RESOLUTION NO. - 447
A RESOLUTION, WITH ATTACHMENT(S), CLOSING,
VACATING, ABANDONING AND DISCONTINUING FOR
PUBLIC USE THE PORTION OF CORNELIA DRIVE AND
GREENWOOD ROAD, MIAMI, FLORIDA, MORE
PARTICULARY LEGALLY DESCRIBED HEREIN.
WHEREAS, the Miami Zoning Board at its meeting of March 16,
1998 Item No. 4, duly adopted Resolution No. ZB 1998-0035 by a
seven to zero (7-0) vote, recommending APPROVAL, as set forth
herein; and
WHEREAS, the Public Works Department and the Plat and Street
Committee have studied the subject vacation and closure and
determined that it will not affect pedestrian or vehicular
traffic circulation or access for public service vehicles since
the roadway is not the right-of-way which is being closed by this
action; and
WHEREAS, the Plat and Street Committee has reviewed the
subject tentative plat and determined that all technical
requirements have been met, and vacation of the subject
right-of-way would benefit the general public; and
WHEREAS, the Department of Public Works and the Plat and
Street Committee recommend approval of said vacation request; and

WHEREAS, the City Commission finds that it is in the best
interest of the general welfare of the City of Miami and its
inhabitants to grant the vacation and closure of a portion of the
subject right-of-way, and deems it advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. A portion of public right-of-way being the
portion of Cornelia Drive and Greenwood Road, Miami, Florida,
more particularly legally described in Exhibit "A", attached
hereto and made a part hereof, is hereby closed, vacated,
abandoned and discontinued for public use.
Section 3. This Resolution shall become effective
immediately upon its adoption.

PUBLIC WORKS ANALYSIS FOR
CORNELIA DRIVE AND GREENWOOD ROAD
The Public Works Department and the Plat and Street Committee have studied the
proposed closure and vacation of Cornelia Drive and Greenwood Road and
determined that the closure of this roadway will not adversely affect traffic
circulation or access for public service vehicles such as trash and garbage trucks,
fire, police and/or other emergency vehicles. These roadways are not part of the
critical pedestrian and vehicular transportation network for the neighborhood. The
Plat and Street Committee has reviewed the tentative plat of "Ritz -Carlton" and
determined that all technical requirements contained in the City Code Subdivision
Regulations have been met and the closure of these roadways and development of
the property would benefit the general public. The property owner must provide a
specific attorney's opinion addressing the reversionary rights of the roadway as
part of the Hearing Board's application process. Based on the criteria contained in
the Subdivision Regulations of the City Code, the Public Works Department and
the Plat and Street Committee recommended approval of this roadway closure and
vacation request.

The City of Miami Plat and Street Committee, at its meeting of March 5, 1998,
approved the above tentative plat subject to the following revisions being made
to the tentative plat, additional information being provided and/or variances
being granted. Please be advised that the processing of your tentative plat cannot
proceed until these conditions have been satisfied:
• Show centerline of adjacent streets in main sketch.
• Parking lot encroachment needs to be removed or a bond with appropriate
insurance until December, 2000 needs to be provided, unless extended by
Public Works Director.
• A unity of title will be required for bank building.
• opinions of Title will be required for roadway vacations. _Provide square
footage of area to be vacated and legal descriptions. Provide a statement
from a Florida attorney addressing the issue of reversionary rights with regard
to the vacation and closure of the streets. This statement must be provided at
the public hearing before the Miami Zoning Board.
• Provide an express purpose statement.
• Reference section line as centerline. Also reference monument line.
• Two (2) new fire hydrants will be required.
• A 20-foot emergency access easement will be required between Tigertail
Avenue and S.W. 27 Avenue.
• Remove building encroachment on S.W. 27 Avenue or post bond along with
appropriate insurance.

Several interior buildings encroach across tract lines. Provide a unity of title
for same.
Provide square footage for each tract.
• The Plat and Street Committee in reviewing the request to close Cornelia Drive
and Greenwood Road has considered the public interest requirements as found
in Chapter 55 of the Miami City Code. These requirements having been met,
the Plat and Street Committee recommends the vacation and closure of these
two (2) rights of way.
In addition to the above requirements, you should be aware of the following:
1. State and local laws require the installation of various physical improvements in
the .public rights -of -way when property is platted. These subdivision
improvements include paving, drainage, landscaping, sidewalks, etc In some
cases this could represent a substantial investment on your part.
2. The alteration, relocation or installation of utilities such as storm and sanitary
sewers, electric, telephone, water, etc., caused by this plat will be at the
property owner's expense. Also, utility easements may be required on the
property being platted.
3. A building permit will not be issued on the property being platted until the
final plat is recorded. Also, the Certificate of Occupancy for any building
construction will be issued only after all the required subdivision
improvements have been completed.
4. Approval for fire flow requirements must be obtained from the Fire -Rescue
Department prior to the issuance of a building permit. S. Additional items must be provided to the City of Miami Department of Public
Works before the final plat is submitted to the City Commission for approval.
You will be notified in writing as to what these items are after the amount of
the bond has been determined for the necessary subdivision improvements.
6. Tentative plat approval is only valid for one (1) year from the date of the Plat
and Street Committee meeting at which time it was approved.

We have been advised that an Application for Closure and Vacation of Public Right -of -Way
adjoining property owned by the "OWNERS" has been filed with the Hearing Board's Division of
the Building and Zoning Department of the <ity of Miami and that all documents in conjunction
therewith have been properly filed with said Division.
It is our further understanding that an appropriate meeting by the Plat and Street Committee
of the City of Miami has been held with reference to such closure in conjunction with the tentative
plat of Ritz Carlton.
It is our further understanding that the Plat and Street Committee of the City of Miami has
requested an Opinion as to the ultimate ownership of the portions of the street or right-of-way areas
above -described being closed as a result of such Application for Closure and Vacation of Public
Right -of -Way and replatting of the total property, including the vacated Public Right -of -Way.
DISCUSSION
We have examined the Plat that originally committed the portions of the Public Right -of -
Way question, as well as the Florida Statutes, and determined the following: -
We have examined the Plat of DAY GROVE TERRACE, recorded in Plat Book 9, Page 180,
Public Records of Dade County, Florida. On its face is the following Statement:
"And we do hereby dedicated to the Perpetual use of the Public for street purposes the Road
and Streets shown on said Plat, reserving unto ourselves, our heirs, executors, administrators
and assigns, the reversion or reversions thereof whenever discontinued by Law."
We have further examined the Florida Statute and have determined that Section 177.085 of
the Florida Statutes reads as follows:
"When any owner of land subdivides the land and dedicates streets, other roadways, alleys or
similar strips on the map or plat, and the dedication contains a provision that the reversionary

interest in the street, roadway, alley or other similar strip is reserved unto the dedicator or his
heirs, successors, assigns, or legal representative, or similar language, and thereafter conveys
abutting lots or tracts, the conveyance shall carry the reversionary interest in the abutting
street to the center line or other appropriate boundary, unless the owner clearly provides
otherwise in the conveyance."
OPINION
Based upon the presumption that proper and appropriate steps have been taken to close the
Public Right -of -Way as above -described and on the further presumption that none of the
Deeds in the chain of title of the abutting land contained a personal reversionary interest in
the abutting streets, it is our Opinion that by virtue of the conditions set forth in the Plat and
Statute quoted above, that that portion of land (being Cornelia Drive) bounded on the
Northwest by a line 25.00 feet Southeasterly and parallel with the centerline of Tigertail
Avenue; bounded on the East by a line 50.00 feet Westerly of and parallel with the centerline
of SW 27th Avenue; bounded on the North and Northeast by Parcel "A" as described in
attached Exhibit "A"; and bounded on the South and Southwesterly by Parcel `B" and Parcel
"C" as described in attached Exhibit "A". Said portion of land lying entirely in the City of
Miami, Miami -Dade County, Florida, said lands containing 26008 square feet, has become
the property of the abutting land owners to the centerline on each side. Since the same
owners own all lots and the abutting land, that ownership by virtue of the closing of the
aforedescribed Public Right -of -Way adjoining the respective land, has placed title to the said
Public Right -of -Way in the abutting land owners, the applicants listed above. It is our
further Opinion that by virtue of the conditions set forth in the Plat and Statute quoted above,
that that portion of land (being Greenwood Road) bounded on the West and South by Tract
"A", GROVE MOUNTAIN REPLAT, according to the Plat thereof, recorded in Plat Book
128, Page 39. of the Public Records of Miami -Dade County, Florida. Said lands lying in and
being the City of Miami, Florida; bounded on the North by Lot 45, DAY GROVE
TERRACE, according to the Plat thereof, as recorded in Plat Book 9, at Page 180 of the
Public Records of Miami -Dade County, Florida; and bounded on the East side by a line
50.00 feet Westerly of and parallel with the centerline of S.W. 27th Avenue, said lands
containing 1959 square feet has become the property of the abutting land owners on both
sides, which is Grove Miami Holdings Inc.
