BETE COMPANY, INC., THE SOLE SOURCE PROVIDER FOR THIS SERVICE, AT A PROPOSED COST OF $21,000.00 FOR THE DEPARTMENT OF POLICE; ALLOCATING FUNDS THEREFOR FROM THE LAW ENFORCEMENT TRUST FUND, PROJECT NOS. 690001, 690002, AND 690003, SUCH EXPENDITURE HAVING BEEN CERTIFIED BY THE CHIEF OF POLICE AS COMPLYING WITH FLORIDA STATE STATUTES, CHAPTER 932.7055, AS AMENDED, AND THE U.S. DEPARTMENT OF THE TREASURY'S, "GUIDE TO EQUITABLE SHARING," AND SUBJECT TO APPLICABLE CITY CODE PROCUREMENT PROCEDURES. WHEREAS, Florida State Statutes, Chapter 932.7055, as amended, and U.S. Department of the Treasury's "Guide to Equitable Sharing," authorize the expenditure of forfeiture proceeds for law enforcement purposes not considered normal operating expenses; and CITY COKK MIOM MEETING OP, MAY 1 2 1998 Resolution No. 98- 463 WHEREAS, the Miami Police Department Community Affairs Section sponsors several programs utilizing various publications which are distributed to different community groups, and which publications include anti -drug education, crime prevention, bicycle safety and a host of other related topics; and WHEREAS, these publications will be used in, and funds will come from, the Officer Friendly Program, which is funded from the Law Enforcement Trust Fund, and has been previously certified by the Chief of Police as complying with Florida State Statutes, 932.7055, as amended, and the U.S. Department of the Treasury's "Guide to Equitable Sharing"; and WHEREAS, the Chief of Police has recommended adoption of this Resolution; and WHEREAS, funds to cover this purchase is available in the City of Miami Law Enforcement Trust Fund, Project Numbers 690001, 690002, and 690003; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote of the members of the City Commission, after duly advertised public hearing, ratifying, approving and confirming the City Manager's finding of sole source, waiving the requirements for competitive bidding procedures, and approving the acquisition of crime prevention publications from Channing L. Bete Company, Inc., the sole source provider for this service, at a proposed total cost $21,000.00, for the Department of Police, is hereby approved, with funds therefor hereby allocated from the Law Enforcement Trust Fund, Project Numbers 690001, 690002, and 2 98- 463 690003, such expenditure having been certified by the Chief of Police as complying with Florida State Statutes, Section 932.7055, as amended, and the U. S. Department of the Treasury's "Guide to Equitable Sharing," and subject to compliance with applicable City Code procurement provisions. Section 3. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue a purchase order for these services. Section 4. Bete Company, Inc., at a total cost not to exceed $21,000.00. Funding will be from the Law Enforcement Trust Fund, Project Numbers 690001, 690002, and 690003. BACKGROUND: The Police Department uses these booklets in conjunction with their Officer Friendly Program. The booklets cover a wide selection of anti -crime and anti -drug topics. They are filled with useful tips on preventing crime and substance abuse. The Department distributes them to schools, day care centers, civic groups, elderly sites and through station tours. The funds to purchase these booklets are available from the Law Enforcement Trust Fund, specifically, the Officer Friendly Program account. Funding for this program was approved on February 10', 1998, Resolution No. 98-131. The Chief Procurement Officer has determined that Channing L. Bete Company, Inc. be deemed a sole source. An investigation was conducted by my staff to determine whether Charming L. Bete Company, Inc., a non-minority/non-local vendor located at 200 State Road, South Deerfield, Ma. 01373, is the sole source provider of these booklets. Contact was made by staff with Lt. Melvin Uptgrow of the Miami Police Department. He reported that the booklets are the same type of booklets previously acquired as a sole source from Charming L. Bete Company, Inc. At the present time, it is the department's desire to acquire more of these same booklets for the Officer Friendly Program, with some changes in topics from those previously acquired. Contact was also made with Mr. Bill Gonzalez, Account Executive for the Charming L. Bete Company, Inc. He reported that his firm remains the publisher, sole creator, sole supplier, and holds the copyright for the Scriptographic Crime Prevention Booklets being sought by the Police Department. In addition, on January 5, 1996, the acquisition of Scriptographic Crime Prevention Booklets was deemed a sole source by Purchasing and the former City Manager. The City Commission approved this acquisition as a sole source via Resolution No. 96-40. The proposed cost for the procurement of the Scriptographic Crime Prevention Booklets is in an amount not to exceed $21,000.00. Funds to cover the cost of these booklets will be from the Law Enforcement Trust Fund, Project Numbers 690001, 690002, and 690003.
