HomeMy WebLinkAboutR-98-0429J-98-450 4/13/98 RESOLUTION NO. 9 8- 429 A RESOLUTION, WITH ATTACHMENT, DECLARING SURPLUS CERTAIN CITY -OWNED PROPERTIES AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A' ATTACHED HERETO AND MADE A PART HEREOF; AUTHORIZING AND DIRECTING THE CITY MANAGER TO SELL OR LEASE THE CITY -OWNED REAL PROPERTIES DESCRIBED IN EXHIBIT "A' (THE "PROPERTIES"); FURTHER AUTHORIZING THE CITY MANAGER TO: (i) ESTABLISH THE MINIMUM SALES PRICE FOR THE PROPERTIES TAKING INTO CONSIDERATION THE APPRAISED VALUE OF THE PROPERTIES AS ESTABLISHED BY THE RESULTS OF TWO INDEPENDENT APPRAISALS AND THE ASSESSED VALUE OF THE PROPERTIES AS DETERMINED BY THE COUNTY PROPERTY APPRAISER; (ii) EMPLOY SUCH PROCEDURES AS MAY BE REQUIRED BY THE CITY CHARTER OR CODE FOR PURPOSES OF DISPOSING OF THE PROPERTIES; (iii) ACCEPT RESPONSIVE AND RESPONSIBLE BIDS; (iv) NEGOTIATE PURCHASE AND SALE AGREEMENTS OR LEASE AGREEMENTS; AND PRESENT THE NEGOTIATED AGREEMENTS TO THE CITY COMMISSION FOR FINAL APPROVAL. WHEREAS, the City Commission hereby declares the City -owned real properties which are more particularly described in Exhibit "A', surplus; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: ATTACHMENT () APN1998 R"duGonCONTAINED 98- 429 Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized and directed to sell or lease the City -owned real properties described in Exhibit "A" (the "Properties"). Section 3. The City Manager is further authorized to: (i) establish the minimum sales price for the Properties taking into consideration the appraised value of the Properties, as established by the results of two independent appraisals and the assessed value of the properties as determined by the County Property Appraiser; (ii) to employ such proceduresV as may be required by the City Charter or Code for purposes of soliciting offers for the purchase or lease of the Properties; (iii) accept responsible and responsive bids; (iv) negotiate purchase and sale agreements or lease agreements; and (v) present the negotiated agreements to the City Commission for final approval. Section 4. This Resolution shall become effective immediately upon its adoption. �i The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 98:_ PASSED AND ADOPTED this 2 8 th day of April iggg. CITY OF MIAMI, FLORIDA 15 INTER -OFFICE MEMORANDUM TO: The Honorable Mayor and DATE : April 28, 1998 FILE: Members of the City Commission Declaration of Surplus SUBJECT: Properties and Authority to Sell or Lease FROM: Jose Garcia -Pedrosa REFERENCES: City Commission Meeting 4/28/98 City Manager Commercial Property List ENCLOSURES: RECOMMENDATION It is recommended that the City Commission adopt the attached Resolution declaring surplus certain city -owned properties attached herewith. Further authorizing and directing the City Manager to sell or lease the properties; establish. the minimum sales price; employ procedures as required by the City Charter or Code for purposes of soliciting offers for the purchase or lease; accept responsible and responsive bids; negotiate purchase and sale agreements or leases; and present the negotiated agreements to the City Commission for final approval. BACKGROUND The City currently owns 10 parcels of land which are either vacant or do not provide a market rent to the City. Some of these properties are encumbered by month to month revocable permits or management agreements which can be terminated or are in default. These properties were acquired for either park use, municipal service use or as a result of liens, and foreclosures. These properties have been reviewed by all departments and are not required for any municipal function. They represent a maintenance cost to the City, and some do not generate ad valorem taxes. The sale of these properties will contribute greatly to the revitalization of the neighborhoods in which they are located. The properties will be sold at fair market value as required by Section 29-B of the City Charter. It is in the best interest of the City to sell these properties, divest itself of the liabilities associated with their ownership, and put them on the tax rolls. Due diligence may reveal title problems or deed restrictions that would inhibit the sale of some of these properties. Appraisals have not been completed on these properties.
