HomeMy WebLinkAboutR-98-0437J-98-475 4/28/98 RESOLUTION NO. 9 8 437 A RESOLUTION DECLARING AN EXEMPTION FROM THE PROHIBITIONS CONTAINED IN SECTION 36-4(a) OF THE CITY CODE (THE "NOISE ORDINANCE") FOR DATES SPECIFIED HEREIN IN CONNECTION WITH THE FILMING OF CERTAIN ACTION SEQUENCES FOR THE USA NETWORK TELEVISION BEING PRODUCED BY SCREENVENTURES I PRODUCTIONS, INC. WHEREAS, Screenventures I Productions (USA), Inc. (the "Applicant") is currently filming a television series for the USA Network Television at various locations throughout the City of Miami, Florida; and WHEREAS, the Applicant has represented to the City that on approximately ten (10) occasions, between the dates of April 30th and August 13th, 1998, between the hours of 5:00 P.M. and 5:00 A.M., the Applicant will film action scenes, including gunfire, at Jose Marti Park; and WHEREAS, the Applicant is requesting that the City Commission declare an exemption from Section 36-4 of the City Code in the event the filming of said sequences creates noise audible at a distance of 100 feet from Jose Marti Park for said dates designated hereinabove; and CITY COrMUSSION, MEETING OF APR 2 8 1998 Resolution No. .99- 437 �► WHEREAS, the Applicant will comply with all applicable laws, ordinances and all other regulations and obtain all required permits from the applicable authorities; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. An exemption is hereby declared from the prohibitions contained in Section 36-4(a) of the Code of the City of Miami, Florida, as amended, between April 30th to August 13th, 1998 (approximately ten occasions), between the hours of 5:00 P.M. and 5:00 A.M., in connection with the filming of certain action sequences to take place at Jose Marti Park, Miami, Florida, for the USA Network television series produced by Screenventures I Productions, Inc. Section 3. This Resolution shall become effective immediately upon its adoption. 2 - 98- 437 PASSED AND ADOPTED this 28th day of ATTEST: April 1 1998.
