HomeMy WebLinkAboutR-98-0455J-98-460 4/30/98 RESOLUTION NO. 9 8- 455 A RESOLUTION AUTHORIZING THE REIMBURSEMENT OF GENERAL FUND MONIES TO THE CITY OF MIAMI RECOVERY PLAN, IN AN AMOUNT NOT TO EXCEED $400,000.00, FROM THE LAW ENFORCEMENT TRUST FUND, PROJECT NUMBERS 690002 AND 690003 SUCH EXPENDITURES HAVING BEEN APPROVED BY THE CHIEF OF POLICE AS COMPLYING WITH THE DEPARTMENT OF THE TREASURY'S "GUIDE TO EQUITABLE SHARING." WHEREAS, the Department of the Treasury's "Guide to Equitable Sharing" authorizes the expenditure of shared cash or proceeds forfeited for law enforcement purposes; and WHEREAS, the City's Recovery Plans provides for $1,808,024 in Law Enforcement Trust Funds to be allocated towards eliminating the City's deficit in FY' 97/98; and WHEREAS, an amount of $400,000 is available to reimburse the General Fund at this time; and WHEREAS, the remaining amount of $1,408,024 will be allocated as soon as additional funds become available; and WHEREAS, this payment will be applied toward authorized salaries and overtime cost of officers and support staff assigned to investigations and operations that result in seizures and forfeitures; and WHEREAS, the Chief of Police has recommended adoption of this Resolution and has determined that the proposed expenditure complies with the Department of the Treasury's "Guide to Equitable Sharing;" and CITY COMMISSION MEETING OF MAY 12 1998 Resolution No. WHEREAS, funds to cover this expenditure for purposes of reimbursing the General Fund are available in the City of Miami Law Enforcement Trust Fund; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The reimbursement of General Fund monies to the City of Miami Recovery Plan, in an amount not to exceed $400,000.00, is hereby authorized, with funds therefor hereby allocated from the City of Miami Law Enforcement Trust Fund, Project Numbers 690002 and 690003, such expenditures having been approved by the Chief of Police as complying with the Department of the Treasury's, "Guide to Equitable Sharing." Section 3. This Resolution shall become effective immediately upon adoption. PASSED AND ADOPTED this 12th day of May , 1998. Recovery Plan City Manager ENCLOSURES: Reimbursement RECOMMENDATION: FILE : It is respectfully recommended that a Resolution, authorizing the reimbursement of monies to the General Fund towards the City of Miami's Recovery Plan, and allocating funds therefor, in an amount not to exceed $400,000.00, be approved. Funding is to be provided from the Law Enforcement Trust Fund, from Project Number 690002 and 690003. BACKGROUND: The City's Recovery Plan provides for $1,808,024 in Law Enforcement Trust Fund monies to be allocated toward eliminating the City's deficit in FY' 97-98. There is $400,000.00 available to reimburse the General Fund at this time which will be applied towards the salaries, fringe benefits, and overtime costs of officers and civilian support personnel assigned to investigations and operations that have resulted in seizures and/or forfeitures. The remaining amount of $1,408,024 will be allocated as soon as funds become available. The Chief of Police has determined that this is a permissible use of shared cash or proceeds of forfeited property as outlined in the Department of the Treasury's, "Guide to Equitable Sharing for Federal, State and Local Law Enforcement Agencies."
