WHEREAS, the Department of General Services Administration requires the procurement of XTS 3000, MTS 2000 and LTS 2000 portable radios with Smartnet software; and WHEREAS, the purchase of said portable radios is necessary to preserve public safety and welfare; and WHEREAS, there are numerous Code enforcement inspectors performing their duties without the vital life link of a radio; and WHEREAS, Motorola, Inc. is the sole source manufacturer of the existing 800 MHz radio system, and the operating and maintenance software for the Smartnet system is proprietary to Motorola, Inc.; and WHEREAS, the Chief Procurement Officer has adopted a finding that Motorola, Inc. is the only vendor able to provide XTS 3000, MTS 2000, and LTS 2000 portable radios with the Smartnet software; and WHEREAS, the finding of the Chief Procurement Officer has been approved and adopted as the finding of the City Manager; and APR 2 8 IM Rew1u6on no. 98- 42 WHEREAS, the City Manager and the Director of the Department of General Services Administration recommend that the requirements for competitive formal sealed bids be waived and the procurement of XTS 3000, MTS 2000, and LTS 2000 portable radios with SMARTNET software from Motorola, Inc., the sole source provider, be approved; and WHEREAS, funds for the initial purchase of LTS 2000 portable radios, in an amount not to exceed $45,000. are hereby allocated from Community Development Block Grant funds appropriated from prior year funds designated for Code Enforcement, Account Code 799211.452264.6.940; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote of the members of the City Commission, after a duly advertised public hearing, ratifying, approving, and confirming the City Manager's finding of sole source for the provision of XTS 3000, MTS 2000, and LTS 2000 portable radios with Smartnet software, waiving the requirements for competitive sealed bidding procedures and approving the initial purchase of thirty-nine (39) LTS 2000 portable radios with Smartnet software from Motorola, Inc., the sole source provider, at a total cost not to exceed $45,000, with funds therefor hereby allocated from Account Code No. 799211.452264.6.940. Section 4. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue purchase orders for said acquisitions. Section 5. Lauderdale, Florida. The acquisition of radio model LTS 2000 shall be at a total cost not to exceed $45,000. BACKGROUND The purchase of the aforementioned radios is necessary in order to preserve public safety and welfare. Currently there are numerous Code Enforcement officers performing their duties without the vital life link of a radio. The immediate and continuous ability of these inspectors to communicate with a dispatcher is critical to the effective, efficient, and safe completion of their assignments. Motorola, Inc. is the sole manufacturer of the existing 800 MHz radio system. The engineering, original design and installation of the system was executed by Motorola, Inc. In addition, the operating and maintenance software for the SMARTNET System is proprietary to Motorola, Inc. Therefore, this purchase of thirty nine (39), LTS 2000 portable radios with Smartnet software is a sole source acquisition. The proposed deployment of these radios to the NET Code Enforcement Inspectors shall allow for the reassignment of a limited number of radios. The reassigned radios shall be used by Building and Code Compliance Inspectors. This will enable us to deal with the portable radio shortage in the most efficient and cost-effective manner.
