/b/a Bayfront Princess, and Bayside Center Limited Partnership will benefit from the improvement; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized to accept donations from Bayfront Ventures d/b/a Bayfront Princess, in the amount of $20,000, and Bayside Center Limited Partnership, in the amount of $20,00, for a total amount of $40,000, for repair to the traffic circle on the south service road located in the Mildred and Claude Pepper Bayfront Park. Section 3. The City Manager is authorized) to execute the necessary documents, in a form acceptable to the city attorney, to accept said donations. Section 4. This Resolution shall become effective immediately upon its adoption. ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and City Code provisions. -r 98- 545 PASSED AND ADOPTED this 26th day of ATTEST: May , 1998.
