HomeMy WebLinkAboutR-98-0529J-98-263 5/4/98 RESOLUTION NO.5 2 9 A RESOLUTION ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER TO APPROVE THE FINDINGS OF THE SELECTION COMMITTEE AS TO THE MOST QUALIFIED TEAMS, IN RANK ORDER, TO PROVIDE PLANNING AND DESIGN SERVICES IN THE FIELDS OF ENGINEERING AND LANDSCAPE ARCHITECTURE FOR THE RIVERSIDE RIVERFRONT REDEVELOPMENT PROJECT; AUTHORIZING THE CITY MANAGER TO NEGOTIATE WITH THE MOST QUALIFIED TEAMS, IN RANK ORDER, UNTIL HE ARRIVES AT AN AGREEMENT WHICH IS FAIR, COMPETITIVE AND REASONABLE; FURTHER DIRECTING THE CITY MANAGER TO PRESENT THE NEGOTIATED AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO THE CITY COMMISSION FOR FINAL APPROVAL. WHEREAS, the City of Miami, pursuant to Resolution No. 97-866, adopted December 9, 1997, designated the Riverside Riverfront Redevelopment Project (the "Project") as "Category B" for the acquisition of professional planning and design services; and WHEREAS, said Project requires the services of a qualified engineering firm, as prime consultant, and a landscape architectural firm to first assess City properties located on the Miami River as to their needs for dredging, shoreline stabilization, access and other improvements, and then to prepare a master plan and complete construction drawings for certain improvements to the property known as Lummus Park/Pioneer Club site, including a riverwalk, boat slips, shoreline stabilization, public plazas, lighting and landscaping; and y COMMSSION MEETING OF MAY 2 6 1998 R&Wlution No. 98- 52 WHEREAS, Resolution No. 97-866 also appointed a Certification Committee of professionals in the field of endeavor and appointed the Chairperson of the selection committee to review the qualifications and related information provided by those responding to a Request for Qualifications ("RFQ") for said professional services; and WHEREAS, a competitive selection process, as described herein, was duly conducted in accordance with Chapter 287, Florida Statutes, and Section 18.81 of the Code of the City of Miami, Florida, as amended; and WHEREAS, the City of Miami advertised and issued the RFQ for the required services for the Project on December 29, 1997; and WHEREAS, ten (10) proposals were received by the City Clerk on January 26, 1998, and the Certification Committee subsequently reviewed and certified nine (9) proposals in accordance with established criteria; and WHEREAS, the Competitive Selection Committee evaluated the nine (9) certified proposals according to criteria established in the RFQ, and "short-listed" five (5) teams to participate in a presentation and interview; and WHEREAS, the Selection Committee subsequently interviewed and evaluated, also according to criteria stated in the RFQ, the five teams and then adopted as its finding, the five teams in specified rank order as most qualified to provide the required professional services for this Project; and WHEREAS, the City Manager has reviewed the report of the Selection Committee and recommends that its findings as to the rank order of the most qualified teams be approved, NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: -2- 98- 529 Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Commission hereby authorizes the City Manager to negotiate an agreement with the Team ranked first as set forth in Section 2 herein. In the event that the City Manager cannot negotiate an agreement which, in his opinion, is fair, competitive and reasonable with the Team ranked first, then he is hereby authorized to terminate such negotiations and to proceed to negotiate with the second most qualified Team, and so on through the ranked providers, until a satisfactory agreement is reached. Section 4. The City Manager is hereby directed" to present the negotiated agreement, in a form acceptable to the City Attorney, to the City Commission for final approval. Section 5. This Resolution shall become effective immediately upon its adoption. The legislation would also authorize the City Manager to negotiate with the most qualified teams, in rank order, until he arrives at an agreement which is fair, competitive and reasonable, and further directs that the negotiated agreement be presented to the City Commission for final approval. BACKGROUND The Department of Planning and Development administered a consultant selection process and has prepared the attached documentation. The City Commission, in accordance with FS 287 and City Code Section 18-81, adopted Resolution No. 97-866 on December 9, 1997, designating the Riverside Riverfront Redevelopment Project as a Category B Project for the acquisition of planning and design services. This effort is part of a comprehensive project that covers nearly all City -owned property on the Miami River, and which today has a total project budget of $1,294,000 funded from several sources listed below. The project timeline is estimated at 36 months from the start (consultant selection) through the completion of construction. As additionally noted below, the funding sources also have specified deadlines, after which time the City will lose funds. It is therefore imperative that the City proceed with the project in a timely fashion. Each phase of the work is to be reviewed and approved by the City before the consultant may proceed to the next phase. The first phase involves data collection, survey, site assessment, and feasibility analysis, and will result in priority recommendations for each of the City's riverfront properties and their relative needs for access improvements (riverwalks, boat ramps or slips), dredging, storm water controls, revegetation and the like. A work program will then be developed with the City's input and approval. This will be followed by design, permitting and construction of the needed improvements, with the Lummus Park/Pioneer Club site as the focal point of a master plan to spur economic efforts in the Riverside District. Resolution No. 97-866 appointed three licensed engineers (from City staff) as the a Certification Committee for the selection process, and also appointed the Director of Planning and Development as the Chairperson of the Competitive Selection Committee, as provided in the City Code. The members of the Selection Committee were appointed by the City Manager and included seven City staff (also as stipulated in the City Code), one representative of the State's Department of Environmental protection (both a funding and regulatory agency for this project), and one member of the community. These committees were to review the qualifications and related information provided by those responding to the City's Request for Qualifications ("RFQ") for said professional services. A detailed report of the competitive selection process is enclosed, and is summarized here. The RFQ was issued December 29, 1998 and ten (10) proposals were received January 26, 1998. Of the ten (10) proposals, nine (9) were certified by the Certification Committee in accordance with established criteria. The Selection Committee then evaluated the remaining nine (9) certified proposals and "short-listed" five (5) for further consideration by presentation and interview. On Thursday, February 12, 1998, the Selection Committee interviewed the five (5) proposer teams and concluded to rank the proposals in the following order as most qualified. During this process, the Certification Committee, with the assistance from staff, reviewed each submission for compliance with the submission requirements of the RFQ. This review alsoperformed the task of verifying that each proposal included all the documents required in Section III, "Submission Requirement" of the RFQ. The members of the Certification Committee also determined whether the team presented in each proposal favorably demonstrated the following factors, as stipulated in the RFQ and in Code Section 18-81. 1. Capability and adequacy of personnel for the Project. 2. Satisfactory past performance in administration and in cooperation with former clients and contractors. 3. Performance in meeting time schedules and budgets. 4. Past record and experience. Prior to review by the Certification Committee, staff from the Department of Planning and Development contacted one or more of the references listed on the Previous Relevant' Experience Form for a brief interview on the team's past performance. The Certification Committee meeting was tape recorded and advertised in the Miami Review as a public meeting. A summary of this meeting is set forth below: The Certification Committee reviewed the ten (10) proposals in accordance with the established procedures. Of the ten (10), nine (9) were certified, and one (1) proposal (Arvelo and Associates, Inc.) was not certified for the following reasons. 1. The proposer did not provide a narrative describing the methodology and approach to be utilized for the project, innovations and/or creative solutions previously used or proposed. 98- 529 RIVEMSIDE RIVERFRONT REDEVELOPMENT''^OJECT COMPETI', . SELECTION PROCESS REPORT - Ce. cation Phase 2.1The proposer did not provide a current Certificate of Status from the Department of State, as stated in the RFQ (as of January 1997) for the prime consultant, and none were submitted for two sub -consulting firms (Brown & Crebbin Design Studio, Inc. & Pacetti Architects, Inc.). 3. The proposer did not fully complete the Previous Relevant Experience Forms provided in the RFQ. There were no telephone numbers provided for contacts for the prime consulting firm, and most of the other references did not provide phone numbers. The staff was therefore unable to verify the relevant experience. 4. The proposer did not provide a letter stating that lump -sum method of payment, as stated in the City's policy, was acceptable. Additionally, the proposer did not provide a document allocating the proposed professional fees among consulting team members. FINDINGS AND CONCLUSIONS OF CERTIFICATION C0b24ITTEE Regarding the certified proposals, the Certification Committee made the following findings and conclusions. 1. One proposal (C.A.P. Engineering Consultant, Inc.) failed to include the Minority/Women Status Information Sheet. The Committee decided to waive this irregularity, since .the information requested on that Sheet was provided in two other sections of the -proposal (specifically, the Minority/Women '4 Business Registration Affidavit & Status and Information Sheet and on the Professional Fee Distribution Statement). 2. Several proposals did not submit a current Certification of Registration Status from the Department of State for corporations included as subconsultants. The Committee also decided to waive this irregularity since the RFQ also requested current licenses from the date of January 1997. 3. One proposal (Bermello-Ajamil and Partners, Inc.) did not provide a conflict of interest letter for Mr. Willy Bermello who is Chairman of the City of Miami Urban Development Review Board. Since this will require the City Commission approval if that firm is ultimately selected, the Committee agreed to waive this irregularity. 4. One proposal (Milian, Swain & Associates, Inc.) omitted question #6 from the 255 Standard Form. The Committee agreed to waive this irregularity. The Committee completed a Certification Form for each of the ten teams, indicating "certified" or "not certified". The Forms were signed by each committee member and are attached as Exhibit 2. The Certification Committee adjourned at 2:45 p.m. after completing its deliberations. 98- 529 RIVERSIDE REDEVELr'4ENT PROJECT - COMPETITIVE SELr LION PROCESS REPORT SELECTION CONMITTEE REPORT INITIAL EVALUATION PHASE Pursuant to City Code Section 18-81 (e)(2)b, the City Manager appointed nine (9) members to serve on the Competitive Selection Committee for the Project (see Exhibit 3). One of the appointees, Ms. Betty Fleming, was unable to serve on the Committee. Staff provided assistance in determining whether the prime or subconsultant firms were located within the City or within the County, and whether the prime or subconsultant firms were minority/women owned firms. The Committee decided to adjourn and reconvene on February 5, 1998 at 2:00 p.m. (The Assistant City Attorney advised that additional advertisement was not required, however, notices of the meeting were posted throughout the building on that day.) 9.
